Certificate in Legal Practice
The CERTIFICATE IN LEGAL PRACTICE (CLP) is a professional level examination
regulated by the Malaysian Legal Profession Qualifying Board1.

With a CLP qualification, one becomes a ‘qualified person’ by virtue of Section 3 of


the Legal Profession Act 19762, who can then choose to complete their pupillage
with a view to be admitted as an Advocate and Solicitor in Malaysia.

The CLP EXAMINATION (CLPE) is commonly known for its high standards which
ensures only qualified and fittest candidates enter and serve as members of the
legal profession in Malaysia.

The Entry Requirements
The LPQB is a statutory body empowered under LPA 1976 to decide on the
requirements for one to qualify to sit for the CLPE.

The basic entry requirements for UK LAW DEGREE HOLDERS are as follows:
[1] Achievement at SPM or its equivalent3
 A minimum of 5 credits at SPM level or its equivalent obtained in one and
the same examination

AND
[2] Achievement at STPM or its equivalent4
 A minimum of 2 principal passes at STPM level or its equivalent obtained in
one and the same examination.

 Duration of the STPM course or its equivalent shall be a minimum of 1


academic year.

AND
[3] A recognized law degree5
 Studied for a minimum of 3 academic years and a minimum of 12 subjects.

 The 12 law must include 6 core subjects, namely Law of Contract; Law of
Torts; Constitutional Law; Criminal Law; Land Law; and Equity & Trusts,
which each was studied for the duration of 1 academic year.

 For University of London LL.B holders, the degree must be completed


within 6 years from registration (first year) AND the candidate must have
obtained at least a Second Class Lower law degree.

CLP Examination [PSAG]
The CLP Examination, also known as, Peperiksaan Sijil Amalan Guaman
(PSAG) is conducted twice (2) every year:
 The Main Examination typically takes place in July/August; and
 The Referral/Supplementary Examination is commonly conducted in
October/November.

To register for the CLP Exam, a candidate must:


[1] Firstly apply to LPQB to sit for the Exam.
 The application period usually opens in November/December & candidates are
required to pay an Application Processing Fees of RM250.00** to LPQB.

[2] Candidates with successful applications, will then proceed to register for the Exam
between the months of February – April (year of the Exam). To register, candidates
will pay LPQB a total of RM 5,800.00**:-
 RM4, 000.00** being the Registration Fee; and
 RM1, 800.00** as the Examination Fee.
**These fees are stipulated by LPQB & may be subject to change from time to time.

Starting from PSAG 2021, a registration for the CLP Examination is valid for a
period of five (5) years only, within which each candidate is entitled to a
maximum of four (4) sittings/attempts.

Should a candidate fail the Exam after his/her fourth attempt OR should the five
(5) year-registration period expires, the candidate will no longer be allowed to
re-apply/re-register for the CLP Exam.

CLP Examination [PSAG]
All CLP candidates must sit for five (5) compulsory papers in the CLP
Examination, comprising of:
 Civil Procedure
 Criminal Procedure
 Evidence
 Professional Practice
 General Paper

There are no optional papers and all candidates must pass all five (5) papers in
one sitting.

Candidates who fail one (1) of the five (5) papers in Main Examination will be
given a Conditional Pass, and allowed to re-sit the one (1) paper in a total of three
(3) trials within the period of four (4) years of his/her registration.

Candidates who fail in two (2) or more papers will be considered to have failed
the Exam as a whole and will be required to retake all five papers within the four
(4) years of the registration for the Exam.

On a yearly basis, the CLP Examination is conducted physically at the University


Malaya’s Examination Building. There is only one venue for this Exam nationwide.
However due to Covid-19 pandemic, the LPQB will conduct the PSAG subject to
strict compliance with standard operating procedures (SOPs).6

exposes students to the many procedural
rules and practices involved in enforcing
rights and obligations in civil matters.

Accordingly, the subject matter is structured

EXAMINATION FOCUS

 A working knowledge of the civil procedural rules contained in Rules of


Court 2012 & related law and practices in relevant statutes and case law.
 Analytical thinking and flexibility in answering examination questions.

The Civil Procedure paper will contain a total of seven (7) questions.
Candidates must answer one (1) unseen compulsory question and three
(3) other questions.

Candidates are allowed to refer to the RULES OF COURT 2012 (ROC 2012),
which will be provided during the examination. Candidates are not allowed
to bring into the examination hall their own copy of ROC 2012.

 A firm grasp of the Criminal Procedure Code & Malaysian Penal Code
and related statutes and case law.

to criminal procedure to situational based questions in exams

The Criminal Procedure paper will contain a total of seven (7) questions.
Candidates must answer one (1) unseen compulsory question and three (3)
other questions.

Candidates are allowed to refer to the CRIMINAL PROCEDURE CODE (CPC),


which will be provided during the examination. Candidates are not allowed
to bring into the examination hall their own copy of CPC.

EXAMINATION FOCUS:

 Demonstrate a working knowledge of the statutory law and decided


case laws on scenario based questions
 Draft Statement of Claim (for both areas), based on the situation given
and application of correct legal principles

The General Paper will contain TWO (2) questions: One on Law of Contract,
the other on Law of Tort. Candidates must answer both the questions.

Candidates are allowed to refer to the following statutes during the


examination:
- Contracts Act 1950 (Act 136);
- Specific Relief Act 1950 (Act 137); and
- Civil Law Act 1956 (Act 67).

Candidates will be provided with copies of the above-mentioned statutes


and are not allowed to bring into the examination hall their own copies.

LAW OF EVIDENCE encompasses the study of substantive law and procedural
rules governing the issue of admissibility of evidence in both civil and criminal
trials.

Centered on the Malaysian Evidence Act 1950 and

3. Key concepts and law in relation to;

The Law of Evidence paper contains SEVEN (7) questions. Candidates must
answer ONE (1) COMPULSORY question and THREE (3) other questions.

Candidates are allowed to refer to the EVIDENCE ACT 1950, which will be
provided during the examination and candidates are not allowed to bring
their own copy of the said statute.

SUBJECT OVERVIEW: PROFESSIONAL PRACTICE
PROFESSIONAL PRACTICE encompasses the (1) rules and conventions governing
the general conduct of practitioners in Malaysia and (2) substantive law involved in
key areas of practice in Malaysia. As such, the subject is divided into five components;

[1] Professional Ethics


Ethics of the Legal Profession emphasises an understanding of:
 The functions of Legal Profession Qualifying Board.
 Structure of the Malaysian Legal Profession.
 Admission to and membership in the Malaysian Bar.
 Rules in the Legal Profession (Practice & Etiquette) Rules 1978
 Grounds and conduct of disciplinary proceedings.

[2] Advocacy
This area encompasses appreciation of the required skills
and knowledge of the advocacy world, specifically:
 Duties of counsels towards the court, the legal
profession, their clients and fellow practitioners.
 Advocacy practices before and during trials in courts
(with emphasis on examination of witnesses).
 Extent of counsels’ authority to represent their clients.
 Enforcement of undertakings made by counsels.
 Types and consequences of contempt of court.
 Liability of counsels in negligence.

[3] Probate and administration of estates


Substantive law and practices in relation to administration of estates in Malaysia
are covered under this component;
 Procedures involved in applying grant of representation
 Duties, rights and powers of personal representatives
 Procedures involved in probate actions
 Types of will and law of succession

[4] Law of Bankruptcy and Winding-up


Understanding of the substantive and procedural laws involved in bringing
bankruptcy and winding up proceedings in Malaysia

[5] Land law and land dealings


This component touches on the main features of the Malaysian Torrens system and
the conveyancing practice which is generally governed by the National Land Code
1965;
- Power of State Authority to alienate land.
- The concept of indefeasibility of title.
- Powers of Land Registrars.
- Rectification of errors in land registry.
- Searches on titles.
- Security transactions (charges).
- Restraints on land dealings (caveats).
- Law governing housing developers.

EXAMINATION FOCUS:

 Familiarity with the relevant statutory provisions and case


authorities in each area is imperative
 Careful analysis and rationalising of issues presented in questions
and portray correct application of the law

The Professional Practice paper will consist of two sections:


SECTION A:
ETHICS AND ADVOCACY
TWO questions must be answered from a selection of 4 questions

SECTION B:
PROBATE, BANKRUPTCY/WINDING UP & LAND DEALINGS
THREE questions must be answered from a selection of 5 questions

Candidates are allowed to refer to the following statutes which will


be provided during examination:
- Legal Profession Act 1976;
- Insolvency Act 1967 (including the Rules) ; and
- National Land Code 1965

Through its CLP Department, ATC has been providing the CLP Course at both our
campuses in Kuala Lumpur and Penang.

Through this Course, our aim is to produce CLP graduates who possess “sufficient
command of knowledge, skills and aptitude in law to serve the profession, society,
nation and humanity; and also develop a sense of awareness to uphold rule of law
and social justice.” 7

The EDUCATIONAL OBJECTIVES8 of our CLP Course are to produce legal


professionals who, inter alia:
 Understand fundamental legal principles, practice and procedures of
Malaysian law;
 Integrate professional value of ethics and professionalisms in accordance with
the Legal Profession Act 1976; and
 Meet the expectation of clients, the profession and society.

THE CLP+ SERIES stands for our “CLP LEGAL PERSPECTIVES SERIES”. By
incorporating the CLP+ Series into our CLP Course, we aim to not only produce CLP

DATO’ JOSHUA KEVIN

Adjunct Professor of Law Faculty Taylor’s University
Advocate & Solicitor

Dato’ Kevin is an integral part of the CLP faculty in ATC. Kind and
passionate, Dato’ Kevin possesses excellent teaching skills that
never fails to produce excellent results amongst his students. In
2009, he established his own legal practice under the name and
style of Kevin & Co. and the firm has since grown to have four
branches in Malaysia today. His depth of legal knowledge and
experience as a legal practitioner is an invaluable asset which
profoundly benefits aspiring lawyers. Presently, Dato’ Kevin is the
Course Advisor of ATC’s CLP programme, and he lectures on
Criminal Procedure and Professional Practice at both our KL and
Course Advisor
Penang campuses. Besides the CLP programme, he has provided
Senior Lecturer
talks on land law, business law and company law at various
seminars and conferences. To date, Dato’ Kevin has authored and
Subjects Taught: co-authored a number of publications on Malaysian Law that have
 Criminal Procedure proven beneficial to academicians, students and practitioners. To
 Professional Practice name a few, his contributions in the Malaysian Law Journal (MLJ)
(Land Law & Dealings) are - “Land Law (CLP Series on Professional Practice)” and “Prinsip-
prinsip Penting Perundangan Tanah Di Malaysia”. Dato’ Kevin has
recently co-written a book on ‘Criminal Procedure & Practice in
Malaysia’, published by CLJ in 2022.

Advocate & Solicitor

Mr. Ravi is a renowned figure in both the legal practice and


academic field. Meticulous and highly knowledgeable, Mr. Ravi has
been contributing tremendously to the success of ATC. He has over
18 years of experience in lecturing on Law of Evidence to our
undergraduates in the University of London LLB programme. He
mainly maintains his practice in the area of corporate and
commercial litigation and shares his extensive knowledge in Civil
Procedure with our CLP students. Mr. Ravi is a Partner at Messrs.
Sreenevasan Young.

Ms. Irene teaches on the LLB degree and CLP programmes at ATC.
She has had contributed tremendously to the national and
international successes of ATC as its former Moot Director.
Ms. Irene is passionate about the pursuit of knowledge and
believes that the study of law is as fascinating as it is relentless.
She teaches Civil Procedure and Contract Law on our CLP
programme. She is Partner in charge of the Intellectual Property &
Privacy practice group of Messrs. Azri, Lee Swee Seng Co.

CHOONG KAK SEN

Mr. Kak Sen comes with a wealth of varied experience in legal


practice. After having obtained a Second Class (Upper) in his CLP
examination, including a distinction for Law of Evidence, Mr. Kak
Sen joined the Attorney General’s Chamber and served as a Deputy
Public Prosecutor for 3 years. He has since appeared in many
reported cases. An inspirational individual, Mr. Kak Sen adds a
unique dimension into the CLP faculty. He currently lectures and
tutors on Law of Evidence and Criminal Procedure in the CLP
Senior Lecturer programme at both our KL and Penang campuses. He currently
maintains his practice and is a Partner of Messrs. Gooi & Azura.

SARAVANESH SUPRAMANIAM

Mr. Saravanesh is currently a partner at Messrs. Allen Chee Ram.


His practice encompasses civil and commercial cases,
construction/engineering & housing development matters, and
employment disputes. He joined ATC Penang in 2012 and teaches
on the CLP Programme on a part-time basis. With a dynamic
teaching style, Mr. Saravanesh effectively prepares students for
Civil Procedure and both the components of General Paper.

Mr Sukhindarpal is a practising lawyer at his legal firm Messrs


Singh & Co. He has 25 years of experience in various industries,
especially manufacturing, human resource and engineering. He
joined ATC Penang in 2020 and teaches on the CLP programme on
a part-time basis where he teaches on Criminal Procedure. He has
been active in criminal practice since 2003 with emphasis on
providing legal aid to locals, migrants and refugees with utmost
compassion and dedication. He has a great penchant for efficient
delivery of lectures and tutorials imbued by his vast experience.

Mr. Damien Chan is the founder and Managing Partner of Messrs.


Damien Chan, Hannibal & Ng Chambers, where he handles various
matters ranging from civil litigation to criminal cases. Damien
currently also teaches at ATC on a part-time basis. With persistent
dedication and teaching style, Mr. Damien effectively prepares
students for Criminal Procedure and Professional Paper.

Mr. Sanjay was a legal practitioner with four years of experience in


civil litigation. He joined ATC Penang in the year 2007 and has
since been teaching on the CLP, LLB and A Level Programmes.
Favourite amongst students, Mr. Sanjay mainly teaches Probate,
Bankruptcy and Winding up of companies in the CLP programme.

KASHMIR HARBANS SINGH

Ms. Kashmir teaches on the CLP and University of London’s LLB


programmes. She enjoys sharing her knowledge in the areas of
Company Law, Family Law, and Legal System & Method. She was
admitted as an Advocate and Solicitor in the year 2015 and mainly
dealt with corporate commercial and cross border issues whilst in
practice. She also led the firm’s Business Development division
where she revived the firm’s online publication efforts. An ardent
believer in continuous learning, Kashmir enjoys elucidating the
ever evolving world of law through her research and written
works. Her articles on Malaysian strata laws were published in
Head, CLP KL
Construction Law Journal in 2016, whilst her paper entitled
Senior Lecturer
“Airbnb and Malaysian Stratified Homes” was published by Current
Law Journal in 2019. She has also presented her research papers,
“Women in Boardrooms: Meeting Responsibility through Sensibility”
at the 7th International Conference on Law & Society in 2018, and
“Rethinking Dispute Resolution in Times of BRI” at the inaugural
seminar of the Asian Institute of Alternative Dispute Resolution in
2019. Ms. Kashmir currently coordinates the CLP Department at
ATC and teaches on the subject of Professional Practice.
