01000-THIKA…and (Hereafter called “the lessee or Tenant” expression
include its personnel representatives and assigns) of other part.

IT IS HEREBY AGREED BETWEEEN THE LESSOR AND THE LESSEE AS


FOLLOWS;

1. The LESSOR is the owner of the TEA BUSHES which sits on land parcel
known as LOC .3/gituru/823 and hereby grants and the tenant accept a
rent of one thousand seven hundred (1700) TEA BUSHES for a period of
three years at a total cost of KSHS 91,800(ninety one thousand eight
hundred )which rent is payable as stipulated hereunder subject to the
covenants, agreement, conditions, stipulation and provisions.

2. The total amount of the rent payable for the nine years shall be Kenya
shillings ninety one thousand eight hundred only (ksh 91,800).
Paid as follows.
a) Kenya shillings ninety one thousand eight hundred only (ksh
91,800) paid prior to execution of this agreement where the
lessor acknowledges receipt whereof.
3. Terms and conditions of this agreement shall extend as per the rules and
conditions of Kenya Tea Development Agency (KTDA).
4. The duration of the lease runs for three years commencing from 1 st
January 2022 and expire not later than 31st DECEMBER 2024.
5. The lessor agrees that he has obligation not to interfere with the lessee
business of plucking and accessing the leased tea bushes for the whole
duration of the lease agreement.
6. Time is of essence in this agreement.
7. The lessee covenants with the lessor as follows

a) To pay the rent as aforesaid and stipulated by this agreement.

8 In case of breach of contract the party in breach shall pay the aggrieved party thirty

(30%) per centum of the consideration herein as liquidate damages besides restoring

the innocent person to the original position.

If at the determination of this tenancy or any subsequent tenancy the tea


bushes are returned to the lessor in the same conditions as at commencement
of this tenancy reasonable wear and tear accepted.
- To keep the said commodity (tea bushes) in good condition.

- To safeguard in all ways the tea bushes and notify the lessor of any
matter that may endanger or diminish the status of the commodity (tea
bushes).
- Not to do or omit to do any act, deed or thing that would constitute in
accordance with the laws of Kenya.

In witness here of this agreement has been duly signed by parties’ here the day
