PLEASE TAKE NOTICE that the United States intends to offer evidence under Rules
702, 703, and 705 of the Federal Rules of Evidence in its case-in-chief at trial in this case.
I. PROCEDURAL BACKGROUND
Jordany Rafael Laboy-Garcia, Christian Yamaurie Rivera-Otero and Anthony Steven Lobos
Ruiz, 1 with federal offenses related to the harassment and assault of a transgender woman,
identified in the Indictment as A.N.L., with a paintball gun, because of her gender identity. See
doc. 3. Specifically, Count One of the Indictment charged the defendants with violating 18
U.S.C. § 371 by conspiring with one another to willfully cause, and through the use of a
dangerous weapon attempt to cause, bodily injury to A.N.L. because of her gender identity. Id.
Count Two of the Indictment charged the defendants with violating 18 U.S.C. § 249(a)(2) by
willfully causing, and through the use of a dangerous weapon attempting to cause, bodily injury

to A.N.L. because of her gender identity. Id. Count Two also specifically alleged that in
connection with the offense, the defendants employed a dangerous weapon that had traveled in
interstate and foreign commerce, a paintball gun, and used an instrumentality of interstate and
foreign commerce, a Mazda Protégé. Id. In addition, Count Three of the Indictment charged
violation of 18 U.S.C. § 1519. Id. This matter is set for trial on October 10, 2023.
Pursuant to Rule 16(a)(1)(G) of the Federal Rules of Criminal Procedure, the United
States provides the following disclosure concerning expert testimony that the United States
intends to introduce pursuant to Rules 702, 703, and 705 of the Federal Rules of Evidence. The
United States reserves the right to offer additional testimony by these experts, or other expert
witness(es), and for the experts to amend or adjust their opinions and bases therefor, based on

The United States intends to offer at trial the testimony of Special Agent Christopher
Adam Goodrich. Agent Goodrich has worked as an FBI special agent since 2016 and currently
serves as a special agent on the FBI’s Cellular Analysis Survey Team (CAST). As set forth in his
curriculum vitae, Agent Goodrich has demonstrated expertise in historical cell site analysis,
having received over hundreds of hours of specialized training in analyzing historical call details
records, precision geo-location, and cellular technologies. See Attachment A. In addition, Agent
Goodrich has hundreds of hours of practical experience analyzing historical cell site data and has
testified as an expert in federal court numerous times about historical cell site analysis. Id. Agent
Goodrich has not authored any publications in the last ten years.
The United States expects Agent Goodrich, based on his knowledge, training, skills, and
experience, will testify regarding his analysis of the data obtained for Defendants Laboy-Garcia
specifically, cellular phone numbers: (787) 702-6037, (939) 231-1280, and (407) 989-1017. This
testimony will include, but not be limited to, Agent Goodrich’s analysis of the call detail records,
event data contained in cellular records of the phone numbers, and data of communications,
including cellular tower data establishing the locations of the towers used and the general
location area of the phones. This data will establish the locations as well as communications
between the cellular phones at times relevant to the defendant’s assault of A.N.L. The data may
be presented in graphic form, including through the presentation of an FBI CAST report of
examination, which Agent Goodrich authored. Agent Goodrich is working to finalize his CAST

report of examination and it is expected to be produced to the defense by September 15, 2023. 2

Agent Goodrich’s testimony and report will replace that of FBI CAST Agent Wendell Consenza, who retired from
the FBI during the pendency of this case. Agent Consenza’s FBI CAST report of examination, which analyzed the
same telephone cellular data as Agent Goodrich’s FBI Cast report of examination will analyze, was produced to the
defense on June 17, 2022.

The United States intends to offer at trial the testimony of Matthew Markovich. Mr.
Markovich has served as Digital Investigative Analyst and Digital Forensic Investigator with the
Criminal Section of the Civil Rights Division of the U.S. Department of Justice (DOJ) since
2016. As set forth in his curriculum vitae, Mr. Markovich is a Certified Computer Forensic
Examiner and has been so recognized since 2013 by the International Association of Computer
Investigative Specialists. See Attachment B. Mr. Markovich has been qualified as an expert in
the field of digital forensic examination and has also testified as a fact witness on several
occasions in state and federal court. Id. at 2. Mr. Markovich authored one publication during the
last ten years. Id. at 3. Prior to his time at the DOJ, Mr. Markovich served as a Digital Forensic
Examiner and a Cybercrimes Specialist for the Criminal Investigations Division of the Office of
the Texas State Attorney General. There, he conducted hundreds of forensic examinations on
various forms of digital evidence, to include computers, cellular phones, and tablets. Mr.
Markovich is also a certified law enforcement officer and served as a task force officer with the
FBI when he worked for the Texas State Police for the Office of the Texas Attorney General. Id.
The United States expects Mr. Markovich will testify, based on his knowledge, training,
skills, and experience, about his digital forensic examination of former co-Defendant Lobos-
Ruiz’s cellular device, which the FBI seized pursuant to a search warrant. A copy of the
extraction of former co-Defendant Lobos-Ruiz’s cellular device was produced to all defense
counsel in November 2021. Mr. Markovich’s testimony about his digital forensic examination is
expected to include, among things, his recovery of three deleted iPhone videos which show (1)
the defendants harassing A.N.L., (2) the defendants shooting at A.N.L. with a paintball gun, and
(3) the defendants driving by the location where they had just shot at A.N.L., again looking for

A.N.L. Mr. Markovich’s testimony is also expected to include a description of his forensic
recovery of text messages between Defendant Rivera-Otero’s phone and former co-Defendant
Lobos-Ruiz’s phone, in which the user of Defendant Rivera-Otero’s phone directs the user of
former co-Defendant Lobos-Ruiz’s phone to delete the video evidence of the assault of A.N.L.
Mr. Markovitch is further expected to testify that his digital forensic examination revealed that
after the user of former co-Defendant Lobos-Ruiz’s phone received the messages from the user

The United States intends to offer at trial the testimony of Elizabeth Rosa Mercado. Ms.
Rosa works as a Chemist for the United States Food and Drug Administration (“FDA”). Prior to
joining the FDA in July 2023, Ms. Rosa worked as a Forensic Chemist and then as the
Laboratory Supervisor of the Forensic Chemistry Section of the Institute of Forensic Sciences, in
San Juan, Puerto Rico, for 12 years. As set forth in her curriculum vitae, Ms. Rosa has years of
experience analyzing, and providing testimony, regarding evidence submitted to the Institute of
gunshot residue. See Attachment C. Ms. Rosa is currently in the process of working with the
Institute of Forensic Sciences to obtain the exact case information of trials she has testified in
within the last four years. This information will be provided to the defense as soon as it is
available. Ms. Rosa has not authored any publications in the last ten years. Ms. Rosa has taken
numerous continuing education trainings in the field of forensic science and is a member of both
the College of Chemists of Puerto Rico and the American Academy of Forensic Sciences. Id.
The United States expects Ms. Rosa, based on her knowledge, training, skills, and
experience, will testify about her microscopic examination and chemical analysis of the paintball
shell, hooded jacket, and white towel, recovered by the Police of Puerto Rico from A.N.L.’s,
body and surrounding area at the crime scene, which was submitted by law enforcement to
the Institute of Forensic Science for analysis. Specifically, Ms. Rosa is expected to testify that
each of these items had yellow particles attached to them, and that after conducting a forensic
analysis of the items, she determined that the yellow particles on the paintball shell was
consistent in color, texture, and shine, as well as chemical characteristics, to the yellow particles
found on the clothing recovered from the victims’ body. Ms. Rosa’s report was produced to

The United States intends to offer at trial the testimony of Emanuel Kapelsohn. Mr.
Kapelsohn has served as the President of the Peregrine Corporation since 1985. During that time,
Mr. Kapelsohn has designed, evaluated, and implemented training programs for law enforcement
officers and civilians throughout the United States and several other countries on a broad array of
topics, including the proper use of less lethal weapons and techniques. Mr. Kapelsohn has also
provided technical evaluation of weapons, ammunition, and related items; testified before
numerous government bodies regarding his expertise in firearms and less lethal weapons, to
include the United States Senate Judiciary Committee (Subcommittee on the Constitution), and
the United States House of Representatives Judiciary Committee (Subcommittee on Crime); and
provided expert testimony in multiple state and federal courts, to include providing expert
testimony on weapon safety, weapon use, use of force, paintball and other non-powder guns;
muzzle to target proximity; written training and use materials, including warnings and user’s
manuals; and video evidence. See Attachments D & E. Mr. Kapelsohn has also published
numerous publications in the last 10 years, as indicated in his curriculum vitae. See Attachment
D.
The United States expects Mr. Kapelsohn, based on his knowledge, training, skills, and
experience, will testify about the characteristics and ballistics of paintball guns, including the
subject Spyder MR 100—that the defendants used to assault A.N.L., and about the serious
physical injuries, including facial and eye injuries, that a paintball gun, including the subject
Spyder MR 100, can cause when utilized against a person in an assaultive manner and without
proper safety precautions or protective equipment. Mr. Kapelsohn is expected to testify about his
review of literature regarding the warned dangers and recommended safety precautions that

manufacturer of the Spyder MR 100, have promulgated. Mr. Kapelsohn is also expected to
testify that based on his review of the recovered iPhone video footage showing the defendants
shooting at A.N.L. with a paintball gun from a short-distance within a car, while their target—
A.N.L.—wore no protective clothing or protective equipment, that the defendants used the
paintball gun in an improper manner that did not comply with industry, or Kingman Spyder MR-
100 specific, safety standards or directives, and which could readily cause serious physical
injury. The Kingman MR100 PRO 2012 manual and the ASTM International Standard
Specification for Paintball Markers, 2017 and 2021 versions are expected to be produced to the

Currently assigned to FBI Headquarters CAST Unit as a CAST National Asset responsible for conducting Historical
Call Detail record analysis, drive testing, training, and testimony throughout the United States. Respond to emergency
situations to provide historical and active telephone location analysis. Provide CAST related case consultations to
Local, state, and federal law enforcement officers and prosecutors.
From 2019-2022 assigned to the South Florida Violent Crimes and Fugitive Task Force responsible for investigating
crimes committed by violent offenders including Hobbs act robbery, carjacking, bank robbery, kidnapping, shootings,
