This is “SANAD - Private Motor Vehicle Third Party Liability Insurance Policy”. It is
composed of:

 Insurance cover,
 General terms and conditions,
 Exclusions
 Definitions of insurance terminology stated in the Policy wording
 Extensions relating to the additional (optional) benefits
 Schedule
 Bail Bond
 Endorsements (if any)

o All documents relating to this Policy and its attachments should be read carefully to
understand the limits of cover provided and be well aware of the conditions and
exclusions applied.

o The Proposal completed and signed by the Contributor (Insured) or his legal
representative, this Policy including its terms, conditions, exclusions, limits of cover,
the Schedule, Bail Bond and any endorsements agreed upon in writing and duly
approved by the Company, whether at the commencement of insurance cover or
during the Policy validity date, shall form an integral part of this Policy

o Please keep all Policy documents together in a safe place for easy retrieval thereof in
case you have any claim.

This Policy is concluded to cover the accidents occurring within the Kingdom of Saudi
Arabia in accordance with the decision issued by the Council of Ministers as per No. 222
dated 13/08/1422H for motor vehicles compulsory insurance.

In accordance with its Articles of Association as a company operating under the


cooperative insurance principle pursuant to the terms of the Cooperative Insurance
Companies Supervision Law promulgated by Royal Decree No. M/32 dated 02/06/1424H.

Tawuniya (hereinafter called "the Company") in its capacity as manager of policyholders’


account for the Contributors (Insureds) will manage the insurance operations and the
rights and liabilities arising out thereof. For this purpose, the Company will manage two
separate accounts; the policyholders' account of the Contributors (Insureds) for the entry
of contributions, re-insurance revenues, its share of return on investments, rights and
obligations of policyholders, and another account for shareholders.

The Contributor (Insured) having applied to the Company by a Proposal and a written
declaration and agreed to consider them the basis of this contract and integral part hereof;
to insure the motor vehicle which particulars are stated in the Schedule and having paid
the Contribution required, the Company has hereby issued this Policy in accordance with
its terms, conditions and exclusion stated in the following manner:

Definitions:

The following words, phrases and expressions wherever they appear in this Policy shall
have the meanings, which are given below:

Company : “Tawuniya” in its capacity as manager of


Policyholders’ Account.
Policyholders’ account : The account allocated for entry of policyholders’
contributions collected, returns on investments of
policyholders’ account, compensation received from
re-insurers and any indemnities, fees or other
expenses deducted from it.
Policy : The Unified Compulsory Motor Insurance Policy.
Insured : A natural or juristic person that has entered into an
insurance contract and whose name is stated in the
Policy schedule.
Driver : Any person driving the Vehicle and holding a
driver’s license.
The insured vehicle (the : Any transport means designed to move by wheels
Vehicle): or tracks or propelled using mechanical or animal
power, as described in the Policy (trains are
excluded).
Third Party : Any natural or juristic person sustaining loss or
damage not excluded under the Policy, excluding
the Insured and/or the Driver, or the person
responsible for the accident.
Accident : Any incident that causes damage to a Third Party
due to the use of the Vehicle, or as a result of an
explosion or fire coming from the Vehicle or its
scattered debris, or due to its motion, self-ropulsion
or being stationary.
Physical Damages : Death or physical injuries, which may be inflicted on
a Third Party, including total or partial disability,
whether permanent or temporary.
Material Damages : Destruction occurring to property belonging to a

Third Party.
Expenses : All expenses borne by a Third Party due to a
damage caused by a risk not excluded in the Policy.
Claim : A claim for indemnity for damages caused by a risk
or loss not excluded in the Policy.
Claimant : Any natural or juristic person or their legal
representatives who sustained a damage caused by
a risk or loss not excluded in the Policy.
Indemnity : What shall be offered by the Insurer to a Third Party
within the maximum limit of civil liability specified
herein.
Premium (Contribution) : The amount paid by the Insured to the Insurer in
exchange for the Insurer’s agreement to indemnify
third parties for damage/loss resulting directly from
a risk not excluded in the Policy.
Civil Liability : The liability of the Insured and/or the Driver towards
a Third Party for material/physical damages inflicted
or expenses arising from the Vehicle.
Material Fact : Any information requested by the Company from
the insurance applicant during the conclusion of the
Policy that may materially affect the Company’s
decision in accepting the insurance or rejecting it or
accepting the insurance with different conditions.
Right of Recovery : The Insurer’s right to recover an indemnity paid to a
Third Party from the Insured, Driver, or person who
caused the accident for damages excluded in the
Policy or cases where the Insurer has the right of
recovery.
Policy Schedule : The schedule annexed to the Policy containing
some information about the insured and the
Vehicle, which is considered an integral part of the
Policy.
Appendix : An agreement between an Insurer and the Insured,
subsequent to the issuance of the Policy, whereby
items of coverage are added to, amended or
removed from the basic coverage, and which
should be attached to the Policy and deemed an
integral part thereof.

Section (1) - Insurance coverage:

The insurer shall, in the event of an accident occurring within the borders of Saudi
Arabia and causing damages not excluded under the Policy and within the terms
and conditions set forth in the Policy, indemnify the Third Party for all the amounts
that the Insured, Driver or the person responsible for the accident is committed to
pay for:
a) Physical damages caused to a Third Party inside or outside the Vehicle.
b) Material damages inflicted on a Third Party.
c) Expenses.

Coverage Limits:

In the event of an accident occurring and resulting in indemnifying the Third Party in
accordance with the provisions of this Policy, the maximum limit of the Insurer's
liability for one event and during the lifetime of the Policy for physical damage,
expenses and material damages shall not exceed together a total sum of SAR
10,000,000 (ten million Saudi Riyals) as a maximum liability limit for coverage.
Based on the appendix (A) attached to the Policy.

Cases where the Insurer shall indemnify a Third Party while reserving the right of recovery
against the Insured, Driver or person responsible for the accident:

First: The Insurer shall have the right of recovery against the Insured or Driver to
recover the indemnity to a Third Party in any of the following cases:
1. Driven against the direction of traffic.
2. Running a red light.
3. Any liability or expenses arising from or incurred when the Insured Vehicle
is:
a. Used in contravention of the restrictions set forth in the Policy
schedule.
b. Carrying a number of passengers exceeding the seating capacity
allowed of the Vehicle, and it has been proved that the accident
occurred because of such violation.
c. Driven by a person who does not hold a proper class of license
corresponding to the type of the Vehicle driven, according to the
relevant laws and regulations, or in the event that an order is issued
by a competent entity for the forfeiture of the driver’s license, or the
license was expired at the time of the accident unless it was
renewed within (50) days from the date of the accident.

Second: In case the Vehicle was stolen or taken forcibly, the Insurer has the right
to recover from the person responsible for the accident, and the Insurer has the
right of recovery from the insured if he/she has not reported the theft to the
concerned entities without an acceptable excuse.

Third: The Insurer must notify the Insured or the Driver within 20 working days from
the date of the claim submission to where the above recovery cases may apply; the
company may exercise its right of recovery within a year from the date of the claim
settlement.

Forth: where any of the recovery cases applies, the juristic person shall not claim
the costs of treatment on physical damages from the Insurer.

Exceptions:

Insurers shall not be liable for paying any indemnities in any of the following cases:

1. Loss or damage to the insured Vehicle, properties inside or outside the


Vehicle which belong to either the Insured or the Driver, or goods
transported in the Vehicle or placed in the Insured’s or Driver’s custody,
control or care.
2. Death or physical injury to the Insured or the Driver
3. If the Vehicle is used in any type of racing or for testing its speed or power

4. If the Vehicle is driven in areas that are normally off-limits to the public, such
as airports or seaports, unless the Vehicle has permission to enter these
areas
5. Acknowledgement by the Insured or the Driver to bear the liability for the
accident undeservedly for the purpose of harming the Insurer
6. If the accident is deliberately caused by the insured and a Third Party, which
is proved in the accident report issued by the authorized entity to attend
accident scenes
7. Submitting inaccurate information in the insurance proposal form or
concealing material facts
8. If it is proved that the accident was deliberate.
9. Fines, financial penalties or bails, which may be imposed on the insured or
the Driver due to the accident.
10. The Driver escaped the scene of the accident with no acceptable reason
11. The Driver escaped the scene of the accident with no acceptable reason
12. Any liability or expenses arising, directly or indirectly, from the following
a. Driven under the influence of drugs, alcohol or medications that a
person is not allowed medically to drive after taking it.
b. War, invasion, acts of foreign enemy, hostilities, warlike acts
(whether war is declared or not), or civil war
c. Rebellion, military or popular uprising, insurgence, revolution,
usurping authority, martial laws, siege, or any events or reasons
leading to declaration or continuation of martial laws, siege, or acts
of vandalism and terrorism committed by person(s) working
individually, on behalf of, or in relation with any terrorist organization.
Terrorism means the use of violence for political, intellectual,
philosophical, racial, ethnic, social, or religious purposes. Such use
of violence includes putting the public and/or a segment thereof
under a state of terror, causing turmoil, affecting and/or intervening
in any of the government’s operations, activities and/or policies,
and/or causing any disturbance that negatively affects the national
economy or any related sectors
d. Strikes, riots, or civil or labor unrest
e. Damage directly or indirectly caused by nuclear weapons, ionizing
radiation, radioactive contamination resulting from any nuclear fuel
or waste, or contamination due to nuclear fuel combustion. For the
purposes of this exclusion, combustion shall include any nuclear
fission; and
f. Natural disasters such as hurricanes, earthquakes, floods, or
volcanoes

Claim Settlement Procedures:

1. Upon receiving a claim, the Insurer shall provide the claimant with an
acknowledgement of receipt and inform the claimant of any missing
documents within (3) working days for individuals and (9) working days for
the juristic person from receiving the claim.

2. Insurers shall settle claims with integrity and fairness without any
bargaining, within a maximum period of (15) working days for individuals
and (45) working days for the juristic person from the date the claim is
received, with all required documents.

3. The Insurer shall notify the claimant of its acceptance or denial of the claim
within five working days from the date of receiving the required claim
documents. In case of acceptance, whether fully or partially, the Insurer
must clarify the amount of indemnity and how it was reached in accordance
with section (2) of this Article.

4. With observance of the periods set forth in sections 1,2 and 3 of this Article,
the Insurer shall settle the claim by one of the following:

a. Propose to repair the Third Party’s vehicle, within a maximum period


of (15) working days for individuals and (45) working days for the
juristic person.
b. Transferring the indemnity amounts to the Third Party bank accounts
for any claim directly through their respective international bank
account numbers (IBAN)

5. With observance of the periods set forth in section 1,2 and 3 of this Article,
the Insurer shall settle the claim when submitted after repairs to the Vehicle
are made, provided that the claimant furnishes the Insurer with:

a. Actual bills of auto repairs and the accident scene is attended by the
authorized entity.
b. The Insurer shall also be provided with a vehicle damage
assessment report from an authorized entity, prepared after the
accident and before auto repairs take place.

6. If the Insurer fails to settle the claim within the prescribed period for no legal
reason, the claimant shall be entitled to submit a complaint at SAMACares
website (www.Samacares.sa) or file a petition of dispute at the Committees
for Resolution of Insurance Disputes and Violations to compel the Insurer to
settle the claim and indemnify the claimant for any expenses incurred as a
result of the loss of use of their vehicle due to the Insurer’s delay in settling
the claim.

7. In case of denial of the claim, whether fully or partially, the Insurer shall:

a. Provide the claimant with the reasons for full/partial denial.
b. Inform the claimant of their right to submit a complaint at SAMACares
website (www.Samacares.sa) or refer their case to the Committees for
Resolution of Insurance Disputes.
c. Provide the claimant, upon their request, with copies of documents in
support of the Insurer’s decision.

Cancellation:
Neither the Insurer nor the Insured has the right to cancel this Policy after its
issuance, except in the following situations:

1. The write-off of the Vehicle’s registration.


2. Transfer of ownership of the Vehicle to another owner.
3. The existence of an alternative policy that covers the remaining term of the
insurance policy to be cancelled.

The Insurer shall refund the Insured the due amount payable for the uncovered
period by depositing the remaining amount to their bank account via IBAN, within
three working days from the date on which the Insurer becomes aware of the
occurrence of any of the cases mentioned above. The due amount payable to the
Insured for the uncovered period is calculated by subtracting the elapsed days from
the total policy term (in days) and then dividing the result by the total policy term.
The result is then multiplied by the insurance premium less administrative fees and
commission (a maximum of SAR 30) to determine the return premium:

(365 − elapsed days) /365 × insurance premium less administrative fees and
commission (a maximum of SAR 30) = return premium.
The Insurer is exempted from its obligation to pay the due amount in the case that
there is a claim—related to the policy to be cancelled and the exact vehicle covered
by the policy— with a value exceeding the amount to be refunded as per the
calculation formula mentioned above.

Notwithstanding the foregoing, Insurer, Insured and Driver shall remain bound by
the provisions of this Policy with respect to the obligations arising prior to its
cancellation.

Section (2) – Extensions of Cover:

These extensions are applied to the motor vehicles for which the benefits and
extension of insurance cover are selected as indicated in the Schedule.
The Company may, on the basis of a written request by the Contributor (Insured),
at the commencement of insurance cover or during the validity of this insurance
and within the Terms and Conditions provided for in this Contract, extend the
insurance cover to include the indemnity against damages other than those
specifically stated in the Policy provided that the Contributor (Insured) has paid the
additional Contribution required, and particularly the following:

Extension for Fire:


It is agreed and understood that otherwise subject to the terms, exclusions,
provisions and conditions contained in the Policy or endorsed thereon, and subject
to the Insured having paid the agreed extra premium, this Insurance shall be
extended to cover loss or damage to the insured Motor Vehicle caused directly by
fire, spontaneous ignition, subject to a maximum of SR 20,000 any one event and
in the aggregate during the period of Insurance.

 Basis of Loss Settlement:


1. In the event of any loss or damage to the insured motor vehicle, the liability
of the Company shall not exceed the reasonable actual cost of repair
necessity required in respect of the damaged motor vehicle or the maximum
amount of SR 20,000 whichever is less.
2. Deductible: In case of loss or damage to the insured motor vehicle, the
Company will apply the amount of deductible stated in the Schedule to each
claim.
3. The Company reserves the right to consider a total loss if in its opinion it is
found that the motor vehicle cannot be economically repaired. In such case
the Company liability shall be limited to pay the difference between the
reasonable market value of the Motor vehicle at the time of the loss or
damage and the salvage value (as may be decided by Tawuniya), or the
maximum value of the Company's liability which shall not exceed in
aggregate SR 20,000 whichever is less. Furthermore, the salvage shall be
retained by the Insured as his own property, and the Company shall not be
obligated to buy-back such salvage.
4. Providing the company with the required reports, including a final report for the
civil defense / police
5. Excluding Vehicles accessories and personal belongings.

Extension for Theft:

It is agreed and understood that otherwise subject to the terms, exclusions,
provisions and conditions contained in the Policy or endorsed thereon, and subject
to the Insured having paid the agreed extra premium, this Insurance shall be
extended to cover loss or damage to the insured Motor Vehicle caused directly by
theft, subject to a maximum of SR 30,000 any one event and in the aggregate
during the period of Insurance.

Basis of Loss Settlement:


1. In the event of any loss or damage to the insured motor vehicle, the liability of
the Company shall not exceed the reasonable actual cost of repair necessity
required in respect of the damaged motor vehicle or the maximum amount of
SR 30,000 whichever is less.
2. Deductible: In case of loss or damage to the insured motor vehicle, the
Company will apply the amount of deductible stated in the Schedule to each
claim.
3. The Company reserves the right to consider a total loss if in its opinion it is
found that the motor vehicle cannot be economically repaired. In such case the
Company liability shall be limited to pay the difference between the reasonable
market value of the Motor vehicle at the time of the loss or damage and the
salvage value (as may be decided by Tawuniya), or the maximum value of the
Company's liability which shall not exceed in aggregate SR 30,000 whichever
is less. Furthermore, the salvage shall be retained by the Insured as his own
property, and the Company shall not be obligated to buy-back such salvage.
4. Exclude Loss or damage to the motor vehicle because of theft or any attempt
threat due to leaving the motor vehicle in operating mode, leaving the keys
therein or non-closing of the doors or screens.
5. Exclude Radios, stereo equipment, telephones or other accessories other than
those originally installed by the vehicle manufacturers and incorporated in the
original price of the motor vehicle
6. Exclude Loss or damage to properties pertaining to either the Insured or the
Driver inside or outside the vehicle; or that sustained by the goods transported
by the vehicle or those held in trust by or in the custody or control of the Insured
or the Driver.
7. Obtaining Police report.
8. Fill out the theft claim form

Extension for Hit & Run:

It is agreed and understood that otherwise subject to the terms, exclusions,
provisions and conditions contained in the Policy or endorsed thereon, and subject
to the Insured having paid the agreed extra premium, this Insurance shall be
extended to cover loss or damage to the insured Motor Vehicle caused directly by
hit & run, subject to a maximum of SR 20,000 any one event and in the aggregate
during the period of Insurance.

Basis of Loss Settlement:


1. In the event of any loss or damage to the insured motor vehicle, the liability of
the Company shall not exceed the reasonable actual cost of repair necessity
required in respect of the damaged motor vehicle or the maximum amount of
SR 20,000 whichever is less.
2. Deductible: In case of loss or damage to the insured motor vehicle, the
Company will apply the amount of deductible stated in the Schedule to each
claim.
3. The Company reserves the right to consider a total loss if in its opinion it is
found that the motor vehicle cannot be economically repaired. In such case the
Company liability shall be limited to pay the difference between the reasonable
market value of the Motor vehicle at the time of the loss or damage and the
salvage value (as may be decided by Tawuniya), or the maximum value of the
Company's liability which shall not exceed in aggregate SR 20,000 whichever
is less. Furthermore, the salvage shall be retained by the Insured as his own
property, and the Company shall not be obligated to buy-back such salvage.

4. Exclude Radios, stereo equipment, telephones or other accessories other than


those originally installed by the vehicle manufacturers and incorporated in the
original price of the motor vehicle
5. Provide the company with the accident report to the direct authority such as
the police / traffic or Najim Company.
Extension for Malicious Damage:
It is agreed and understood that otherwise subject to the terms, exclusions,
provisions and conditions contained in the Policy or endorsed thereon, and subject
to the Insured having paid the agreed extra premium, this Insurance shall be
extended to cover loss or damage to the insured Motor Vehicle caused directly by
Malicious Damage (vehicle gets damaged due to intentional or deliberate act),
subject to a maximum of SR 20,000 any one event and in the aggregate during the
period of Insurance.

required in respect of the damaged motor vehicle or the maximum amount of
SR 20,000 whichever is less.
2. Deductible: In case of loss or damage to the insured motor vehicle, the
Company will apply the amount of deductible stated in the Schedule to each
claim.
3. The Company reserves the right to consider a total loss if in its opinion it is
found that the motor vehicle cannot be economically repaired. In such case the
Company liability shall be limited to pay the difference between the reasonable
market value of the Motor vehicle at the time of the loss or damage and the
salvage value (as may be decided by Tawuniya), or the maximum value of the
Company's liability which shall not exceed in aggregate SR 20,000 whichever
is less. Furthermore, the salvage shall be retained by the Insured as his own
property, and the Company shall not be obligated to buy-back such salvage.
4. Exclude Radios, stereo equipment, telephones or other accessories other than
those originally installed by the vehicle manufacturers and incorporated in the
original price of the motor vehicle
5. Provide the company with the accident report to the direct authority such as the

Extension for Hail and floods:
It is agreed and understood that otherwise subject to the terms, exclusions,
provisions and conditions contained in the Policy or endorsed thereon, and subject
to the Insured having paid the agreed extra premium, this Insurance shall be
extended to cover loss or damage to the insured Motor Vehicle caused directly by
hail, flood due to rain and torrents resulting thereof, subject to a maximum of SR
30,000 any one event and in the aggregate during the period of Insurance.

Basis of Loss Settlement:


1. In the event of any loss or damage to the insured motor vehicle, the liability of
the Company shall not exceed the reasonable actual cost of repair necessity
required in respect of the damaged motor vehicle or the maximum amount of
SR 30,000 whichever is less.

2. Deductible: In case of loss or damage to the insured motor vehicle, the


Company will apply the amount of deductible stated in the Schedule to each
claim.

3. The Company reserves the right to consider a total loss if in its opinion it is
found that the motor vehicle cannot be economically repaired. In such case the
Company liability shall be limited to pay the difference between the reasonable
market value of the Motor vehicle at the time of the loss or damage and the
salvage value (as may be decided by Tawuniya), or the maximum value of the
Company's liability which shall not exceed in aggregate SR 20,000 whichever
is less. Furthermore, the salvage shall be retained by the Insured as his own
property, and the Company shall not be obligated to buy-back such salvage.
4. Exclude any loss or damage arising directly or indirectly from storms,
earthquake, typhoon, hurricane, tornado and cyclone.
5. Exclude Radios, stereo equipment, telephones or other accessories other than
those originally installed by the vehicle manufacturers and incorporated in the
original price of the motor vehicle
6. Providing the company with a civil defense, police / traffic or Najim Company
report.

Glass coverage:

In case of breaking the front or rear windshield, breaking the windows or breaking
the sunroof of the car, we will pay the cost of replacing the damaged glass provided
that the loss amount does not exceed 5000 riyals.

Roadside Assistance:

Roadside assistance services are provided to vehicles on all asphalted roads in the
Kingdom of Saudi Arabia, which include.

1. Vehicle Towing Service:


In the event of a sudden breakdown of the vehicle cannot be operated or drive, the
service provider shall be towing the vehicle to the destination, If:
Within the city: to the nearest service centre or any destination chosen by the
customer.
Outside of the city: to the nearest service centre in the nearest city from the place
of vehicle stops, up to a maximum of 150 km

2. Emergency fuel service:

In case of unavailability of fuel, the service provider shall provide fuel with sufficient
quantity to drive the vehicle to the nearest fuel station or towing the vehicle to the
nearest fuel station, the customer shall bear the value of the fuel supplied

3. Tire Replacement Service:


In case of tire failure, “provided that the tire isn't damaged as a result of a traffic
accident.” the service provider shall replace the unfit tire with a spare one that fits in
terms of size and qualifications. In case of impossibility to replace, the service
provider shall be installing a new tire for the customer provided that the customer
bears the value of the new tire or towing the vehicle to the nearest maintenance
center having the required service.

4. Battery Charge service:


In case of battery failure, the service provider shall charge the battery, if the battery
did not respond; the service provider shall be changing the battery, provided that
the customer pays the value of the new battery.

Towing:

If the insured vehicle is not working or needs mechanical repairs, the vehicle will be
towed to the nearest dealer workshop or workshop With maximum limit SR. 250

Personal Accident:
If the Contributor (Insured) adds this extension of cover, the Company undertakes to
pay compensation according to the scale and provisions stated hereunder for the
injury as hereinafter described, sustained by the Contributor(Insured) or Authorized
Driver and/or any of the passengers specifically stated in the Policy Schedule such
as 'Driver only' or 'Driver and Passengers', as a direct result of an accident to the
motor vehicle described in the Policy Schedule and caused by violent, accidental and
visible means which independently of any other cause shall within 52 consecutive
weeks of the occurrence of such injury result in:

The enforcement of the above Scale of Compensation shall be subject to the


following:

a) Compensation shall not be payable to any one person in respect of benefits


under (1) to (7):
b) Inclusive for more than SR 100,000 in aggregate in respect of any one
accident.
c) If the accident was a result, directly or indirectly, of criminal and / or offensive
acts by the Contributor (Insured) or Authorized driver.

d) The age of the person at the time of accident shall not be over 70 years.

e) A person under 16 year of age at the time of the accident shall receive only
50% of the Scale of Compensation with maximum aggregate of SR 50,000 in
respect of one accident.

f) Such compensation shall be payable only with the approval of the Contributor
(Insured) or the Contributor (Insured)’s legal representative and directly to the
injured person or his/her legal representative whose receipt shall be a full
discharge in respect of the injury to such person, or to the heirs in case of
death.

g) Compensation shall only be payable in respect of injury sustained by third


partys carried inside the cabin of the motor Vehicle at the time of the accident.

h) If the number of persons (including the driver) in the cabin of the motor vehicle
at the time of the accident exceeds the number stated as the seating capacity
in the Schedule, the compensation payable will be decreased proportionately,
but this compensation shall not be payable if carrying more passengers than
the registered seating capacity was a cause of the accident.

i) Compensation under benefit (7) shall be restricted to treatment obtained


within Saudi Arabia only. However, the Company will not compensate any
expenses incurred directly or indirectly for psychological or psychiatric
treatment.

j) Compensation under benefit (6) shall be payable only when the disablement
has lasted for 52 consecutive weeks and has been certified by a qualified
registered medical practitioner appointed by the Insurer.

Mechanical breakdown insurance provides insured with financial assistance in the


event of an unexpected mechanical breakdown or electrical failure for sedan

Benefits

The repair or replacement of components due to a mechanical breakdown or electrical


failure that occurs during the period of this policy.

Mechanical breakdown or electrical failure means the breaking or failure of any of the
components listed in the “Components Covered” section, that results from a mechanical
or electrical defect and that suddenly stops functioning, needing repair or replacement.

The policy covers Sedan vehicles, SUVs and 4x4s with a maximum gross vehicle mass
(GVM) of 3 500kg.

It does not cover taxis, hire vehicles, rebuilt vehicles, modified vehicles and vehicles that
are, or have been, used in any form of motoring competition.

Vehicles below 10 years from first registration and kilometers less than 200,000km
travelled, on the odometer.

Claim Limit

 The individual component claim limit that applies to this policy is stated in the
List of Benefits.
 Claims are limited to one claim per component type (eg. Fuel system, Engine,
Radiator…etc) per year, up to full benefit.
 Claims are limited to a maximum of SAR 20,000 per annual duration of a policy

Deductible

A deductible of SAR 1,000 will be applicable to all claims

Warranties:

* It is warranted that any person driving the insured motor vehicle holds a valid driving
license to drive such a motor vehicle as so required by the Saudi Authorities.

*You must take all steps possible to keep your vehicle in a proper and efficient state and
not misuse the vehicle.

* If any mechanical or electrical failure occurs you must protect your vehicle from further
loss or damage.

* You must report all claims to Tawuniya and take the vehicle to approved dealer or
Tawuniya appointed registered facility within 30 days of becoming aware of the
breakdown or failure otherwise the claim will not be accepted.

*Upon purchase of this policy you must adhere to the service requirements as stipulated
by the vehicle manufacturer. You may service your vehicle at any recognized service
center, however self-service will not be allowed.

* Insured must keep record of the service in the form of service stamp or invoices for
records as these will be requested at claims stage.

Exclusions

This insurance does not cover any claim with the following:

1. Pre-Existing damages, which are components that were broken or had failed
before the policy started.

2. Repairs that have not been authorized by Tawuniya claims.

3. Any repairs if the odometer is not working or has been changed in any way or
has been disconnected or replaced without our authority.

4. Damage resulting from oil leaks or for oil leaks themselves.

5. Damage caused by incorrect fuels or lubricants, unreasonable use, improper


servicing or malicious damage.

6. Damage caused by a road accident.

7. Damage to vehicles that have been altered in any way from the manufacturer’s
specifications.

8. Any components that are not listed under the Schedule of Benefits (Components
Covered).

9. Any components that are still covered by the manufacturer’s or supplier’s


warranty at the time of the failure.

10. Damage to all electrical wiring.

11. Service items or items that need to be changed at specific or regular intervals
such as filters, spark plugs and glow plugs, fan belts, ribbed drive belts, toothed
drive belts, auxiliary drive belts, screws, windscreen wiper blades, arms,
operating fluids – unless the replacement is necessary in conjunction with the
repairing of parts covered by this insurance cover.

12. Costs or expenses that insured can recover from comprehensive motor
insurance policy.

Section (3) – General Conditions

1. Changes in the marital fact:

The Insured shall notify the Insurer, within 20 working days, of any material changes.
The Insurer shall notify the Insured in case it intends to increase the premium rate,
or return part of the premium if the premium is reduced. If no notification is sent to
the Insured by the Insurer, then this shall indicate the Insurer’s approval to continue
providing the coverage at the premium rate agreed upon at the time of signing the
policy

2. Insurers’ right to conduct legal proceedings and settlement.

The Insurer shall have the right to:

a. Represent the Insured or Driver in any investigation or interrogation related to a


claim which is the subject of indemnity under this Policy.

b. Handle defense proceedings for the Insured or Driver before any judicial body
against any allegation or accusation related to an accident, which is the subject
of indemnity under this Policy.

c. The Insured shall notify the Insurer as soon as they become aware of any claim,
inquest or investigation relating to the said incident, unless the delay is justified
by an acceptable excuse.

3. The Insurer's right to include the Insured's name in the system of the
company authorized to collect consumer credit information:

The Insurer has the right to include the name of the Insured in the system of the
company authorized to collect consumer credit information if the Insured defaults on
payments due to the Insurer, whether insurance premiums or claims recoveries.

4. In the case of occurrence of a risk not excluded in the Policy, the Insured
or Driver shall:

a. Inform the concerned entities as soon as an accident occurs and not leave the
accident scene until procedures are completed, except in cases where it is
necessary to leave, e.g. in the case of physical injuries.

b. Not to claim responsibility with the intention of harming the Insurer, pay or
undertake to pay any amount to any party involved in the accident except after
obtaining a prior written approval from the Insurer.

c. Perform, at the Insurer's expense, all required actions to guarantee the Insurer's
right to recover, from any other party, any amounts due as a result of indemnity
paid by the Insurer under this Policy.

5. Fraud:

The rights arising from this Policy shall be forfeited if the claim involves fraud; if the
Insured, Driver, an agent thereof, or a Third Party uses fraudulent approaches or
methods to gain benefit from this Policy; or if liability or damage results from a
deliberate act by, or collusion with, the Insured, Driver, or others. The Insurer shall
have the right to recover against any party found to be responsible for such fraud,
whether as a conspirator or an accomplice, provided that the Insurer shall indemnify
the Third Party if it becomes clear that they acted in good faith

6. Policy issuance and renewal notification:

Insurers may not issue the Policy unless they are electronically connected to the
system of the company approved by SAMA to collect, maintain, and exchange
insurance information. The Insurer shall notify the Insured of the expiry date of the
policy (20) working days before it expires, so that the Insured can renew or replace
the Policy with another policy from another insurer.

7. Cases in which the company is not allowed to deny liabilities towards
third parties:

Subject to Articles 6 hereof, the Insurer may not deny liability for indemnity towards
a Third Party because the Insured, the Driver or the person responsible for the
accident has committed any violation, whether before or after the accident, or has
not complied with the provisions hereof, without prejudice to the insurer’s right of
recovery against the Insured, the Driver or the person responsible for the accident
after indemnifying the Third Party if the recovery is justified.

8. Judicial jurisdiction and governing law:

a. Any dispute that arises concerning this Policy shall be subject to laws and
regulations in force in the Kingdom of Saudi Arabia and shall be settled by the
Committees for Resolution of Insurance Disputes and Violations

b. Any dispute arising concerning this Policy shall not be looked into after the
lapse of five years from the occurrence of the incident forming the basis of the
claim, and of which the parties concerned are aware, unless the Committees for
Resolution of Insurance Disputes and Violations are satisfied with the reason for
considering the claim.

Surplus Distribution:
The surplus will be distributed to the Insureds in accordance with the provisions of
Article (70) of the Implementing Regulations of the Cooperative Insurance
Companies Supervision Law promulgated by Royal Decree No. M/32 dated
02/06/1424H.

Value Added Tax VAT:

The amounts stated in this policy and its endorsements have been charged VAT -
where applicable -according to the prevailing rate as per KSA VAT LAW
