The Proponent shall establish a nursery for the 43,868 seedling production, planting, maintenance and protection in support to the Green Philippines Master Plan which will be utilized for tree planting activities. The Proponent shall likewise submit an approved work and financial program (WFP) for the tree planting activities after one (1) month from the receipt of the ECC as well as an affidavit, of execution by the Proponent for the tree planting activities. The timeline shall also be indicated in the WFP. However, if tree planting activities will be conducted by a 3rd party organization, the Proponent shall submit copy of the MOA between the Proponent and the 3rd party organization. 11, The proponent shall establish an adequate rainwater harvesting/cistern storage tank upon project implementation as an additional measure in water resources management. Any complaint and issue arising from the ownership or right over the area/s covered shall be resolved by the Proponent with the appropriate concerned Government Agency/Entity (e.g. DENR 7 for Tenurial Instruments such as FLA, MLA, SLUP, SAPA, etc., affected LGUs, Registry of Deeds, Judicial Courts, etc.). No development shall be done without an approved tenurial instrument or any valid proof of authority over the area; The Proponent shall ensure that the nature of the project is compatible to the approved Comprehensive Land Use Plan (CLUP) of the LGU. RESTRICTIONS The Proponent shall cater to municipal wastes and accept only pre- treated infectious hospital and medical wastes to be disposed of ina separate in the sanitary landfill; ‘The proponent shall provide at least three (3) meters as easement from water bodies in urban areas, twenty (20) meters in agricultural areas, and forty (40) meters in forest areas in compliance to the Water Code of the Philippines; If the project is not implemented for five (5) years from the date of ECC issuance, the same is deemed expired unless the proponent has regularly submitted the Compliance Monitoring Reports (CMR) pursuant to Section 4.g, of EMB MC 2014-005. The reckoning date of project implementation is the date of groundbreaking, based on the Proponent's work plan as submitted to EMB. ‘The proponent shall coordinate with other concerned Government Agencies in the management of the project and shall implement only after securing all the necessary and relevant permits from other pertinent Government Agencies; Land clearing shall be limited to the project area. Any destruction of adjacent properties related to the Proponent’s construction and operation shall be rehabilitated and affected parties shall be duly compensated; No cutting down of trees during project implementation, however, when clearing an area is unavoidable, the proponent should comply with the pertinent provisions of Presidential Decree (PD) 705, Executive Order (EO) 23, and other existing forestry laws. Replacement of trees shall follow the following ratio: 50 trees for one (1) planted tree cut and 100 trees for one (1) naturally growing tree cut.
