was covered by ECC-RO7-1711-0010 issued by EMB R7 office on November 4, 2017
original ECC) and amended on June 3, 2020 (1* amendment)
After satisfying the requirements of the said application, this Bureau has decided to grant
an ECC amendment for the abovementioned project
Along with the issuance of this ECC, you are expected to implement the measures
presented in Environmental Impact - Environmental Performance Report and
Management Plan (EIS-EPRMP) document. This is intended to protect and mitigate the
project's adverse impacts on community health, welfare, and the environment.
Environmental considerations shall be incorporated in all phases and aspects of this
project.

The project has a total waste handling of 1,200 metric tons per day
(Category 4 Sanitary Landfill), an annual treatment/processing
capacity of 5 metric tons of medicaVhealth care wastes, and a total
volume capacity of 663 cubic meters for the sewerage treatment plant
as stated in the submitted EIS-EPRMP document.
This ECC is issued in compliance to the requirements of Presidential Decree No.
1586, in accordance to Department Administrative Order No. 2003-30. The Bureau,
however, is not precluded from reevaluating, adding, removing, and correcting any
deficiencies or errors that may be inconsistent with the Revised Procedural Manual of
DAO 2003-30 after issuance of this ECC.

This amended ECC shall supersede the old ECC conditions set forth in
ECC-RO7-1711-0010 issued on November 4, 2017 (original ECC) and
amended on June 3, 2020 (1st amendment);
2. The proponent shall strictly comply with the commitments, mitigating
neasures and moni requirements, especially those contained in the
Environmental Impact Statement - Environmental Performance Report and
Management Plan (EIS-EPRMP), particularly in the Environmental
Management and Monitoring Plan (EMMoP), to minimize any adverse impact
to the environment throughout the project implementation as indicated in
Annex A:
The proponent shall ensure that discharges/effluents comply with the
DENR standards and with all the provisions of RA 9275, the Philippine
Clean Water Act of 2004 and its Implementing Rules and Regulations at
all time:
There shall be no disposal of leachate and other untreated wastewater to
the nearest waterbody, and proponent must ensure that there will be no
leaking of leachate or wastewater that would lead to possible
contamination of the underground water table or aquifer. A regular
monitoring should be conducted;
5. The proponent shall install and maintain air pollution control devices to
minimize dust and gas emissions from different sources. Likewise, the
proponent shall ensure that emissions at all times comply with the DENR
standards and with all the provisions of RA 8749, the Philippine Clean
Air Act of 1999 and its Implementing Rules and Regulations;
©. The proponent shall install, operate, and maintain collection, handling,
treatment, storage and disposal facilities or any system serving different
sources of hazardous waste. The system shall be properly operated to
ensure compliance with all the provisions of RA 6969, the Toxic

its Implementing Rules and Regulations;

installation of Materials Recovery Facility (MRF), implementation of
recycling, composting, and segregation at source;
8. Conduct an effective Information, Education and Communication (IEC)
Program to inform and educate all stakeholders, especially its contractors,
workers, and local residents about the mitigating measures embodied in its
EIS-EPRMP, the conditions stipulated in this Certificate and the
environmental and human safety features of the project for greater awareness,
understanding and sustained acceptance of the project. The program shall be
submitted once to EMB Regional Office prior to project implementation;
9, Implement a Comprehensive Social Development Program (SDP) on an annual
basis and submit a separate report with the 2nd semester Compliance
Monitoring Report (CMR) to the concerned EMB Regional Office;
10, Establish a reforestation program in collaboration with the DENR-
PENRO/CENRO using endemic/indigenous species to mitigate greenhouse
gas (GHG) emissions of the project in line with the DENR's thrust for GHG
emissions reduction programs and National Greening Program. The Proponent
shall establish a nursery for the 43,868 seedling production, planting,
maintenance and protection in support to the Green Philippines Master Plan
which will be utilized for tree planting activities. The Proponent shall likewise
submit an approved work and financial program (WFP) for the tree planting
activities after one (1) month from the receipt of the ECC as well as an affidavit,
of execution by the Proponent for the tree planting activities. The timeline shall
also be indicated in the WFP. However, if tree planting activities will be
conducted by a 3rd party organization, the Proponent shall submit copy of the
MOA between the Proponent and the 3rd party organization.
11, The proponent shall establish an adequate rainwater harvesting/cistern
storage tank upon project implementation as an additional measure in water
resources management. The rainwater collected shall be utilized for flushing
toilets, landscaping, and other recycling initiatives to prevent storm run-off
water from directly overflowing to nearby areas or road networks;
12, The proponent shall designate a Pollution Control Officer (PCO) and secure
accreditation at the EMB Regional Office within six (6) months from the
issuance of this ECC who shall take charge on the environmental concerns of
the project:

‘The proponent shall ensure that the tenurial instrument and/or proof of
authority over the project area are valid prior project implementation.
Any complaint and issue arising from the ownership or right over the
area/s covered shall be resolved by the Proponent with the appropriate
concerned Government Agency/Entity (e.g. DENR 7 for Tenurial
Instruments such as FLA, MLA, SLUP, SAPA, etc., affected LGUs, Registry
of Deeds, Judicial Courts, etc.). No development shall be done without an
approved tenurial instrument or any valid proof of authority over the
area;
The Proponent shall ensure that the nature of the project is compatible
to the approved Comprehensive Land Use Plan (CLUP) of the LGU. Hence,
any inconsistency or issue in the said compatibility shall be resolved
prior project implementation by the Proponent with the concerned LGU;
Any inconsistency or misrepresentation of data, information, plans, proof
of authority, land use compatibility, or any supporting documents in the
submitted ECC application in comparison with the actual
implementation as determined by this Office shall be a ground for the
suspension of this ECC and/or other legal sanctions;
Creation of an Environmental Unit (EU) (e.g, ng Head, Pollution Control
Officer (PCO), Safety Officer, ete.) that competently handle the
environment-related aspects of the project shall be established before project
implementation, In addition to the monitoring requirements as specified in the
Environmental Management Plan/ Environmental Monitoring Plan, the EU
have the following responsibilities:

Site Development Plan (SDP) will be followed and implemented, especially

be covered at all times while plying on the road heading to the sanitary landIill

The same shall be planted with fragrant tree/shrub species to reduce the
impact of potential odor nuisance;

substances to reduce the impact of potential odor nuisance and proliferation
of flies and other insects;

allowing the disposal of solid, medical/healthcare, and temporary storage of
household hazardous wastes in the project site;

RESTRICTIONS
The Proponent shall cater to municipal wastes and accept only pre-
treated infectious hospital and medical wastes to be disposed of ina
separate in the sanitary landfill;
‘The proponent shall provide at least three (3) meters as easement from
water bodies in urban areas, twenty (20) meters in agricultural areas, and
forty (40) meters in forest areas in compliance to the Water Code of the
Philippines;
If the project is not implemented for five (5) years from the date of ECC
issuance, the same is deemed expired unless the proponent has regularly
submitted the Compliance Monitoring Reports (CMR) pursuant to Section 4.g,
of EMB MC 2014-005. The reckoning date of project implementation is the
date of groundbreaking, based on the Proponent's work plan as submitted to
EMB.
‘The proponent shall coordinate with other concerned Government
Agencies in the management of the project and shall implement only
after securing all the necessary and relevant permits from other pertinent
Government Agencies;
Land clearing shall be limited to the project area. Any destruction of
adjacent properties related to the Proponent’s construction and
operation shall be rehabilitated and affected parties shall be duly
compensated;
No cutting down of trees during project implementation, however, when
clearing an area is unavoidable, the proponent should comply with the
pertinent provisions of Presidential Decree (PD) 705, Executive Order
(EO) 23, and other existing forestry laws. Replacement of trees shall
follow the following ratio: 50 trees for one (1) planted tree cut and 100
trees for one (1) naturally growing tree cut. Proponent shall submit a Work
and Financial Program (WFP) within one (1) month from the
implementation of the project to the EMB Regional Office:

35, The allocated open space of the project area shall be solely for parking and
parks and shall be designated strictly as non-buildable zone,
