I. INTRODUCTION
A and B are a married couple. They went to Shimla for honeymoon. During the honeymoon, A
had clicked certain intimate pics of B while she was changing her dress. B had no idea that A
was doing this. A couple of days after returning from honeymoon While casually looking at A's
mobile phone, B found as many as 48 pictures and videos of B in various stages of nudity which
were clicked unawares. Ms. B was shocked and infuriated and at once demanded an explanation
from A. A’s claim was that in great appreciation of B's beauty, he had clicked her pictures. His
intentions were only to surprise her. However, B was not satisfied with this explanation at all,
she did not want to listen to anything and called him a dirty pervert and walked away.
II. PARTIES
A. Plaintiff B
B is the wife of A. They were married on 10th of November, 2022. She is a teacher of
Mathematics in a government school in Bangalore. She has been in the teaching profession for
over 7 years.
B. Defendant A
A is married to B since 10th November, 2022. He is a successful businessman with primary
business in Bangalore. He is well respected and admired by his colleagues.
III. FACTS
A. Background
A is a successful businessman in Bangalore, Karnataka, and B is a government school teacher in
the same city. They, after having dated for a couple of years, had gotten married according to the
Hindu personal laws on the 10th of November, 2022 at Udaipur, Rajasthan. To celebrate the
marriage, the couple had gone on a 7-day long honeymoon to Shimla.
B. The Incident
During the said honeymoon, A had clicked certain intimate pics of B while she was changing her
dress. B had no idea that A was doing this. A couple of days after returning from honeymoon
While casually looking at A's mobile phone, B found as many as 48 pictures and videos of B in
various stages of nudity which were clicked unawares. Ms. B was shocked and infuriated and at
once demanded an explanation from A. A’s claim was that in great appreciation of B's beauty he
had clicked her pictures. His intentions were only to surprise her. However, B was not satisfied
with this explanation at all, she did not want to listen to anything and called him a dirty pervert
and walked away.
IV. NEGOTIATION
A has only love and admiration towards his wife, B. He had no ill intentions behind clicking
intimate pictures and videos of his wife. However, now that B has taken up the issue, A realizes
his mistake in compromising the privacy and safety of his wife. He feels disheartened to have
caused hurt to his wife.
He cannot bear divorcing his beloved wife. He agrees to delete all copies of the pictures and
videos taken by him; however, he does not agree to divorce.
He instead seeks a period of six months with his wife to give him an opportunity to prove his
love and loyalty towards his wife reconcile with her.
VIII. CONCLUSION
A intended no harm in clicking the pictures and videos of his wife. He did it in genuine awe of
her. He took the liberty to take the photos out of extreme fondness towards his wife. However,
realizing that there indeed is scope for B to misunderstand his intentions and understanding that
she got hurt by his actions, he now wants an opportunity to prove his love and loyalty towards
his wife.
