CONSENT FORM

I represent and warrant that I am the actual owner of the subject Rotax aircraft engine (the Engine”)
and that I understand, acknowledge and agree to the following:

(1) I confirm that I have received the Engine together with the respective documentation (Logbook,
Operators Manual, Safety Information Card, Warranty Conditions) as ordered from the seller of my
choice based on a separate purchase contract with the seller;
(2) I confirm that the seller has instructed me on the operation, maintenance, safety features and
limited warranty for Rotax aircraft engines, related parts and accessories and that I have understood
the entire instructions;
(3) I confirm that I have read the Installation Manual, Operators Manual and all warnings provided for
the Engine (“Documentation”) prior to the operation of the airplane.
(4) I confirm that I have fully complied with the Documentation and that I expressly assume all risks
of the use of the Engine in any aircraft. I am informed about the availability of all Engine relevant
technical documentation under the link http://www.flyrotax.com/
(5) Considering the compliance and certification status of my aircraft engine, I am fully aware of and
will respect the limitations, regulations and standards approved by the competent authorities.
Depending on the Engine type, all airworthiness requirements and standards like ASTM F2339 or
FAR-33, JAR-E, CS-E in their applicable version have to be considered. Any engine modification
made by the aircraft manufacturer has to comply with all applicable regulations and standards and
the aircraft manufacturer has to produce all relevant documents required to evidence compliance of
such engine installation in the aircraft with applicable regulations and standards.

I agree to follow the Rotax instructions of continued airworthiness available under the link
http://www.flyrotax.com/ and also to observe the aircraft related and relevant design regulations and
standards.

I am aware that maintenance and repair work on an ASTM compliant or type certified ROTAX®
aircraft engine is only allowed to be carried out by persons and companies approved by the relevant
authorities, regulatory bodies and according to the iRMT standard.

I understand that all engines, by their nature, are subject to sudden stoppage. Engine stoppage
can result in crash landings, forced landings or no power landings. Such crash landings can lead to
serious bodily injury or death.

I assume all risk of use, and I acknowledge by using this product that I know that this engine, like
all engines, is subject to sudden stoppage.

I will never fly the aircraft equipped with this engine at locations, airspeeds, altitudes or in other
situations where a safe and successful no-power landing cannot be made after sudden engine
stoppage.

(6) I agree to the exclusive jurisdiction and venue for all legal disputes between myself and the seller
relating to the Engine and warranty as set forth in the terms of the purchase contract with the seller
and that any legal dispute between me and the Seller will be brought solely in the jurisdiction as
agreed under the purchase contract with the seller;

(7) I acknowledge that BRP-Rotax GmbH & Co KG is an Austrian company and I agree that any legal
dispute or claim between me and BRP-Rotax GmbH & Co KG relating to the Engine will be brought
exclusively in the courts of Austria and solely pursuant to Austrian law without regard to any choice of
law or borrowing statute;
