Minutes of 230th meeting of SEAC-1 (Day-2)

Date: 27th to 28th October, 2022


Venue: Through Video Conferencing

In view of pandemic situation of COVID-19 , Maharashtra SEIAA directed SEAC-1 to


appraise the proposals by using information technology facilities. Hence, SEAC-1
initiated to appraise the proposals received by the SEIAA through Video-conferencing
technology on Cisco Webex platform.

Following members of SEAC-I were present for videoconference meeting.

INTRODUCTION:
This has reference to your online application vide proposal No. 81886 for prior
Environmental Clearance for manufacturing of aroma chemicals under category 5(f)
Synthesis of Organic Chemicals as per provisions of the EIA Notification, 2006 amended
from time to time and appraised in the SEAC-1 committee.
PROJECT DETAILS:
Environmental Clearance for Proposed Establishment of Synthetic organic
Chemicals (Aroma chemicals) manufacturing facility at Plot No- B-7/2,
MIDC Mahad Tal. Mahad, Dist. Raigad, Maharashtra by Prigiv Specialties
Private Limited

DELIBERATIONS IN SEAC:
After deliberations SEAC observed:-
The project proponent along with their accredited consultant M/s Aditya Environmental
Services Pvt. Ltd were present for the meeting.

The proposal was considered under category 5(f) B1 as per Notification EIA Notification,
2006 as amended form time to time.
The proposal was appraised based on the documents submitted and presented by the PP and their
accredited Environmental Consultant.
PP was granted online ToR vide No. SIA/MH/IND3/81886/2022 dated 06.08.2022 for
the preparation of EIA/EMP report.
Now, PP submitted EIA/EMP report for appraisal.
During deliberations following deficiencies were observed,

1. PP is having adequate space to provide mandatory 33% green belt within the plot
area, but PP proposes to provide only 24% within the plot and deficit out side the
plot area. PP asked to rearrange the layout and submit revised layout providing
green belt within the plot area preferably on the periphery.
2. PP to carryout soil sampling analysis based on the identification of control site
outside the premises and collect soil samples in and around the proposed site. PP
to choose parameters to be analysed based on the use of raw materials and finished
products by the earlier owner of the site and all other chemical parameters
including heavy metals. PP to compare these results with the control site result

and prepare and implement appropriate mitigation plan to address soil
contamination issue.
3. PP to prepare wild life conservation plan and get it approved from the Competent
Authority of the Forest Department as there are two scheduled species were
observed during EIA study.
4. PP to carry out risk assessment study of steam line proposed to be taken from the
adjacent sister unit of the PP; PP to include safety risks as well as operational ,
legal liability and other related risk in the assessment study.
5. PP to submit structural stability certificate of buildings exists on site w.r.t its load
bearing capacity of additional equipment, manpower etc. and it can safely
accommodate proposed manufacturing activity in in the existing building.
6. PP to submit copy of MoU executed with the sister unit of PP to obtain steam from
them. PP to submit copies of NOC/permissions obtained for the same from
Competent Authority.
7. PP to submit details of gas leak detection system proposed in the storage and
operation areas so as to avoid any unforeseen incident as most of the impact of
incident seen affecting the areas outside the factory limit.
8. PP to submit plan for VOCs control and monitoring on site w.r.t emissions during
loading/unloading, process activities etc.

RECOMMENDATIONS OF SEAC:
After detailed deliberations with the PP and their accredited consultant, SEAC-1 decided to defer
the proposal till submission of compliance of above points.

INTRODUCTION:
This has reference to your online application vide proposal No. 77209 for prior Environmental
Clearance for expansion project for Sugar (4000 TCD to 7500 TCD of sugar), Proposed Distillery
(45 KLPD) and Expansion of Cogen plant (15 MW to 28 MW) under category 1(d) Thermal
Power Plant, 5(j) Sugar Industry and 5 (g) Distillery B1 as per provisions of the EIA Notification,
2006 amended from time to time and appraised in the SEAC-1 committee.

PROJECT DETAILS:

DELIBERATIONS IN SEAC:
After deliberations SEAC observed:-
Representative of PP was present during the meeting along with Accredited Environmental
consultant M/s. Sneha Hi- Tech Products Ltd.
The proposal was appraised based on the documents submitted and presented by the PP and their
accredited Environmental Consultant.

The proposal is for Environmental Clearance For Proposed Modernization cum expansion
project for Sugar (4000 TCD to 7500 TCD of sugar), Proposed Distillery (45 KLPD) and
Expansion of Cogen plant (15 MW to 28 MW) At Mohannagar, At/ Post- Arag, Tal- Miraj, Dist-
Sangli, Maharashtra by M/S. Mohanrao Shinde Sahakari Sakhar Karkhana Ltd.

During deliberations , PP submitted that, they applied for the grant of Term of References (ToR)
to MoEF&CC on 19.10.2018 as per requirement of EIA Notification, 2006 dated 14.09.2006,
wherein it was mentioned that, all distillery projects having capacity more than 30 KLPD shall
be considered as Category “A” and be dealt at MoEF&&CC level. Accordingly, PP obtained ToR
vide letter No. IA-J-11011/341/2018-IA-II(I) dated 29.11.2018.

In the mean time, MoEF&CC issued amended Notifiation dated 13.06.2019 mentioning the
molasses based distillery having capacity less than 100 KLPD shallbe dealt by respective State
SEIAA.

MoEF&CC issued an O.M. dated 18.01.2022 which reads as below,
“..Notwithstanding anything contained above, the period from 1st April, 2020 to the 31st March
2021 shall not be considered for the purpose of calculation of the period of the validity of Term
of Reference granted under te provisions of this Notification in view of outbreak of Coron Virus
(COVID 19) and subsequent lockdowns (total or partial) declared for its control, however, all
activities undertaken during this period in respect of the said ToR shall be treated as valid.”

Hence, the validity of ToR issued to the PP was up to 28.11.2022. Accordingly, as per ToR
obtained, PP prepared draft EIA/EMP report and Maharashtra Pollution Control Board conducted
the Public Hearing on 31.12.2021.

After completion of Public Hearing, while uploading final EIA/EMP report on State portal of
PARIVESH, PP observed that, there is no provision to upload EIA/EMP report on the State Portal
for which ToR was granted by the MoEF&CC. Hence, PP applied on State SEIAA Portal for
ToR and obtained online standard ToR on 25.05.2022 and uploaded final EIA/EMP report for
the grant of prior Environmental Clearance.

With above facts and records, PP requested SEAC-1 to consider the proposal as per ToR obtained
on 29.11.2018 and subsequent submission of EIA/EMP report.

After deliberations with the PP and their accredited consultant and looking at the facts submitted
by the PP, SEAC-1 noted that, PP was not able to upload final EIA/EMP report on PARIVESH
portal of the SEIAA directly as per ToR issued on 29.11.2018, hence, PP applied for fresh ToR
and uploaded the EIA/EMP report.

In view of above facts, SEAC-1 was of the considerate view to apprise the proposal as requested
by the PP.

34 Brief Note on Air Pollution Control equipment’s :

The air pollution caused by this industry is mainly from dust as SPM from fuel. The dust is
not predominantly due to the composition and handling of raw materials because those are
largely controlled. The efforts taken by the Industry in this respect, are also indicated. Stack
with 65-meter height provided as per guideline with Dust catcher ESP. The CO2 from
fermentation will be converted to liquid CO2. The effluent treatment will be fully aerobic.

RECOMMENDATIONS OF SEAC:

After detailed deliberations with the PP and their accredited consultant, SEAC-1 decided to
recommend the proposal to the SEIAA for the grant of prior Environmental Clearance subject to
following specific conditions,

of drip irrigation and submit photographs. PP to plant tree sampling of 5-6 feet height.
4. PP to prepare plan for conservation of all natural water streams exists on site; PP shall
not diver any natural water stream without permission of competent authority.
5. PP to provide Zero Liquid Discharge Effluent Treatment for distillery unit. PP to
explore possibility to assess techno-economic feasibility of using technology for MEE
such as low temperature/mechanical vapour compressor etc. so as to reduce operation
cost and use of natural resources.
PP to get ZLD design vetted by the reputed Govt. Institution like IIT/NIT.
6. PP to ensure enclosed storage with impervious flooring of all raw materials and
chemicals, no open storage be practiced so as to avoid odour nuisance and its impact
on the soil in case of spillage.
7. PP to provide RCC platform for composting area with proper leak proof lining of 250
micron HDPE sheet followed by local soil & finally brick-on-edge with filled cement
solution in between bricks to stop percolation from yard.
8. PP to provide dig trench (cut off trench) with black cotton soil & plastic sheet around
the boundary of composting site to avoid the percolation/lateral capillary movement of
liquid
9. PP to provide display board at piezometric hole and monitor ground water
10. PP to provide appropriate measure to remove the issue related with odour I flies within
and surrounding of the compost plant by spraying (Glue Trap, Bromodialon 0.005%
cake, Bromodialon 0.005% powder, Fifronil 0.03%) at different points of Bio-
Compositing site and provide Sugar beds for flies at Biocomposting site to reduce fly
nuisance.
11. PP should regularly monitor the poly sheds, brick-on edge area and HDPE lining area
and immediately replace if found damaged
12. PP should maintain record regarding daily receipt of spent wash, compost dispose each
day.
13. PP to submit copies of MoU executed with the brick manufacturer for disposal of boiler
ash along with their quantities.
14. PP to provide asphalting on all internal roads so as to reduce particulate matter
pollution during plying of vehicles within the premises.
15. PP to provide nature based treatment for Sewage Treatment for treatment of domestic
sewage ( in place of septic Tank) and ensure all standard parameters are met as per
requirements of CPCB/MPCB.

This has reference to your online application vide proposal No. 62118 submitted along with copies

Notification 2006 amended from time to time and the proposal is appraised in the SEAC-1
committee.

DELIBERATIONS IN SEAC:
Representative of PP was present during the meeting along with Accredited Environmental consultant
M/s. Ultra Tech Environmental Consultancy and Laboratory.
The proposal was appraised based on the documents submitted and presented by the PP and their
accredited Environmental Consultant.
The ToR was granted to the PP vide letter dated 06.05.2021. The Public Hearing was carried out on
18.11.2021; the public hearing report submitted along with EIA/EMP report.
PP submitted EIA report on 01.12.2022.
The proposal was earlier considered in the 224th meeting of SEAC-1 wherein the proposal was deferred
for following reasons,
I. PP proposes composting of spent wash the Regional Officer, MPCB noted in the Public Hearing
that, the process generates the odour nuisance in the surrounding of the industry area. PP to submit
their management plan indicating use of new and recent technologies for the complete treatment
of spent wash without creating any nuisance in the surrounding.
II. PP to submit point wise compliance of all issues raised during public hearing along with specific
time lines for completion, responsibility for compliance and adequate budgetary provisions.
III. It was noticed from the proceedings of the Public Hearing and information shared by the PP and
their consultant that, the NOC given by the Grampanchayt vide letter dated 16.02.2021 was
revoked in the monthly meeting of Grampanchayat held on 16.11.2021. PP replied that the same
has been later on cancelled. PP asked to submit revised proceeding soft e Grampanchayat meeting
indicating they do not have any objection for the establishment of proposed distillery in the area.

IV. PP to submit copy of certified compliance to be obtained from MPCB for existing Consent to
operate.
V. PP to submit copy of permission/ agreement executed with the Water Resource Department for
supply of water for the proposed Distillery unit as per prevailing rules of Water Resource
Department.
VI. PP informed that, they have submitted application for withdrawal of ground water but yet not
obtained the same. PP to submit copy of permission obtained from the Competent Authority.
VII. PP to carry out HAZOP of the distillation process and submit an undertaking indicating all
recommendation will be implemented on site.

Now, PP submitted additional information.


During deliberations it was noted that, PP has not complied with the observations of last meeting.
Following deficiencies were observed,
1. PP proposes composting of spent wash the Regional Officer, MPCB noted in the Public Hearing
that, the process generates the odour nuisance in the surrounding of the industry area. PP to submit
a comprehensive and technically sound odour management plan indicating use of new and recent
technologies for the complete treatment of spent wash without creating any nuisance in the

2. PP has not obtained water lifting permission from the Competent Authority of water resource
department. PP proposes to use ETP recycled water, water stored from rains and ground water for
which NOC has been obtained. PP to submit detailed water requirement calculations to establish
sustainability of project in absence water supply from other sources.
3. PP to submit design details of ETP and STP.

RECOMMENDATIONS OF SEAC:
After detailed deliberations with the PP and their accredited consultant, SEAC-1 decided to
recommend the proposal for prior Environmental Clearance to the SEIAA subject to following
conditions,

and storages of hazardous chemicals instead of contract workers. Regular safety training to
be provided to all such employees.

stored on site and ensure its storage/handling as per compatibility.
5. PP to provide Continuous Online Monitoring System connected to the servers of CPCB and
MPCB. PP to include VOCs monitoring in the scheduled ambient air monitoring plan.

7. PP ensure to provide adequate space for parking of all types of vehicles including external

INTRODUCTION:
This has reference to your online application vide proposal No. 76489 submitted along with copies
of documents seeking prior Environmental Clearance under the provisions of the EIA Notification,
2006. The proposed project activity is listed at Sr. No. 1(a), Mining of Minerals category B of the
EIA Notification, 2006 and the proposal is appraised in the SEAC-1 committee.
PROJECT DETAILS:

DELIBERATIONS IN SEAC:
PP along with their accredited consultant M/s Manusrushti were present for the meeting.

The proposal was earlier considered in the 206th meeting of SEAC-1 wherein the proposal was
deferred for following reasons,

“During deliberation an excavation/quarrying was observed on the site from the KML files and
Google map.
In view of above observation, SEAC directed to carry out a joint inspection by the District Mining
Officer, Environmental Consultant and Project Proponent to ascertain the extent of
excavation/quarrying exists on site and permission / approvals obtained from the Competent
Authority for such excavation
The District Mining Officer shall submit an inspection report through Collector/Addl. Collector
mentioning that, no excavation/ quarrying is carried out on site in violation of EIA Notification 2006
amended from time to time.
In case any illegal excavation observed the District Mining Officer shall initiate appropriate legal
action against the defaulter.”
There after the proposal was again considered in the 215th meeting of SEAC-1 wherein the proposal
was referred to the SEIAA for guidance on violation. The details are as below,
“The proposal was appraised based on the information presented by the PP and DMO, Nashik.
During deliberation, it was observed that, quarrying was carried out on site and Environmental
Clearance was not taken by the PP.
A joint inspection report submitted by the Additional Collector, Nashik vide letter dated
13.08.2021indicating there is no excavation/quarrying carried out in violation of EIA Notification,

with their letter.
The committee also observed that, PP was continuing the excavation under Temporary Permit even

In view of above facts and figures, SEAC-1 is of the opinion that, it is the case of violation but the
Additional Collector in his report mentioned that, there is not violation of EIA Notification, 2006.

Hence SEAC-1 decided to refer the proposal to SEIAA for further guidance and decision in the
matter.”
The SEIAA considered the proposal in their 238th meeting and directed PP to apply a fresh under
violation SOP.
Now, PP submitted their application for ToR under violation category as per SOP issued by the
MoEF&CC vide Office Memorandum No. 22-21/2020-IA-III dated 07.07.2021.
As per para B (vii) which reads as below,

“…..may insist upon the Public Hearing to be conducted for such categories of projects for which
the EIA Notification 2006, as amended from time to time, requires the Public Hearing to be
conducted. “

As the proposed project is falls under category 1(a) B2 which does not attract Public Hearing as per
the EIA Notification, 2006, as amended from time to time. Hence the Public Hearing is exempted.

In the meanwhile the SEIAA, Maharashtra issued guidelines on the Terms of Reference for EIA and
preparation of Environment Management Plan (EMP) for Violation Cases in August 2022 which is
to be followed by the PP for the preparation EIA report and EMP.(Atatched as Annexure –I).
The brief details of the project are as below,

RECOMMENDATIONS OF SEAC:
The SEIAA shall initiate action against the PP under section 15 read with section 19 as per para 10(i)
of the SOP issued by MoEF&CC on 07.07.2021.
After detailed deliberations with the PP and their accredited consultant, SEAC- decided to grant
violation ToR subject to the following conditions and as per SOP issued by the MoEF&CC dated
07.07.2021 and Annexure – I attached here with for the preparation of EIA/EMP report.
CONCLUSION:
ToR Granted with following terms

1. PP to submit detail of ownership of the area in the EIA report.


2. PP to submit their plan to utilize CER (Corporate Environment Responsibility) along
with timelines as per OM issued by MoEF&CC dated 01.05.2018.
3. PP to submit approved District Survey Report, Mining Plan, Mine Closure Plan obtained
from the Competent Authority.
4. All documents including Form I/II, approved mine plan, District Survey Report, EIA /
EMP should be compatible with each other in terms of the mine lease area, production
levels, waste generation and its management, mining technology etc. and should be in
the name of the lessee.
5. All corner coordinates of the mine lease area, superimposed on a High Resolution
Imagery/ topo sheet, topographic sheet, geomorphology and geology of the area should
be provided. Such an Imagery of the proposed area should clearly show the land use and
other ecological features of the study area (core and buffer zone).
6. Details about the land proposed for mining activities should be given with information
as to whether mining conforms to the land use policy of the State; land diversion for
mining should have approval from State land use board or the concerned authority.
7. It should be clearly stated whether the proponents/ Company has a well laid down
Environment Policy approved by its Board of Directors? If so, it may be spelt out in the
EIA Report with description of the prescribed operating process/procedures to bring into
focus any infringement/deviation/ violation of the environmental or forest norms/
conditions? The hierarchical system or administrative order of the Company to deal with
the environmental issues and for ensuring compliance with the EC conditions may also
be given. The system of reporting of non-compliances / violations of environmental
norms to the Board of Directors of the Company and/or shareholders or stakeholders at
large, may also be detailed in the EIA Report.
8. Issues relating to Mine Safety, including subsidence study in case of underground
mining and slope study in case of open cast mining, blasting study etc. should be
detailed. The proposed safeguard measures in each case should also be provided.
9. The study area will comprise of 10 km zone around the mine lease from lease periphery
and the data contained in the EIA such as waste generation etc. should be for the life of
the mine / lease period.
10. Land use of the study rea delineating forest area, agricultural land, grazing land, wildlife
sanctuary, national park, migratory routes of fauna, water bodies, human settlements

and other ecological features should be indicated. Land use plan of the mine lease area
should be prepared to encompass preoperational, operational and post operational
phases and submitted. Impact, if any, of change of land use should be given.
11. Details of the land for any Over Burden Dumps outside the mine lease, such as extent
of land area, distance from mine lease, its land use, R&R issues, if any, should be given
12. A study shall be got done to ascertain the impact of the Mining Project on wildlife of
the study area and details furnished. Impact of the project on the wildlife in the
surrounding and any other protected area and accordingly, detailed mitigation measures
required, should be worked out with cost implications and submitted.
13. Location of National Parks, Sanctuaries, Biosphere Reserves, Wildlife Corridors,
Ramsar site Tiger/Elephant Reserves/(existing as well as proposed), if any, within 10
km of the mine lease should be clearly indicated, supported by a location map duly
authenticated by Chief Wildlife Warden. Necessary clearance, as may be applicable to
such projects due to proximity of the ecologically sensitive areas as mentioned above,
should be obtained from the Standing Committee of National Board of Wildlife and
copy furnished.
14. One season (non-monsoon) [i.e. March-May (Summer Season); October-December
(post monsoon season) ; December-February (winter season)]primary baseline data on
ambient air quality as per CPCB guidelines, water quality, noise level, soil and flora and
fauna shall be collected and the AAQ and other data so compiled presented date-wise in
the EIA and EMP Report. Site specific meteorological data should also be collected.
The location of the monitoring stations should be such as to represent whole of the study
area and justified keeping in view the pre-dominant down wind direction and location
of sensitive receptors. There should be at least one monitoring station within500 m of
the mine lease in the pre-dominant downwind direction. The mineralogical composition
of PM10, particularly for free silica, should be given.
15. Air quality modeling should be carried out for prediction of impact of the project on the
air quality of the area. It should also take into account the impact of movement of
vehicles for transportation of mineral. The details of the model used and input
parameters used for modeling should be provided. The air quality contours may be
shown on a location map clearly indicating the location of the site, location of sensitive
receptors, if any, and the habitation. The wind roses showing predominant wind
direction may also be indicated on the map.
16. The water requirement for the Project, its availability and source should be furnished. A
detailed water balance should also be provided. Fresh water requirement for the Project
should be indicated.
17. Necessary clearance from the Competent Authority for drawl of requisite quantity of
water for the Project should be provided.
18. Description of water conservation measures proposed to be adopted in the Project should
be given. Details of rainwater harvesting proposed in the Project, should be provided.
19. Impact of the Project on the water quality, both surface and groundwater, should be
assessed and necessary safeguard measures, if any required, should be provided.
20. Based on actual monitored data, it may clearly be shown whether working will intersect
groundwater. Necessary data and documentation in this regard may be provided. In case
the working will intersect groundwater table, a detailed Hydro Geological Study should
be undertaken and Report furnished. The Report inter-alia, shall include details of the
aquifers present and impact of mining activities on these aquifers. Necessary permission

from Central Ground Water Authority for working below ground water and for pumping
of ground water should also be obtained and copy furnished.
21. Details of any stream, seasonal or otherwise, passing through the lease area and
modification /diversion proposed, if any, and the impact of the same on the hydrology
should be brought out.
22. Information on site elevation, working depth, groundwater table etc. Should be provided
both in AMSL and bgl. A schematic diagram may also be provided for the same.
23. A time bound Progressive Greenbelt Development Plan shall be prepared in a tabular
form (indicating the linear and quantitative coverage, plant species and time frame) and
submitted, keeping in mind, the same will have to be executed up front on
commencement of the Project. Phase-wise plan of plantation and compensatory
afforestation should be charted clearly indicating the area to be covered under plantation
and the species to be planted. The details of plantation already done should be given.
The plant species selected for green belt should have greater ecological value and should
be of good utility value to the local population with emphasis on local and native species
and the species which are tolerant to pollution.
24. Impact on local transport infrastructure due to the Project should be indicated. Projected
increase in truck traffic as a result of the Project in the present road network (including
those outside the Project area) should be worked out, indicating whether it is capable of
handling the incremental load. Arrangement for improving the infrastructure, if
contemplated (including action to be taken by other agencies such as State Government)
should be covered. Project Proponent shall conduct Impact of Transportation study as
per Indian Road Congress Guidelines.
25. Details of the onsite shelter and facilities to be provided to the mine workers should be
included in the EIA Report.
26. Conceptual post mining land use and Reclamation and Restoration of mined out areas
(with plans and with adequate number of sections) should be given in the EIA report.
27. Occupational Health impacts of the Project should be anticipated and the proposed
preventive measures spelt out in detail. Details of pre-placement medical examination
and periodical medical examination schedules should be incorporated in the EMP. The
project specific occupational health mitigation measures with required facilities
proposed in the mining area may be detailed.
28. Measures of socio economic significance and influence to the local community
proposed to be provided by the Project Proponent should be indicated. As far as possible,
quantitative dimensions may be given with time frames for implementation.
29. Detailed environmental management plan (EMP) to mitigate the environmental impacts
which, should inter-alia include the impacts of change of land use, loss of agricultural
and grazing land, if any, occupational health impacts besides other impacts specific to
the proposed Project.
30. Public Hearing points raised and commitment of the Project Proponent on the same
along with time bound Action Plan with budgetary provisions to implement the same
should be provided and also incorporated in the final EIA/EMP Report of the Project.
31. Details of litigation pending against the project, if any, with direction /order passed by
any Court of Law against the Project should be given.
32. A Disaster management Plan shall be prepared and included in the EIA/EMP Report.

Executive Summary of the EIA/EMP Report.


All documents to be properly referenced with index and continuous page numbering.
Where data are presented in the Report especially in Tables, the period in which the
data were collected and the sources should be indicated.

Project Proponent shall enclose all the analysis/testing reports of water, air, soil, noise
etc. using the MoEF & CC/NABL accredited laboratories. All the original
analysis/testing reports should be available during appraisal of the Project.

Where the documents provided are in a language other than English, an English
translation should be provided.

While preparing the EIA report, the instructions for the Proponents and instructions
for the Consultants issued by MoEF & CC which are available on the website of this
Ministry, should be followed.

The EIA report should also include (i) surface plan of the area indicating contours of
main topographic features, drainage and mining area, (ii) geological maps and
sections and (iii) sections of the mine pit and external dumps, if any, clearly showing
the land features of the adjoining area.

Annexure -I
Terms of Reference for EIA and preparation of Environment Management Plan (EMP) for
Violation Cases
August 2022

The following Terms of Reference (TOR) for violation cases shall be read along with Ministry of
Environment Forest and Climate Change orders no F.No.22-21/2020-IA.III Dated 7th July 2021 and
F No. 22-21/2020-IA.III (E 138949) dated 28th January 2022 and Approach for Assessment for
Environment Damage and Estimation of Remediation Costs for Building Construction Projects
Initiated Without Mandatory Environment Clearance” 2018
The following TOR are drafted with reference to Ministry of Environment Forest and Climate
Change impact assessment division TORs for Violation Case a) For Construction Sector vide
Notification S.O.804 (E) dated 14th March 2017 in the matter of IA/HR/NCP/63612/2017 and b) For
Mining Sector dated 12th November 2018 in the proposal No IA/MH/MIN/68113/2017.

A) Project Description
1. Project description, its importance and benefits.
2. Project site details (location, topo-sheet of the study area of 10 Km, Coordinates, google map, layout
map, land use, geological features and geo-hydrological status of the study area, drainage). hydro geological
survey report with graphs & data.
3. Land use as per the approved Master Plan of the area, Permission/approvals required from the land
owning agencies, Planning / Development Authorities, Local Body, Water supply & Sewerage Board, etc.
4. Land acquisition status, R & R details.
5. Forest and Wildlife and eco-sensitive zones, if any in the study area of 10 km. Any sensitive areas in
impact zone such as archaeological structures, reserved forest, noise sensitive zones etc. Clearances required
under the Forest (Conservation) Act, 1980, the Wildlife (Protection) Act, 1972 and/or the Environment
(Protection) Act, 1986.
6. High Tension lines or Hazard lines if any on the plot.
7. Plan showing HFL/CRZ lines.
8. Permissions granted by State Government in tabular and chronological form. Comparative statement
of components approved and components constructed including tis configuration as per earlier EC (if
applicable) and proposed development.
9. PP to submit the detailed master plan indicating already completed construction and proposed
construction. PP to submit the certificate from registered architect for completed work, built up area and
configuration.

10. Project cost shall be based on government notified stamp duty ready reckoner at time of application
including cost of land and construction including civil, MEP works, environment services, site/land
development, horticulture/landscape works etc complete

B) Base Line Data


11. Baseline environmental study for ambient air (PM10, PM2.5, SO2, NOx & CO),water (both surface and
ground), noise and soil for one month (except monsoon period) as per MoEF&CC/CPCB guidelines at
minimum 5 locations in the study area of 10 km, The collection and analysis of data shall be done by an
environmental laboratory duly notified under the Environment (Protection) Act, 1986, or an environmental
laboratory duly notified under the Environment (Protection) Act,1986, or an environmental laboratory
accredited by NABL, or a laboratory of a Council of Scientific and Industrial Research (CSIR) institution
working in the field of environment.
12. Detail on flora and fauna and socio-economic aspects in the study area. Details of tree cutting, tree
transplantation and survival report of existing trees including conformity to prevailing Tree Act.
13. Likely impact of the project on the environmental parameters (ambient air surface and ground water,
land, flora and fauna and socio-economic, etc.)
14. Source of water for different identified purposes with the permissions required from the concerned
authorities, both for surface water and the ground water (by CGWA) as the case may be, Rain water
harvesting, etc.
15. Socio-economic infrastructure details including public transport arrangements on the site; PP to
mention details of socio-economic in EIA.
16. PP to submit contour map with slopes, drainage pattern of the site and surrounding area. Layout
showing natural water courses on site; total runoff calculation before and after development.
17. PP to submit details of existing trees, proposed to be cut, proposed to be transplanted along with tree
survival report conforming to prevailing Tree Act.
18. Land use of the study area delineating forest area, agricultural land, grazing land, wildlife sanctuary,
national park, migratory routes of fauna, water bodies, human settlements and other ecological features should
be indicated.
19. Proximity to Areas declared as ’Critically Polluted’ should also be indicated and where so required,
clearance certifications from the prescribed Authorities, such as the SPCB should be secured and furnished
to the effect that the proposed Activities could be considered.
20. Similarly, for Coastal Projects, A CRZ map duly authenticated by one of the authorized agencies
demarcating LTL. HTL, CRZ area, location of the mine lease w.r.t. CRZ, coastal features such as mangroves,
if any, should be furnished. (Note: The Projects falling under CRZ would also need to obtain Approval of the
concerned Coastal Zone Management Authority).
21. The water requirement for the Project, its availability and source should be furnished. A detailed
water balance should also be provided. Fresh water requirement for the Project should be indicated.
22. Necessary clearance from the Competent Authority for drawl of requisite quantity of water for the
Project should be provided.

23. Description of water conservation measures proposed to be adopted in the Project should be given.
Details of rainwater harvesting proposed in the Project, if any, should be provided.
24. Impact of the Project on the water quality, both surface and groundwater, should be assessed and
necessary safeguard measures, if any required, should be provided.
25. Based on actual monitored data, it may clearly be shown whether working will intersect groundwater.
Necessary data and documentation in this regard may be provided. In case the working will intersect
groundwater table, a detailed Hydro Geological Study should be undertaken and Report furnished. The Report
inter-alia, shall include details of the aquifers present and impact of mining activities on these aquifers.
Necessary permission from Central Ground Water Authority for working below ground water and for
pumping of ground water should also be obtained and copy furnished.
26. Details of any stream, seasonal or otherwise, passing through the lease area and modification /
diversion proposed, if any, and the impact of the same on the hydrology should be examined.
27. Information on site elevation, working depth, groundwater table etc. should be provided both in
AMSL and BGL. A schematic diagram may also be provided for the same.

C) Traffic Impact Study in detail including:


28. Traffic Management Plan for the development – Internal circulation indicating road width and turning
radius. Cross section of roads at four places showing clear road width, distance left from building line, spaces
left for plantation, footpath, service lines etc.
29. Traffic Volume Counts and Turning Movement Counts on all the external surrounding roads of the
proposed project showing the time period taken.
30. Topographic details of roads and intersection of the surrounding roads where counts are taken, actual
geometry on ground to be shown with dimensions.
31. Traffic generation values of similar development to be given by actual count by actual count as
support data for assumption made to the particular project.
32. Impact on local transport infrastructure due to the Project should be indicated. Projected increase in
truck traffic as a result of the Project in the present road network (including those outside the Project area)
should be worked out, indicating whether it is capable of handling the incremental load. Arrangement for
improving the infrastructure, if contemplated (including action to be taken by other agencies such as State
Government) should be covered. Project Proponent shall conduct Impact of Transportation study as per Indian
Road Congress Guidelines.
33. Parking statement mentioning parking as per DCR & parking provided actually.
34. Basement ventilation plan: Fire Tender Movement Plan showing clear road and turning radius. Cross
section of roads at four places including UGT, OWC and DG set location showing clear road width and
distance left from building line & spaces left for plantation, parking, service lines, foot paths, etc.

D) Environmental Impact and Management Plan:


35. Identify sources of air pollution, indicate mitigation measures to reduce Air pollution/Noise pollution.

36. Debris management plan including (a) debris required for refilling, (b) contour plan, (c) details of
site where excess debris will be disposed, capacity of the site and NOC of plot owner. PP shall also ensure
that debris disposed on other plot shall not be disposed on another plot. If to be disposed on another plot, the
same shall be carried out as per prevailing environmental laws.
37. Management of solid waste and the construction & demolition waste for the project vis-a-vis the
Solid Waste Management Rules 2016 and the Construction & Demolition Rules, 2016. Transport, collection,
storage and disposal for all types of wastes like hazardous waste, non-hazardous waste, solid waste, E– waste,
and debris/excess earth etc. PP to provide the detailed solid waste management plan along with marked
locations on the master plan. Design details of waste processing equipment such as OWC/biogas plants
confirming to the technical requirements to meet the quality products.
38. Waste water management (treatment, reuse and disposal) for the project and also the study area.
Design of all STP’s along with BOD load, oxygen requirement calculations and sizing of the tanks with
respect to the design criteria. PP to submit detailed calculation for the disinfection of the treated STP water;
PP to submit cross sectional drawing of STP’s showing dimensions and ground level; PP to provide ozonation
for tertiary treatment. PP to mark the area required for all STP’s on master layout with dimensions
39. PP to show internal storm water drain and sewer line arrangements up to final disposal point.
40. Provision of mandatory RG area on virgin land and submit the drawing with calculations, ensuring
entire mandatory RG is provided on the plot where residential buildings are proposed.
41. A detailed phase wise development plan with safety planning where occupancy has been given.
42. If any site specific structures such as creation of water body, alteration of natural storm water, large
alteration of slopes, creation of green areas abutting to water bodies / natural storm water drain / river etc, is
involved, detailed environmental protection approach for the same shall be provided.
43. Separate chapter on Renewable energy in EIA report. PP to submit terrace plan for installing solar
panels& calculations of energy saving; Energy efficient measures (LED lights, solar power, etc.) during
construction as well as during operational phase of the project. Report on ECBC compliance.
44. Provide details of Solar PV and Solar water heater in the specific format. PP to carryout shadow
analysis for identifying the roof-top area for providing solar panels Minimum 5% of the total connected load
shall be provided with Solar PV.
45. Environmental status report including analysis reports of all environmental pollution reduction
facilities if any commissioned.
46. PP to submit Disaster management plan.
47. Preparation of site specific, executable and auditable environment management plan (EMP)
48. A time bound Progressive Greenbelt Development Plan shall be prepared in a tabular form (indicating
the linear and quantitative coverage, plant species and time frame) and submitted, keeping in mind, the same
will have to be executed up front on commencement of the Project. Phase-wise plan of plantation and
compensatory afforestation should be charted clearly indicating the area to be covered under plantation and
the species to be planted. The details of plantation already done should be given. The plant species selected
for green belt should have greater ecological value and should be of good utility value to the local population
with emphasis on local and native species and the species which are tolerant to pollution.

49. Benefits of the Project if the Project is implemented should be spelt out. The benefits of the Project
shall clearly indicate environmental, social, economic, employment potential, etc

E) Environmental Modelling and additional Studies:


50. Fugitive dust modelling by using local meteorological data.
51. Ecological footprint calculation using LCA approach.
52. Estimation of Carbon footprint of the project and its analysis to be included.
53. Assessment of ecological damage with respect to air, water, land and other environmental attributes.
The collection of data and sample analysis shall be done by an environmental laboratory duly notified under
the Environment (Protection) Act, 1986 or Environmental Laboratory accredited by NABL, or a laboratory
of council of Scientific and Industrial Research (CSIR) institution working in the field of environment.
54. Gate mass balance analysis for environmental parameters related to solid/liquid waste material
coming to site, waste generated and its treatment and disposal from site.
55. Public health implications of the Project and related activities for the population in the impact zone
should be systematically evaluated and the proposed remedial measures should be detailed along with
budgetary allocations.
56. Measures of socio economic significance and influence to the local community proposed to be
provided by the Project Proponent should be indicated. As far as possible, quantitative dimensions may be
given with time frames for implementation.
57. Detailed environmental management plan (EMP) to mitigate the environmental impacts which,
should inter-alia include the impacts of change of land use, loss of agricultural and grazing land, if any,
occupational health impacts besides other impacts specific to the proposed Project.
58. Public Hearing points raised and commitment of the Project Proponent on the same along with time
bound Action Plan with budgetary provisions to implement the same should be provided and also incorporated
in the final EIA/EMP Report of the Project.
59. PP to refer “approach paper for assessment for environmental damage and estimation of remediation
costs for building construction projects initiated with obtaining mandatory environmental clearance”
available on the portal : “ecmpcb.in”.

F) NOCs, Undertakings, CER and Litigations:


60. NOC’s required: a) CFO, b)Water supply with quantity, c) Drainage, d) Non-biodegradable waste
disposal, e) Aviation f) HRC, G) PESO , H ) Defence/NAD etc
61. Undertaking to provide DG set backup to all Pollution Control Devices, Water Supply, Emergency
Services including emergency lifts, etc.
62. Include condition of “maintenance of all Pollution Control Equipment’s and functioning of
Environment Monitoring Cell in PP’s MoU with society /maintenance agencies /vendors

63. PP to submit details of CER activities in consultation with the affected people in the project area as
per MoEF&CC circular dt. 01.05.2018, along with details of fund utilization & agreement or consent of
executor.
64. PP to submit Roles and Responsibilities of developer etc for compliance of environmental regulations
under the provisions of EP act.
65. Details of litigation pending against the project, if any, with direction /order passed by any Court of
Law against the Project should be given.

G) Specific Term of Reference


66. The State Government/SPCB shall take action against the project proponent under the provisions of
section 15 read in conjunction with Section 19 of the Environment (Protection) Act, 1986, and further no
consent to operate to be issued till the project is granted EC.
67. As per extant regulations at the time of scoping, if it is viewed that the project activity is otherwise
permissible, Terms of Reference (TOR) shall be issued with directions to complete impact assessment studies
and submit Environment Impact Assessment (EIA) report and Environment Management Plan (EMP) in a
time bound manner.
68. Such cases shall be subject to appropriate
(a) Damage Assessment
(b) Remedial Plan and
(c) Community Augmentation Plan.
69. Assessment of ecological damage with respect to air, water, land and other environmental attributes
shall be done before arriving at quantum environment remediation and natural and community resource
augmentation.
70. The methodology of calculating this quantum shall be as specified in format for Assessment of
Environmental damages in the paper titled “Approach for Assessment for Environment Damage and
Estimation of Remediation Costs for Building Construction Projects Initiated Without Mandatory
Environment Clearance” 2018
71. Preparation of EMP comprising remediation plan and natural and community resource augmentation
plan corresponding to the ecological damage assessed and economic benefits derived, which shall be based
on cost of project derived from prevailing rates of construction and land of government approved ready
reckoner, due to violation. The cost of the Project (capital cost and recurring cost) as prevailing in Annual
Statement of Rates / District Schedule of Rates/ Government Ready Reckoner Rates as well as the cost
towards implementation of EMP should be clearly spelt out.
72. The project proponent shall be required to submit a bank guarantee equivalent to the amount of
remediation plan and natural and community resource augmentation plan with the SPCB prior to the grant of
EC. The quantum shall be recommended by the EAC and finalized by the regulatory authority. The bank
guarantee shall be released after successful implementation of the EMP in a period of one year, followed by
recommendations of the EAC and approval of the regulatory authority.

73. The collection and analysis of data shall be done by an environmental laboratory duly notified under
the Environment (Protection) Act, 1986, or an environmental laboratory accredited by NABL, or a laboratory
of a Council of Scientific and Industrial Research (CSIR) institution working in the field of environment.
74. The remediation plan and the natural and community resource augmentation plan shall be prepared
as an independent chapter in the EIA report by the accredited consultants.
75. It should be clearly stated whether the proponent if it is a Company has a well laid down Environment
Policy approved by its Board of Directors? If so, it may be spelt out in the EIA Report with description of the
prescribed operating process/procedures to bring into focus any infringement/deviation/violation of the
environmental or forest norms/ conditions? The hierarchical system or administrative order of the Company
to deal with the environmental issues and for ensuring compliance with the EC conditions may also be given.
The system of reporting of non-compliances / violations of environmental norms to the Board of Directors of
the Company and/or shareholders or stakeholders at large, may also be detailed in the proposed safeguard
measures in each case should also be provided.
76. Besides the above, the below mentioned general points are also to be followed:

In case of continued violation after issue of TOR, the ToR/Environmental Clearance shall be
terminated forthwith.
