JOB OFFER TO LIMITED TERM CONTRACT
This Job Offer to Limited Term Contract (the “Contract”) is made on this day 17 July 2024,
BETWEEN
PNC Architects, having its Registered Office at 13th Floor, Sobha Sapphire Building, Khaleej Al Tejari
2nd Street, Business Bay, PO Box 122960, Dubai, United Arab Emirates. (Hereinafter referred to as the
“Employer”);
AND
Mr. “Md Amaan Dani” an “Indian” national, holder of Passport number P2448211 date of birth
30/06/2000(hereinafter referred to as the "Employee").
The Employer and the Employee collectively referred to as the “Parties” and individually referred to as
a “Party”.
WHEREAS, THE PARTIES HERETO HAVE MUTUALLY AGREED AS FOLLOWS:
(1) Position
The Employee is hereby appointed as “Junior Mechanical Engineer” on the terms and
conditions stated and agreed herein and subject to acceptance.
(2) Effective Date and Contract Period:
This Contract shall be effective from the date the Employee joins the Employer and shall remain
valid for a period of 2 years (“Term”) unless terminated in accordance with this Contract and
the provisions of UAE Federal Law No. 33 of 2021 Regulating Labour Relations and its Executive
Regulations (as may be amended) (collectively the “UAE Labour Law”) and decisions of
Ministry of Human Resources and Emiratisation (MOHRE), subject to clearance of Probation.
(3) Work Pattern:
The Work Pattern shall be as indicated in Annexure A.
(4) Probation:
The Employee shall be on probation for the period indicated in Annexure A. During the
probation period, the either Party may terminate the Contract upon giving the other written notice
of 14 days. On such termination, the Employee is entitled for remuneration for such 14 days’
notice period from the Employer, (except on the occasions of dismissal of Employee without
notice, in accordance with the UAE Labour Law). In the event that the Employee is terminates
employment during the probation period in order to join another employer in the UAE, the
Employee will be required to provide 30 days written notice to the Employer. In all instances,
the Employer reserves the right to seek reimbursement of the Employee’s recruitment costs in
accordance with UAE Labour Law.
If the Employee does not serve the notice period (as applicable for the Employee under
probation) on termination of the Contract or remains absent without any termination, during
the probation period, the Employee is not entitled for any pay, from the Employer for the notice
period. Further, the Employee is liable to compensate the Employer, for the unserved notice
period, in accordance with the UAE Labour Law.

At the end of probation period, the performance of the Employee shall be evaluated by the
management and his employment shall be confirmed, if the performance is found to be
satisfactory. In case of his performance is found to be unsatisfactory, the Employer shall have
the right to terminate the Employee’s employment forthwith upon notice in accordance with
this clause. On such termination the benefits, if any, accrued to the Employee, will be settled,
in accordance with the applicable Law.
(5) Location of Work:
The Employee shall be assigned to work at PNC Architects in Dubai, UAE. However, during
the period of employment, the Employee may be assigned or transferred to any of the
offices/departments/divisions/work place of the Employer or its subsidiaries located in the UAE
or any other country.
If such assignment or transfer requires the Employee to permanently relocate outside of the
UAE, the Parties agree to terminate this Contract and the Employee shall be entitled to his full
and final settlement as per UAE Labour Law.
(6) Duties:
Notwithstanding anything contained in this Contract, the Employee shall:
(i) Abide by all the rules and regulations laid down by the Employer at all times;
(ii) Work with a high standard of initiative, efficiency and economy, and shall perform,
observe and conform to such duties, directions and instructions assigned or
communicated to the Employee by the Employer and those in authority over the
Employee;
(iii) Perform such duties and exercise such powers and functions which may, from time to
time, be reasonably assigned to or vested in the Employee and such duties that relate
to the business of the Employer or of any other group company of the Employer
(“Group”); and
(iv) Faithfully serve the Employer and the Group to the best of the Employee’s ability and
use his best endeavors to promote the interests of the Employer and the Group.
(7) WORKING HOURS:
The maximum normal working hours is as stipulated in the UAE Labour Law, which shall not
exceed 48 hours per week. If the Employee is permitted to work on remote basis, by the
Employer, there shall be specific working hours for such pattern, which will be decided by the
Employer. The Employee will be given a weekly rest of not of less than a day, unless otherwise
stipulated in the UAE Labour Law.
(8) EMPLOYER’S OBLIGATIONS:
Compensation & Benefits:
Salary:
As indicated in ANNEXURE A.

Payment of Salary:
Subject to deductions, in accordance with the applicable Law by the Employer from and out
of total Remuneration, the salary shall be paid to the Employee by transfer of the same to
the bank account of the Employee. Upon commencement of his employment, the Employee
shall be assisted by the Employer to open a salary transfer account.
Temporary Accommodation:
Temporary accommodation will be provided to new employees recruited from overseas as
per the Employer’s policy.
Medical Insurance:
The Employer shall arrange for medical insurance of the Employee as per the Employment
Status which is indicated in ANNEXURE A.
Transportation:
Except, under the circumstances stated in the applicable Law mandating the Employer to
provide transport facility to the Employee (and/or) the Employer in its discretion undertakes
to provide any transport facility or cash equivalent, the Employee shall arrange his own
transport to the work place.
Work Regulations:
The Employee should make himself aware about the work instructions, penalties, prevailing
labour regulations and the safety standards and comply with the same.
Housing:
The Employee will be provided a cash alternative for housing, by including in the monthly
Remuneration payable to the Employee, by the Employer, which details are indicated in
Annexure A.
(9) Leave and Holiday:
(i) Annual Leave:
The Employee is entitled to Annual Leave with pay of not less than
a. Thirty (30) calendar days for each year of extended service;
b. Two days for each month, if his service period is between six months to one year;
c. Leave for fractions of the last year spent at work, incase service ends before using
his Annual Leave balance;
The Employee is required to avail his annual leave in the year of its entitlement by
intimating the Employer in advance. The Employer may after determining the dates of
such leaves in accordance with the work requirements and in agreement with the
Employee grant such leaves or grant them alternately by dividing the leave in two parts
at the most, except in cases of juvenile employee, where vacation may not be divided

in parts. The ticket costs for the Annual Leave to the Employee and/or his spouse and
maximum of his 2 children, as the case may be, will be paid by the Employer, provided
they does not avail any such benefit from any other person;
The Employee will be paid during the Annual Leave as per UAE Labour Law. The
Employee may only carry forward any unutilized leave with the written approval of the
Employer to the following year.
The calculation of duration of Annual Leave will be in accordance with the applicable
law;
The Employee under probation is not entitled for Annual Leave or any benefits thereof;
(ii) Sick and Other Leave:
Entitlement towards sick and other leave shall be in accordance with the UAE Labour
Law. During the probation period, the Employee shall not be entitled to any paid sick
leave. The Employee is expected to become acquainted with the Employer’s policy
regarding leave.
(iii) Public Holidays:
The Employee is entitled for leave on Public Holidays as declared for the private sector,
as notified by the Employer, unless the nature of the work being performed by the
Employee requires the Employee to work on holidays, based on the specific permission
of the Employer in writing.
(10) Severance Pay:
(i) Occupational Diseases & Accident Compensation
In cases of accidents and occupational diseases the Employer shall pay the Employee's
treatment expenses at government or private hospitals until he recovers. When
disability is proven the Employer will pay for transport expenses arising from the
treatment of the Employee;
In case of disability due to work or arising out of the work, the Employer shall pay the
Employee in accordance with the UAE Labour Law;
If the Employee has deliberately caused injury to himself with intention of committing
suicide or to obtain indemnity or sick leave or otherwise, or if the Employee was at the
time of the incident under the influence of drugs or alcohol, or if he has willfully violated
safety instructions displayed conspicuously at the place of business or if his injury or
disability resulted from serious premeditated misdemeanor on his part or if he has
refused unreasonably the medical checkup or treatment as prescribed by the medical
board formed in accordance with the provisions of UAE Labour Law, the Employer shall
not be under obligation to provide treatment or any financial compensation to the
Employee;
If the Employee dies as a result of an accident or occupational disease, the Employee's
family members shall be entitled to a compensation in accordance with the UAE Labour
Laws, in addition to the end of service Gratuity. The Employer will pay for transport
the Employee remains (body) to his country or origin, to his family members.

(ii) End of Service Remuneration (Gratuity)
In accordance with the UAE Labour Law.
(11) Employee’s Obligations:
(i) The Employee undertakes to familiarize himself with all the applicable policies and
procedures of the Employer as existing (as may be amended from time to time).
(ii) If any of the obligations of the Employee shall become illegal or unenforceable in whole
or in part, the remaining obligations of the Employee shall be valid, binding and existing,
for the purpose of this Contract.
(iii) The Employee undertakes not to pursue any other employment, either on a part-time
or fulltime basis for remuneration or otherwise, except with the prior written permission
of the Employer. Contravention of this provision shall lead to termination of the
Employee’s employment forthwith upon notice, without any compensation whatsoever.
(iv) The Employee shall neither divulge nor give any information regarding the Employer’s
business, processes, technical know-how, security arrangements, administrative and/or
organizational matters which are of a confidential nature, which the Employee may
come to know by virtue of his employment, to any unauthorized person during the
period of his employment or any time thereafter for a minimum period of one (1) year
from the date of termination of employment.
(v) The Employee shall keep confidential all information and material provided to the
Employee by the Employer or its clients, concerning their affairs. The Employee shall
not release, use or disclose such information or material except with the prior written
permission of the Employer. The Employee’s obligation to keep such information
confidential shall remain even on termination or cancellation of his employment, for a
minimum period of one (1) year from the date of such termination or cancellation.
(vi) The Employee shall forthwith disclose to the Employer any discovery, invention, process
or improvement made or discovered by him, and such discovery, invention, process or
improvement shall belong absolutely to and be the sole and absolute property of the
Employer. If and when required to do so by the Employer, the Employee shall, at the
Employer's expense, take out or apply for a patent, license, trademark or other rights,
privileges, protection or improvement so that the benefit thereof shall accrue to the
Employer and the Employee shall execute all instruments, acts, deeds and things which
may be required by the Employer for assigning, transferring or otherwise vesting the
same in favour of the Employer or such other persons, firms or companies as Employer
may direct as the sole beneficiary thereof.
(vii) The Employee shall not enter into any commitments or dealings on behalf of the
Employer for which the Employee has no express authority nor exceed the authority or
discretion vested in the Employee, without the prior permission of the Employer or
those in authority over the Employee.
(viii) The Employee shall be responsible for the safekeeping and return in good condition
and order of all the property of the Employer, which may be in the Employee’s use,
custody, care or charge. For the loss of any property of the Employer in the Employee’s
possession, the Employer shall have a right to assess on its own discretion and recover

the damages of all such properties from the Employee and to take such other action as
it deems proper in the event of the Employee’s failure to account for such property to
the satisfaction of the Employer.
(ix) The Employee shall perform the work by himself under the direction and supervision of
the Employer or his representative and shall not outsource the work.
(x) The Employee shall implement occupational safety and health instructions, prescribed
by the Employer.
(xi) The Employee shall work diligently to develop his functional and professional skills and
shall continue to nurture the same.
(xii) The Obligations referred hereinabove will be without prejudice to any other conditions
stipulated in the UAE Labour Law.
(12) Preconditions:
(i) Satisfactory references from your present or previous employers.
(ii) The Contract will be rescinded immediately in the event the Company is unable to
procure the necessary work permit or residence visa for the employee due to any reason
whatsoever.
(iii) This Contract may be terminated immediately if the employee commits any violation as
detailed under the UAE Labour Law.
(iv) The Employee will be bound by all the rules, regulations, policies and ethics of the
Company, as may be amended from time to time.
(v) The Employee is required to undergo all necessary medical examinations as required
by the UAE Government. Failure to pass necessary medical examinations will result in
this Contract being rescinded immediately and the Employee will be sent back to his
home country.
(vi) The employment relationship will be governed by the UAE Labour Law in respect of any
matter not covered under this Contract.
(13) Termination of Employment:
This Contract may be terminated by either Party, for the reasons stated in the applicable Laws
and in this Contract, either prior to the expiry of the Term or during the Term by providing a
notice of termination as mentioned in Annexure A. Upon termination of the Employee’s
employment for any reason, the Employee shall:
(i) forthwith return all correspondences, documents, computers, sim card, computer disks
and software equipment, memory cards, external hard drives, medical insurance cards,
parking card, ID’s and any other property of any kind belonging to the Employer and/or
the Group which may be in the Employee’s possession or control. For the avoidance of
doubt, the Employee shall not be permitted to retain any such information or documents
(or copies thereof) after the termination of his employment for whatever reason; and
(ii) co-operate with the Employer in completing all necessary formalities to notify the

relevant immigration and employment authorities including the Labour Department in
the UAE of the termination of employment and the cancellation of the Employer’s
sponsorship of the Employee;
(iii) in case of non-compliance of the notice period by the Employee, the Employer is entitled
to act in accordance with the applicable law;
(iv) if the Employee desires to terminate the contract, the Employee shall bear the ticket
cost for returning to home country.
(14) Suspension, Disciplinary Proceedings and Dismissal:
The Employee is aware that the Employer is entitled to suspend, initiate disciplinary proceeding
and dismiss the Employee without notice, for the reasons stated in the UAE Labour Law and in
accordance with such Law.
(15) Notices:

Any change in the residential address must be communicated to the Employer in writing by the
Employee.
(16) General:
(i) The Parties acknowledge that they are obliged to execute a standard contract of
employment as per the Ministry of Human Resources and Emiratisation (MOHRE)
template (“MOHRE Contract”) in addition to this Contract for the purposes of
registration with the relevant governmental authorities.
(ii) This Contract, together with the MOHRE Contract, constitutes the entire understanding
and agreement between the Parties and supersedes all previous offers or contracts, if
any, verbal or written, exchanged or executed between the Parties.
(iii) No variation of this Contract shall be valid unless it is in writing and signed by or on
behalf of the Parties.
(iv) The Employee confirms that all information which he has provided to the Employer
and/or the Group relating to his professional experience and educational qualification
is true and accurate. In the event that any information is shown to be inaccurate, the
Employee’s employment may be terminated immediately.
(v) The Employer will be responsible for obtaining the requisite residence work permit and
other necessary statutory approvals on behalf of the Employee and eligible dependents.

The costs incurred towards such permits/approvals will be borne by the Employer. The
costs towards attestation of various personal documents of the Employee including
certificates of educational qualifications shall be borne by the Employee.
(vi) In the matter of service conditions including those not specifically covered by this
Contract, the Employee shall be governed by the Employer's policies. According to the
Labour law, the Employer can amend, add, remove the points in the contract and can
review as per the company policy from time to time and the Employer’s decision in this
respect shall be final and binding.
(vii) In case of any dispute of any kind arising out of the Employee's employment or breach
of this Contract, a court of law in the UAE alone shall have jurisdiction to adjudicate
upon any such dispute and the governing Law for the purposes of the Contract shall be
the UAE Labour Law.
(viii) Any gender shall include the other genders and references to the singular shall include
the plural and vice versa.
(ix) The headings in this Contract are for convenience only and shall not affect its
interpretation.
(x) The provisions contained in each clause and sub-clause of this Contract shall be
enforceable independently of each of the others and its validity shall not be affected if
any of the others is invalid. If any of those provisions is void but would be valid if some
part of the provision were deleted, the provision in question shall apply with such
modification as may be necessary to make it valid.
(xi) The Employee shall disclose the personal information about him and his family, as
required in the applicable law that are being sought for by the Employer in the course
of Employment. The Employee further consents the Employer to transfer his personal
data to anyone, in accordance with any applicable law or to comply with the terms of
the Contract;
If the terms of this contract are acceptable to you, please sign and return the duplicate copy of this
Contract to confirm your acceptance on or before 22 July 2024 along with the following documents.
Failure to do so shall result in this Contract being cancelled with immediate effect.
1) Clear copy of passport (validity - minimum 1 year);
2) Colour passport size photographs on white background - 10 Nos;
3) Attested qualification certificate (Duly attested by UAE Embassy and MFA);
4) Clear copy of salary declaration or payslip (if applicable);
5) Clear copy of visa and immigration cancellation (if applicable);
6) Clear copy of previous Emirates ID (if applicable).
