MODULE-SPECIFIC INSTRUCTIONS

2.3 Name two (2) factors which a court would consider when deciding whether the
evidence was obtained unconstitutionally. (2)

3.1 Identify and briefly explain any five (5) investigative techniques. Provide a
practical example of how each of the identified investigative techniques could be
applied in practice. (15)
3.2 A professional investigator should possess certain characteristics. List any five
(5) characteristics of an investigator and briefly explain what each one entails.

Question 4 [40]
The police received a report about the body of a man inside an abandoned house near
a dumping site. Police officials proceeded to the scene where members of the public
pointed to the location of the body. The body was found inside a dilapidated house at
the dumping site. The doors and windows of the house have been removed. The body
has multiple stab wounds. People who are working at the dumping site can identify the
deceased male person.
4.1 Discuss the general elements of an offence (4x4) and link your discussion of
these elements to the above scenario (2x4). (24)
4.2 Provide a relevant practical example from your work environment in your
discussion of each general element of an offence. (4)
4.3 Identify and briefly explain the requirements of the ground of justification that may
be raised by an accused in the scenario. (5)
Question 4 is an essay-type question. Your answer to this question must comply with
the following technical requirements: (7)
Title: Provide a descriptive title for your answer (1).
Introduction: Provide a brief discussion of the topic and briefly describe what you are
going to discuss (2).
Content: This is to be presented under suitable headings and sub-headings which are
numbered accordingly (2).
Conclusion: Provide a brief summary of your discussion and indicate the importance
of understanding the different elements of an offence (2).
