Dear Sir,

Under instructions from and on behalf of my client's M/s. Stellar

Information Technology Private Limited, a Company incorporated under
the Companies Act, having its registered office at 205, Skipper Corner,
88 Nehru Piace, New Delhi - 110018, I give you the foilowing Notice: -
1. That my client is one of the pioneers in Data Recovery Industry in
India and has been providing a wide range of Data Recovery, Data
Migration and Data Erasure Solutions through software and
services to its clients in India and abroad. My client has
established itself as a market leader in delivering the recovery of
lost data from inaccessible computer storage media for over 25
years to over 3 million satisfied clients across 190 countries
worldwide & India and has expertise interalia in recovery from
almost all storage media/devices such as Computer Hard Drive,
Servers (all configurations). Solid State Disk, External hard drives.
Tape storage, USB drive etc.

2. That you, the Noticee approached my client on 09/03/2023 for

Data recovery from your HDD Sr. No. W3T7JMDL Size 500 GB. As per
the process of my client, my client sent the MAF Form to you
containing the detailed terms and conditions and the overall
process, which were duly accepted and signed by you. The media
was received ih the office of my client on 09/03/2023.

That on 10/03/2023 my client shared the analysis report

containing terms & condition and the quotation of Rs. 32500-1- GST
for the recovery charges.

That my client on 16/03/2023 gave the revised quotation of Rs.

26000 + 18% GST being the Recovery charges for the same.

That said revised quotation for the recovery charges was duly
approved by you vide email dated 18/03/2023. A Purchase Order
dated 20/03/^023 for the recovery charges was also received by
my client. Suffice to state here that the tampering permission of
the storage media was also sought by my client and the same was
approved and granted by you.

That my client shared regular updates on the recovery and on

25/03/2023, It was informed by my client to you that the recovery
process has been completed and the data be verified by you. On
25/03/2023, my client also shared the Directory Listing of the
recovered data to you, which was duly verified, accepted and
confirmed by you on 27/03/2023 and which was also confirmed.
My dient also sent soft as well hard copy of the Invoice dated
28/03/2023 Rs.30680/-.

That despite requesting you to supply the blank hard drive to my

client, you supplied hard drive containing data. My client vide
email dated 29/03/2023 informed you that the event the
recovered data is copied in hard drive supplied by you, there is a
possibility of the data in the hard drive being over written by the
recovered data. You vide email dated 28/03/2023 informed my
client to copy the recovered data in the hard drive given by you
containing some data, despite being fully aware of the risk of old
data being over written or being Ultimately lost.

8. That the Hard Drive containing the recovered data was handed
over to you on 30/03/2023 the receipt which was duly
acknowledged by you.

9. That despite repeated requests and reminders sent to you by my

client to pay the balance amount of Rs. 30680/-, you have failed
to pay the same.

10. That accordingly, my client is left with no other option but to call
upon you by means of this legal notice to pay an amount of Rs.
30680/- which you are liable to pay to my client for the services
provided by niy client to you.

11. That you are therefore liable to pay to my client and my client is
entitled to recover the aforesaid amount of Rs. 30680/- along with
interest @ 24 % per annum the transaction being commercial,
failing which my client will be forced to take such legal action as
advised to then under the facts and circumstances of the case at
your costs as to risks and consequences.

Under the circumstances please take this Notice of demand to pay

to my client the aforesaid amount of Rs. 30680/- alongwith upto date
interest at the rate of 24 % per annum and an amount of Rs. 25,000/-
being the cost of this with in a period 30 days of the receipt of this
notice, failing which, my client shall be constrained to take such legal
action including criminal and civil action, as advised to them under the
facts and circumstances of the case entirely at your risks as to costs and
consequences.

Copy of this Notice is retained in my office for future reference.
