Subject:- Reconsider the cases of JBT Teachers regarding granting the
benefit of ACP’s 1%, 2" & 3",
In continuation of this office letter No. KW 12/27-2023 Estt.
PRT/Guest (1) dated 11.03.2024 on the subject cited above.
It has come into the notice of the Directorate that many PRT/JBT
Teachers have been granted the ACP by ignoring the provisions contained in para
8/1 of Haryana Civil Services ACP Rule 2016 issued notification dated
28.10.2016. In Para 8 of Haryana Civil Services ACP Rule 2016 the following
provision has been made:~
8. Other general conditions of eligibilities of ACP Level—
The following general conditions shall also be fulfilled by a
Government employee for availing benefit of ACP Level:
(a) after completing the respective prescribed period for
eligibility for the grant of any of Ist, 2nd or 3rd ACP Level
the Government employee shall be fit to be promoted to the
immediate next higher post only in the functional hierarchy
in his cadre, but despite of fitness he could not be
functionally promoted due to lack of vacancy or otherwise
‘on the promotional post in the hierarchy to which he is
eligible to be promoted;
(b) if such promotion involved passing of any departmental or
other test, acquisition of higher educational qualification,
etc., such condition shall also be fulfilled by the
Government employee.
From the perusal of the said rule it is clear that if an employee is not
fit to be promoted to the immediately next higher post only in functional hierarchy
in his cadre, but despite of fitness he could not be functionally promoted due to
lack of vacancy or otherwise on the promotional post in the hierarchy to which he
is eligible to be promoted.
It has come into the notice that many teachers are not eligible are
promotion to the post of head teacher from the post of JBT as many teacher does
not qualified the essential academic qualification as per provision in the Rule 2012.It is also informed that the relevant academic qualification and
experience for promotion from the post of JBT/PRT to Elementary School
Head Teacher as prescribed in Appendix B (See Rule 7) of the Haryana
Primary School Education (Group C) District Cadre Service Rules, 2012
(Annexure P-2) is reproduced as under
By promotion:-
(® Senior Secondary (or its equivalent) with at least 50% marks
and 2 year Diploma in Elementary Education; OR
Senior Secondary (or its equivalent) with at least 45% marks
and 2 year Diploma in Elementary Education in accordance
with the NCTE (Recognition Norms and Procedure), Regulations
2002; OR
Senior Secondary (or its equivalent) with at least 50% marks
and 4-year Bachelor of Elementary Education (B. El. Ed.); OR
Senior Secondary (or its equivalent) with at least 50% marks
and 2 year Diploma in Education (Special Education);
(ii) At least six years regular service as Primary Teacher (PRT);
(iii) At least 3 weeks in-service training in administrative and
accounts module.
‘A committee have been constituted at the level of the Head Office
vide order no. 12/27-2023 PRT/Guest (1) dated 10.01.2024 for reconsider the ACP
cases of JBT Teachers, those are not eligible for promotion of Elementary School
Head Teacher. It is also submitted that pay fixation committees have also been
constituted at the District level in the DEEO Office.
It is requested to examine the ACP 1*, 2% and 3 cases of JBT
Teachers in which the benefit have been granted by ignoring the above provision
by the committee constituted at the level of all DEEO office and send to this
Directorate for re consideration. Top priority may be given to this.

Under the control of Directorate, Elementary Education, Haryana two categories
of teaching staff i.c. PRTUBT) and TGT(MASTER) are being dealt for grant of ACP. As per
provision of Rule-11(1) of ACP Rules, 2008 and 2016, the authority competent to grant
Promotion in case of Govt. employee shall be required to pass suitable orders for grant of ACP
level. Rule 7 to 11 of ACP Rules, 2008 and 2016 should be kept in view at the time of ACP. As
per relevant service Rules, 1998 and 2012 as applicable for the post of PRT and TGT, competent

“The Th February, 2019
No. GSR.44,ConstJArt.309/19.— In exercise of the powers conferred by the proviso to article 309 of the
CConstinton af india, the Governor of Haryana hereby makes the following rules further to amend the Haryana Civil
Services{Revised Pay) Rules, 2008, namely:-
1. (1) These ules may be called the Haryana Civil Services (Revised Pay) Amendment Rules, 2019.
(2) These rules shal be deemed to have come into fore with effet from the Ist Jnuary, 2006
2. In the Haryana Civil Services (Revised Pay) Rules, 2008 cherein after called the said rules), for rule (8)
following rule shall be substituted namely:~
‘(Entry level pay inthe revised pay stature ofthe employees by dirt recruit ar by promation on
rafter the Ist January, 2006,
(a) The column number 7 and 8 of Section 1 of Part A of the Fist Schedule of these roles
indicating the eoty level pay inthe pay band at which te pay of direct recruit or promt employee to
srvarticuae post carrying & specific grade pay where existing pay scale has been upgraded, shall be
fixed on or aftr the Ist January, 2006.
(b) The column number 6 and 7 of Section Ml of Part A of the First Schedule of these rues
indicating te etry level pay i the pay baad at which the pay of direct recruit or promotee employee fo
inwaricuar post carting a specific grade pay in other cases where existing pay seale has not been
‘upgraded, shall be fixed on or after the Ist January, 2006.
{This shall also be applicable in the case of those recruited between the Ist January, 2006 and
the date of issue of this Notification. In such cases, where the emoluments in the pre-revised pay
sele(s) fie, basic pay in the pre-evised pay sca.e(s) plus deamness pay plus dearess allowance
Spplicble on the date of joining] exceeds the sum ofthe pay fixed in the revised pay structure and the
seolcabledeamess allowance thereon, the difference shall be allowed as personal pay to be absorbed in
future increments in pay
Provided that where Grade Pay of the post shall be upgraded after the Lst January, 2006, the
ny level pay of such post shall be determined by wakipying, minimum of the existing pay seale as
eri st December, 2005, by a fnctor of 1.86 and rounding of the resultant figure to the next multiple of
ten. The grade pay corresponding tothe upgraded scale shall be payable in adtion.”
|b. Inthe said rales in sub rule (1) in rule 13, fr the words “minimum ofthe higher pay band,” the words “entry
pay ofthe grade pay” shall be substituted.
4. Inthe said rules, in the FIRST SCHEDULE,
