“Una po akong nilapitan ni Ms. Chariz Fheid Barraza sa chat. Sa pag-uusap po namin, ikinuwento niya po sa akin ‘yung mga problema po niya sa
kaniyang kasalukuyang kasintahan na si Mr. Rhein Crisologo. Nabanggit niya rin po na plano na niyang makipag-break kay Rhein. Nagpatuloy po
ang mga naging pag-uusap namin ni Chariz sa chat. Ako naman po, bilang kaibigan ay nakikinig at nakikipag-usap nang maayos at walang malisya
kay Chariz.

Kanina po, mga bandang 11:50 AM, tinawag po ako ni Ms. Asianna Mariez Dianalan at pinababa dahil mayroon daw siyang mahalagang bagay na
sasabihin sa akin. Sa aming pag-uusap, nabanggit ni Asianna na parang gusto raw ni Rhein ng comeback o makipag-balikan kay Chariz, to the point
na parang obsessed na raw si Rhein. Sinabi rin sa akin ni Asianna na may mga pagkakataon pa raw na pinipilit ni Rhein na kausapin si Chariz, na
sila ay napagsabihan pa ni Sir Kennedy Zorilla, ang aming PE teacher.

Pagkatapos naming mag-usap ni Asianna, nakita ko si Rhein na malapit sa playground sa first floor kasama ang isa pa niyang kamag-aral na si Mr.
James Clyde Sobremonte. Habang paakyat na ko at pabalik sa aming classroom, bigla akong inakbayan ni Rhein at sunod-sunod na pinagpapalo
ang tiyan ko at sa bandang gitna ng tiyan at dibdib. Marami pa siyang mga sinabi sa akin habang naka-akbay ngunit hindi ko na maintindihan at hindi
ko na rin natandaan. Nahabol niya pa ko ng isang suntok na tumama malapit sa kaliwang tenga pagkatapos niya akong suntuk-suntukin sa tiyan. Sa
pagkakataong ‘yon ay pinaakyat na ako ni JC upang makaiwas sa karagdagang gulo. Habang paakyat ako ay nakita ko ring hine-headlock niya si
Chariz sa baba.”
ACTIONS DESIRED:

Complainant did not ask for any specific sanction to be imposed to the respondent apart from making him apologize for what he did.

PHYSICAL ASSAULT AND VERBAL INTIMIDATION


MINUTES OF THE CONFERENCE PROPER:
1. CONFERENCE WITH MR. G3 GAVRIL SEBASTIAN YUZON, THE COMPLAINANT
 The complainant, G3 Gavril Sebastian Yuzon, initially received a congratulatory message from Ms. Chariz Fheid Barraza after placing as
first runner-up in the recently concluded Mr. and Ms. VMC Junior High School Edition.
 As per the complainant, he never had any prior face-to-face interaction with Ms. Barraza apart from their online exchanges. It was only
this Thursday, 09 November 2023 that they spoke with each other regarding the quick-spreading rumors about them and the rift between
Ms. Barraza and the respondent, Mr. Rhein Crisologo.
 Prior to the incident, the complainant was with Ms. Barraza and Ms. Asianna Mariez Dianalan, a witness.
 The incident happened after the complainant’s conversation with Ms. Barraza, wherein the respondent, Mr. Crisologo, ran towards him
and wrapped his arms around his neck while punching and slapping him right between his chest and abdomen. The complainant also
claimed that the respondent was telling him something while punching him; he cannot, however, remember what his words were.
 Mr. James Clyde Sobremonte, one of the witnesses, saw the incident and intervened. He pushed Mr. Crisologo away from Mr. Yuzon, so
that the latter can get away. However, Mr. Crisologo was able to land one last haymaker on the complainant, which hit him below his left
ear. The complainant did not dare fight back and walked away.
 The complainant claimed that he saw the respondent putting Ms. Barraza on a head lock after their altercation.

2. CONFERENCE WITH THE WITNESSES , MR. JAMES CLYDE SOBREMONTE AND MS. ASIANNA MARIEZ DIANALAN
 The witnesses claimed that the cause of the altercation was the respondent Mr. Rhein Crisologo’s jealousy and misinterpretation of the
exchanges between his girlfriend, Ms. Chariz Fheid Barraza, and the complainant, Mr. G3 Gavril Sebastian Yuzon.
 The witnesses claimed that long before this incident, they have witnessed frequent quarrels between Mr. Crisologo and Ms. Barraza.
 The incident happened as they saw the respondent wrapped his arm around the complainant’s neck while punching him in the abdomen
as they went upstairs. As they reached the second floor, Mr. Sobremonte intervened and pulled them away from each other. As the
complainant walked away, the respondent suddenly threw a punch which hit him at the back of his left ear and jaw.
 The witnesses also claimed that they saw the respondent wrapped his arms around Ms. Barraza while loudly asking, “jowa kita, ‘di ba?”
(you are my girlfriend, right?)

3. CONFERENCE WITH MS. CHARIZ FHEID BARRAZA


 Ms. Barraza claimed to experience verbal abuse from the respondent, Mr. Rhein Crisologo, whenever they have a misunderstanding.
 Ms. Barraza claimed that she already broke up with Mr. Crisologo through chat on 06 November 2023. However, it seemed that Mr.
Crisologo failed to understand what she meant, ultimately believing that they are still in a relationship with each other.
 Mr. Crisologo bumped into Ms. Barraza after the former punched Mr. Yuzon. She got hurt and sobbed a little, so Mr. Crisologo rushed to
comfort her.
 Ms. Barraza claimed that she heard majority of the rumors from her classmates, particularly Ms. Mhary Rieal Bonete and Ms. Zhakiyyah
Nicole Timtim. She also claimed that Mr. Aldrin Gabriel Lascano, Mr. Yuzon’s best friend, might know something about it.
 Finally, Ms. Barraza claimed that Ms. Kristina Cassandra Sencil relayed the rumors to her.

4. CONFERENCE WITH THE RESPONDENT, MR. RHEIN CRISOLOGO


 The respondent claimed that Ms. Chariz Fheid Barraza never broke up with him. “Nagpapahinga lang po kami, pero kami pa rin.”
 Last Tuesday (07 November 2023), the respondent claimed that he heard rumors from Ms. Barraza’s circle of friends regarding her
feelings toward him. The respondent claimed to clarify what the rumors said. Instead, he just said that it “raised his suspicions.”
 Wednesday (08 November 2023), the respondent got a word from Mr. James Clyde Sobremonte of a rumor that the complainant, Mr. G3
Gavril Sebastian Yuzon, and Ms. Barraza were seen together.
 The respondent claimed that he heard multiple rumors from Ms. Mhary Rieal Bonete, one of his classmates, about the budding romantic
relationship between the complainant, Mr. Yuzon, and Ms. Barraza. He also claimed to have seen the two together, all the more
“confirming” his suspicions.
 The respondent admitted to wrapping his arm around the complainant’s neck and punched him in the chest and the abdomen while telling
him “Nang-aagaw ka ng babae”. The respondent also admitted to punching the complainant somewhere on the left side of the neck.
OTHER DETAILS OF THE CONFERENCE:

Four separate conferences were held and led by the Prefect of Discipline. The advisers of the two involved sections were present on all the said
conferences.

ACTIONS TAKEN TOWARDS SETTLEMENT:

 Initial complaint was filed on 09 November 2023.


 The Prefect of Discipline conducted a series of interviews with the complainant, the respondent, eye witnesses, and students whose names
were introduced into the investigation by both the complainant and the respondent.
 The Prefect of Discipline convened with the complainant’s and the respondent’s respective class advisers, the grade level coordinator, and
the school principal to discuss the results of the investigations and come up with an appropriate action plan and resolution.
 The Committee also met with the parents of both the complainant and the respondent to discuss the complaint, the actions taken, and the
resolutions reached, which were explained in detail below.
AGREEMENT/S REACHED:

Sanctions imposed against the respondent, Mr. Rhein Crisologo:


1. A failing “E” grade on the Character-Building Sheet (CBS) for the first quarter, specifically indicating a deficiency in the following
attributes:
 Personal discipline;
 Concern for the common good;
 Courtesy;
 Respect for others;
 Social relationship; and
 Sportsmanship.
2. A THREE-DAY DISCIPLINARY SUSPENSION shall be imposed on the respondent, based on the following grounds:
 Pursuant to Section 5.2 Major Misconducts of Article IV of the Basic Education Department Student Handbook (p. 28), the
respondent has committed physical assault upon others.
 Section 7.1 Sanctions on Major Misconducts of the same Article mandates the Committee to, depending on the gravity of the
misconduct, select an appropriate sanction from the following:
 Dismissal (honorable or dishonorable);
 Dropping from the rolls during the semester which the student is enrolled in;
 Suspension;
 Withholding of graduation; or
 Curtailment of student privileges.
 Upon careful consideration, the Committee has decided to impose a three-day disciplinary suspension on the respondent for the
offence committed.
3. The respondent shall also be required a written apology and promissory letter to refrain from committing the same or any other
violation. The written apology must be addressed to the complainant, with copies furnished to the school principal and the CSDE.
4. The respondent may also undergo guidance counseling based on the availability of the guidance counselor.
