1. INTRODUCTION

1.1. Background
The Purpose of the Terms of Reference for Environmental and Social Impact Assessment (ESIA) of Crop
production Farm is to provide a detailed description of the work to be carried out by the Planet Consultant &
Training service PLC in order to fulfill the requirements for Environmental licensing of proposed project.
Planet Consultant & Training service PLC has prepared this terms of reference to provide the guidelines for
undertaking an Environmental and social Impact Assessment (ESIA) study for the proposed development.

Model Farmer Mustefa Regasa moved to Investment on Government land accessed based on his investment
proposal, the Oromia Investment Board have been meet on date of 09/02/2017.EC decided to Farmer
Mustefa Regasa Moved to Investment on planting Crop production farm project. The project bordered by
North, Dinsho Investment farm, from South Yusuf Ahmed and Abadir Sasaba Farm, from East Melka
Bedesa, and from the west Melka Canco. The total land allocated for project is 7.2 hectare on which the
proponent will invest.
In order to ensure that the proposed project is sustainable, it is essential to integrate socio-environmental
concerns starting from the early stage of the project proposal. The proposed project is Crop production Farm
involving the deliberate management of crop farm. The Environmental and Social impact assessment report
will be prepared by Planet consultant and training service PLC for proposed project located in Cara kebele
Gechi district, Buno Bedele zone, Oromia regional state. The site visit will be accomplished together with
experts of district EPA office department of environmental protection.

Terms of Reference (TOR) for preparation of Environmental and Impact Assessment (ESIA) as per the
Oromia ESIA principle No. 05/2014 has been devised to improve the quality of the reports and facilitate
decision-making transparent and easy.
Therefore the project proponent is required to submit a PESIA report to EPA for approval before
commencing implementation of the project. By this report the relevant government authorities are able to
monitor impacts within the life span of the project on the immediate environment, so as to enable major
stakeholders of the project including the government agencies to manage the environment for the wellbeing
of the community.

2. OBJECTIVES
2.1 Objective of the TOR
The purpose of this Terms of Reference (TOR) is to undertake an environmental and social assessment of
the impacts associated with the establishment of Crop production Farm as per the EIA guideline has been

devised to improve the quality of the reports and facilitate decision-making transparent and easy. It is also to
set the objectives, describe the project, and establish the strategy and schedule to develop, and approve a
PESIA for the project.
TOR will help the project proponents and consultants to prepare report with relevant project specific data
and easily interpretable information. TOR for proposed project is expected to cover all environmental and
social related features.
The following are the main objectives of this TOR document:
 To identify key issues and concerns raised by public and stakeholders for consideration in the
development of the ESIA study; and
 To identify resource areas that have the potential to be impacted and environmental issues that may
require further studies in the PESIA.
 Identification and assessment of impacts due to existing and proposed project activities on the
environmental components.
 Analyze how the Project may interact with resources and receptors identified during
 baseline studies in order to define, predict, and evaluate the likely extent and
 Significance of environmental and social impacts that may be caused by the Project.
 Develop and describe effective, realistic, and practical mitigation measures that avoid, reduce, control,
remedy, or compensate for negative impacts and enhance positive benefits.
 Evaluate the predicted positive and negative residual impacts of the Project.
 Develop a system whereby mitigation measures are integrated into Project activities and become Project
commitments. This is achieved through the development of an
Environmental and Social Management Plan (ESMP)

3. PROJECT DESCRIPTION
Ethiopia’s oilseed sector plays an important role in generating foreign exchange earnings. The three major
oilseed crops (sesame, soybean, and niger seed) contribute to nearly 20% of Ethiopia’s total agricultural
export earnings, second only to coffee. In MY 2018/19 (Oct-Sep), exports of sesame, Niger seed, and
soybeans generated nearly $430 million in export earnings. In addition, the oilseed sector provides income
to millions of growers and others market actors along the value chain.
The production of sesame, Niger seed and soybean is estimated to increase in MY 2019/20 (Oct-Sep) on
average by seven percent over last year. Looking ahead, Post expects production of soybeans and Niger seed
to increase to meet the growing demand for cooking oil and livestock feed, most notably soybean meal for

poultry production. Sesame seed is one of the most widely produced oilseed crop, accounting for 30 percent
of total oilseed production in the country. The proposed project will involve the growing of Crop Production
both during the rainy season and by centre pivot irrigation during the dry season. Gechi district is one of the
districts in Buno Bedelezone of Oromia regional state where the crop production farming mostly cereal crop
farm is well known. The project will comprise developing farm and Construction of staff housing, toilets
and showers, other infrastructure to be constructed like chemical storage area, machinery workshop and
Production store on a total of about 7.2hectares of land.
Some of the farm site is used for the construction of offices, clinic house, toilet, drying floor, store,
residents, garage, cafeteria, and nursery. It also includes establishment and procuring force to run the project
activates.

The land size allocated of the project is 7.2 hectares of land that Oromia investment board approved for the
proponent. The project will create job opportunity for Temporary and permanent workers from the local
community. The company also provides an opportunity to transfer technology that could really the local
community of the area will be benefited from the proposed project operation.

4. PROJEC T LOCATION
Buno Bedele (also Buno Bedelle; Oromo: Buunoo Beddellee) is one of the zones of the Oromia Region in
Ethiopia. Located in western Oromia, Buno Bedele is bordered on the south by Southern Nations,
Nationalities, and Peoples Region, on the west by the Ilu Aba Bora Zone, on the north by the East Wollega
Zone and West Wollega Zone and on the east by the Jimma Zone. Its administrative center is Bedele, The
Buno Bedele was created by 9 districts and 1 town in March 2016. The Zone covers 5,856.5030 square
kilometres of which 1,126.64 square kilometres are covered by forests.
Gechi district is bordered on the south by Didessa, on the east by the Jimma Zone, on the north by Bedele
and on the east by the Didessa River which separates the district from the Jimma Zone. The project site is
about 36km far away from the zone capital and 18km from Gechi town. The district is divided in to three

agro-ecological zones; namely, highland (‘Dega’), midland (‘Woinadega’), and lowland (‘kola’) areas
with a proportion of 30.4, 45.7 and 23.9%, respectively.
This woreda was selected by the Ministry of Agriculture and Rural Development in 2004 as one of several
areas for voluntary resettlement for farmers from overpopulated areas. Gechi became the new home for a
total of 17,395 heads of households and 2048 total family members.
Annual precipitation ranges from 1500 to 2200 mm with 6 to 9 months of rainfall and daily temperature of
the district varies from 12 to 35°C. Rainfall variability is an important determinant of rural-farming
population of Gechi practice rain fed agriculture. Coffee production is the dominant farming system in
the district in which the major crops like maize, tef, sorghum, wheat and barley as well as horticultural
crop production is practice.

6. Source of Data
Primary and secondary data are used for the preparation of environmental and social impact assessment
report work for the proposed project. This may include:
Primary data source
 Socio economic and biophysical data collection in the project area
 Observation and Surveys,
 Interviews, and discussion with kebele administration committee and local public consultation
 Interviews, and discussion with Jimma zone EPA office expert (environmentalist)
 Sensors eg. data from camera
Secondary data source
The secondary data obtained from the Literature review:
This involved the review of all literature and data relevant to the project. The literature included legislation,
(constitution, policy, proclamation, Principle and guideline), data kept by the proponent and government
and non-government organization at different level.

7. SCREENING ASSESSMENT
The Screening process involves the determination of whether an ESIA assessment is required for a
particular development activity. The proposed Project was understood to require an ESIA since the
anticipated activities have the potential for both negative and positive impacts on the environment above a
threshold or triggering particular listed activities in the legislation.
The proposed development comprises of the following works
 A review of the policy, legal and administrative framework
 Description of the proposed project.
 Baseline information (Biophysical and Socio-Economic environment)
 Assessment of the potential environmental impacts of the proposed project on the biophysical,
socio-economic and cultural aspects.
 Development of the mitigation measures and future monitoring plans.
 Occupational Health and Safety –OHS
 The project also assesses the impacts of the proposed development on the environment in
accordance with Ethiopia Environmental Impact assessment proclamation no 299/2002
 Identification and evaluation of the potential environmental and social impacts associated with
project implementation and subsequent operation, and

 Preparation of plans and recommendations regarding measures that will minimize adverse
impacts and enhance beneficial impacts.

 Demolition of the existing old structures; Site drainage works including surface water drainage and
connections to existing drainage and Proposed utilities for the Project operation;

The contract agreement has been entered between Planet Consultant & Training service plc and Mustefa
Regasa; establish the terms and conditions in which the firm shall deliver the professional services stated in
the subject heading.

Art. 1 Type of Contract


This Contract is a Professional contract Agreement.

Art. 2 Obligation of the Firm

(1) To conduct Environmental and social impact assessment study for Mustefa Regasa in Buno Bedele
Zone, Gechi district, Cara kebele.

Art. 3 Obligation of the proponent


(1). The Client shall make available relevant documents and useful information requested by the firm.
(2). The Clients shall Pay the agreed service fee as specified under Art.5 of this agreement.

Art. 4 Place of Work

(1) The place of work is in Buno Bedele Zone, Gechi district, cara kebele

Art. 5 Professional fees


(1) The Client hereby agrees to pay the professional fee of Birr 10000.00 Birr including 10% tax.
(2) The amount is payable into two installment effective as of the date of commencing.
(3) The 50% first payment Birr 5000.00 with 10% tax will be paid in advance after the contract is signed.
(4) The remaining 50% Payment Birr 5000 with 10% Tax. Will be settled at the end of the contract.

Art. 6 Tax
Payment is subject to 10% tot tax deduction by from the firm if applicable.

Art.7 Applicable Law

The contract shall be interpreted in accordance with the Ethiopian Law.

Art. 8 Duration and Termination of Contract

(1) This contract is made for a period of 16 days from the contract signed date if all the relevant documents
are delivered on requested time. Otherwise it will extend with both parties agreement
(2) The contract may be terminated when the parties to this contract agree.
(3) Notice of termination shall be in writing.

Art. 9 Amendments

Any amendment and/or supplements to this contract shall be made in writing based on the two parties'
agreement.

Art. 10 Dispute settlements

1. In the event of disputes over the interpretation or implementation of this Agreement, the parties shall, as
far as possible Endeavour to settle it amicably between them.
2. If the dispute cannot be settled amicably, the matter shall be referred to the regular court having
jurisdiction in accordance with the Ethiopian law.
Art. 11 Coming into Force
This agreement will be effective and mutually binding as of the date it is signed and sealed by both parties.
