CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE made and entered into by and between:

1. BENJAMIN MIRANDA III, of legal age, Filipino and with residence


address at 310 G. Tuazon St., Sampaloc, Manila, hereinafter referred to as the
Lessor;
And

2. JACQUELINE S. TIONGSON, of legal age, Filipino and with residence


address at 913-A Basilio St., Sampaloc, Manila, hereinafter referred to as the
Lessee;

WITNESSETH:

WHEREAS, the Lessor is the lawful owner of that certain commercial unit
with floor area, Thirty Square Meter (30 sq. m.) and located at 310 G. Tuazon St.,
Sampaloc, Manila;

WHEREAS, the LESSEE is desirous to lease from the LESSOR said


premises for a period and for the price, and under the terms and conditions
hereinafter provided, and the LESSOR has agreed thereto;

NOW, THEREFORE, for and in consideration of the foregoing premises


and of the mutual premises, covenants and stipulation hereinafter contained, the
parties thereto have agreed and do hereby agree as follows:

1. TERM AND PURPOSE. This lease shall be for a period of one (1)
year, commencing on October 1, 2020, and ending on October 1,
2021, for commercial purposes and including all material described in
the attachment.

RENTAL. The lease of the premises shall be for the amount of Seven
Thousand Five Hundred Pesos (PhP7,500.00) per month.

An advance payment of the monthly rental equivalent to one (1) month


plus a deposit equivalent to two (2) month, shall be paid on the first
day of the lease. The said monthly rental shall be paid by the Lessee
every first day of the month at the residence of the Lessor without
need of any

2. IMPROVEMENTS. Any improvement on the leased premises made by


the Lessee, which cannot be removed without damage to the leased
premises, shall accrue and belong to the exclusive ownership of the
Lessor at the termination of this Contract of Lease.

3. PROHIBITION ON SUBLEASE. The Lessee shall not sublease the


leased premises to anyone without the express consent of the Lessor.
For this purpose, silence on the part of the Lessor shall not in ay way
be construed as any manifestation of such consent or waiver of this
prohibition.

4. PROHIBITION ON TRANSFER OF RIGHT TO LEASE. The Lessee


shall not in any way transfer or otherwise assign his/her right in this
Contract of Lease to any third person.
5. NON-PAYMENT OF RENTAL: Should the Lessee fail to pay the rental
or otherwise be in arrears for a period of one (1) month, the lessor
shall have the right to cause the ejectment of the former.

6. COMPLIANCE WITH LAWS. In addition to the terms and conditions


herein prescribed, the Sub-lessee shall comply with laws, ordinances,
rules and regulations respecting the use and occupancy of the leased
premises and shall hold the Lessor free from any action or claim by
any third person for the Lessee’s non-observance or non-compliance
thereof.

7. EXPENSES FOR UTILITIES. The Lessee shall be responsible for the


use of electrical power, water supply, telephone, cable television, other
telecommunications facilities, Internet access and other forms of
utilities installed at the leased premises. For this purpose, the Lessee
is hereby authorized to furnish a copy of this Contract of Lease to utility
companies as may be required for proper installation of utility
equipments.

8. SURRENDER OF THE LEASED PREMISES. Upon the expiration of


the lease, or the termination or cancellation of the Contract of Lease,
the Lessee shall peacefully surrender the leased premises without any
need for a prior notice or demand from the Lessor.

9. TERMINATION OF THE LEASE CONTRACT. This Contract of Lease


shall be terminated on any of the following grounds:

a) That the Contract has already expired;

b) That the Lessee has violated any of the terms and conditions
prescribed in the Contract;

c) That the parties hereto have entered a mutual agreement for


such termination;

10. VENUE OF ACTION. Any and all legal actions arising out of, or in
connection with, this Contract of lease shall be filed before the
appropriate court of the City of Manila.
