Muhammad Ali Mazhar, J: The petitioner No.1 present in
person, who is also an advocate of this court. The petitioners
have raised the following issues for directions:
“A Writ of Mandamus directing the Respondent (and its
Enrolment Committee) to ensure the strictest compliance of
the Legal Practitioners and Bar Councils Act of 1973 (and
related rules) when admitting persons to its rolls;
A Writ of Prohibition restraining the Respondent (and its
Enrolment Committee) from causing admission of any
person to its roll otherwise than as intended under the
Legal Practitioners and Bar Councils Act of 1973 (and
related rules)”
2. The petitioners have further prayed that no person can be
admitted to the roll of advocates maintained by the Sindh Bar
Council in violation of the procedures as set out by and under
the Legal Practitioners and Bar Councils Act, 1973. Mr. Abdul
Haleem Siddiqui, learned counsel for the Sindh Bar Council is
present with Mr. Muhammad Naeem, Secretary Sindh Bar
Council. He argued that they are already following and
observing the Legal Practitioners and Bar Councils Act, 1973 as
well as Sindh Legal Practitioners and Bar Council Rules, 2017
for the purposes of enrolment of the advocates and he further
assures that all enrolments are made in accordance with the
aforesaid Act and Rules without any relaxation. He further
argued that earlier the NTS was in vogue but now the Higher
Education Commission has introduced LAT and before
enrolment, all candidates have to appear in the Law Aptitude
Test and after that process they may apply for the enrolment
under the Legal Practitioners and Bar Councils Act, 1973 as
well as Sindh Legal Practitioners and Bar Councils Rules, 2017.
The petitioner No.1 is satisfied with this statement, whereas the
petitioner Nos.2 and 3 both are called absent without any
intimation. In view of the statement given by the learned
counsel for Sindh Bar Council, the petition is disposed of
accordingly alongwith pending application.
