SUB: Legal Recall Notice for recovery of entire outstanding amount payable pursuant to the loan agreement
bearing loan account number PYTMPLHE6355115897 (“Loan”) & the product being PERSONAL LOAN.

Dear Sir/Madam,

Under the instructions from and on behalf of our client (HERO FINCORP LIMITED) (through channel
partner Paytm) a non-banking company duly registered with Reserve Bank of India and incorporated under
the provisions of the Companies Act 1956, having its Registered office at 34, Community Centre, Basant
Lok Vasant Vihar New Delhi-110057, we hereby issue to you the present notice which reads as hereunder: -

1. That our client is in the business of finance and is inter-alia engaged in the business of granting loans
and you the above-named addressee had approached our Client through Paytm and requested for
financial assistance by way of grant of a Digital Loan and you had also made a Loan Application to our
client.

2. That you had assured and represented to our client that in case a loan / credit facility was granted to
you, the above-named addressee, then you would timely and punctually repay the same as per the terms
and conditions of the sanctioned loan documents and you had further reassured and represented to our
client that you had the financial capacity/net worth for the grant and repayment of the loan. Based on
your express representation and the documents/information submitted by you the abovenamed
addressee, our client had sanctioned a credit facility for an amount of Rs. 249000/-. For the aforesaid
facility being sanctioned and granted to you, you had executed the loan agreement and other relevant
documents in favour of our client assuring to repay the loan strictly in terms of the sanction & loan
agreement etc.

3. The said loan had been granted to you based on your express representations and assurances that you
would make regular and timely repayments as and when due. Timely payment is the essence of the
contract but despite of repeated reminders and follow-ups, you have not been regular in honouring your
contractual commitments with regards to the repayment as and when they became due and payable. The
payments have not been regularly paid by you and that constitutes an event of default as per the loan
documents. By not adhering to the terms of the repayment, you have rendered yourself liable to pay
overdue interest and other charges, as well.

4. Your representations to the effect that you would make prompt and regular payments, in respect of the
dues pertaining to the said loan, have been proven false and malafide. However, despite repeated
requests and reminders of our client you have failed and neglected to pay the outstanding dues as per
the terms and conditions of the loan documents. It is thus evident from your conduct, that you have
fraudulently induced our client to issue loan facility and you never had the intention of clearing loan
amount availed and utilized by you. Thus, you have rendered yourself liable to be prosecuted for having
committed the offences of cheating and criminal breach of trust, which upon conviction from a court of
law, could lead to imprisonment.

5. It is further stated that, the entire contract between you and our client is vitiated in view of breach of the
terms by you addressee therefore, you addressee is under legal obligation to repay the entire sum along

with interest and other charges (as agreed) that has been wrongly utilized by you all under the above
said loan agreement. Note that if you ignore the present notice and fail to comply aforesaid sum then
our client shall be constrained to initiate legal remedies including but not limited to civil recovery and /
or criminal action which also includes criminal complaint under Section 405/406/415/420/120-B & 34
of the Indian Penal Code, 1860 and other legal remedies available to our client against you solely at
your cost and peril. Our client may consider treating you as wilful defaulter and accordingly request
concerned statutory (Reserve Bank of India) authorities and other credit rating bureaus to add you to the
list of wilful defaulters maintained by them.

6. Under these circumstances our client hereby recalls the entire loan facility by means of the present
notice, you, the above-named addressee, is called upon to pay our client a sum of Rs. 115811/- as on
14.01.2025 in respect of the said loan transaction together with future interest and other charges at the
contractual rate within seven days of the receipt of this notice failing which our client would be
constrained to proceed against you, for the recovery of the said amounts as per the terms of the said
documents and including but not limited to initiation of the arbitration proceedings by making the
reference of the dispute to the Learned Arbitrator, as per the relevant arbitral clause as contained in the
Agreement entered between you and our Client and under the Arbitration and Conciliation Act, 1996
for adjudication of claims and disputes without any further notice to you, holding you liable for all costs
and consequence arising thereof.

retained in our office for future necessary action. Kindly mention the Loan Account No. in all future
