MEMORANDUM OF AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:
This AGREEMENT is made and entered into by and between:
CAROL V. GUIRA, of legal age, Filipino, widowed, and a resident of General Santos City, hereinafter referred to as the
FIRST PARTY;
-and-
CHARLITO OLIVAR SOLONGON SR., of legal age, and a resident of Brgy. KAL-III Isulan, South Cotabato, hereinafter
referred to as the SECOND PARTY;
The FIRST PARTY and the SECOND PARTY are, collectively, hereinafter referred to as the PARTIES.
-WITNESSETH-
WHEREAS, the FIRST PARTY is the rightful owner of a certain parcel of land and all its existing improvements,
specifically described as follows:
“A parcel of land known as Lot No. 529-A part, Cad-153, containing an area of FIVE THOUSAND (5000)
square meters, more or less Sitio Umbo, Brgy. Baranayan, Palimbang Sultan Kudarat ..;”
WHEREAS, the FIRST PARTY offers a portion of the above described property in favor of SECOND PARTY;
NOW, THEREFORE , for and in the consideration of the above-mentioned premises, the parties hereto agree, as they
hereby agree the following terms and conditions, to wit:
1. That the subject property shall not be offered for sale in favor of the SECOND PARTY, but in case the FIRST
Party decides to sell and make improvements, the SECOND PARTY have no rights to intervene;
2. That the FIRST PARTY allows the SECOND PARTY to use all the vacant areas in the above-mentioned property
for parking purposes but not to the extent of the TWO (2) Lots of Hadji Dhol Acob/ Haja Pudjia Acob;
3. That the FIRST PARTY restricted the SECOND PARTY from cutting of coconut trees and fruit-bearing trees
around the subject proprty;
4. That the FIRST PARTY allows the SECOND PARTY to use the bunkhouse and old black house and can be
improved the parts of the house that where devastated by the termites;
5. That the SECOND PARTY shall pay an amount of TWO THOUSAND FIVE HUNDRED PESOS (PHP 2, 500.00)
MONTHLY, for the old black house to commence on January 2022;
6. That the SECOND PARTY shall safe keep and secure the tablons, lumbers and farm equipment in the two-storey
unfinished house of the FIRST PARTY.
7. That the FIRST PARTY allows the SECOND PARTY to put gravel in the low areas of the subject property and
also allowing an installation of comfort room;
8. That the FIRST PARTY allows the SECOND PARTY to use the excess mixture of gravel from the road widening
and use it as a fence for the area to help with its security;
9. That the SECOND PARTY shall pay the electricity and water charges and bills, if there will be any;
10. That the SECOND PARTY shall stay in the subject property for a period of THREE (3) years and this agreement
shall be renewable every year.
11. That incase the SECOND PARTY decides to vacate the subject property before the end of the year, the SECOND
PARTY undertakes to notify the owner a month before leaving the subject property, and all improvements made
by the SECOND PARTY shall remain in the possession of the FIRST PARTY.
