MEMORANDUM OF AGREEMENT

This Memorandum of Agreement (the “Agreement”) is made on February 8, 2025 by and between:

The HTE and the HEI are hereinafter collectively referred to as “Parties” and individually referred to as “Party”.
WITNESSETH THAT:
WHEREAS, in line with its program of attaining academic excellence while enhancing professionalism and
productivity, the HEI incorporates an on-the-job training program (referred to as "Training") into its curriculum, which
is intended to enhance learning and prepare students for careers as competitive and technologically innovative
professionals by giving them real-world exposure to a professional environment;
WHEREAS, the HTE, in furtherance of its socio-economic development programs, agrees to collaborate
with HEI and provide work experience and training to its students in accordance with the guidelines contained in
CHED Memorandum Order No. 104, series of 2017 or the Revised Guidelines for Student Internship Program in the
Philippines (SIPP) for All Programs (“CMO No. 104 s. 2017");
NOW, THEREFORE, for and in consideration of the aforementioned premises and of terms hereinafter
provided, the Parties agree as follows:
Section 1. Subject of the MOA. The implementation of the OJT Program shall be governed by this
Agreement, OJT Policies and Guidelines of T.I.P., T.I.P./IATF/CHED COVID-19 Health Protocols, and the
applicable rules and regulations of the HTE.
Section 2. Duration of the Training. The student's Training shall follow the number of hours prescribed by
the HEI’s curriculum. Unless sooner terminated by the parties in accordance with the terms hereof, this
Agreement shall remain valid and effective.
Section 3. Responsibilities of the Parties: The Parties shall have the following responsibilities guided by
the CMO No. 104 s. 2017:
A. T.I.P. shall:
1. Ensure that before student trainees are endorsed to the HTE, they have passed all of T.I.P.’s
qualifications for eligibility to the Training, and all other requirements specified under CMO No. 104 s.
2017 and other relevant laws or issuances;
2. Endorse student trainee who will undergo the Training, subject to the admission process of the HTE;
3. Designate a Training Coordinator who will:
a. Conduct orientation/training to the student trainee on work environment issues, such as but not
limited to proper work ethics and laws against sexual harassment, as a requirement before
deployment;
b. Coordinate with the HTE regarding the preparation of the Training Plan and other activities related
to the Training under this program to ensure that the student trainee gains practical and
applicable competencies in the necessary learning areas and tasks;
c. Monitor and evaluate the performance of the student trainees periodically to help ensure that they
finish their assigned tasks;
d. Coordinate with the HTE regarding the student trainees' conduct, behavior, and performance;
4. Ensure that for the duration of the Training, all student trainees comply with the applicable rules and
regulations of the HTE and are subject to the disciplinary authority of HEI.
5. Jointly monitor and assess the student trainee’s performance in accordance with the Training Plan with
the HTE’s officially authorized Training Coordinator to ensure that they complete their allotted
assignments;
6. Withdraw, upon notice from the HTE, a student trainee who is discovered to be acting in opposition to
or disregarding the laws, guidelines, and the HTE’s regulations;
7. Provide documents and/or feedback that the HTE may require for the implementation of the training;
8. Take on professional supervision of the student trainees during their training, under this Agreement's
terms, the Training Plan, HEI internal policies and procedures, and relevant laws and releases; and
9. Comply with the monitoring, evaluation, reporting, and other requirements of CMO No. 104 s. 20 17.
B. WILSON Y. SIOCO, fuap WALDEMAR KENDRICK G. SIOCO, uap ARCHITECTS shall:
1. Implement the internship plan in partnership with T.I.P.;
2. Encourage student interns to develop their personality and professionalism, and to the extent possible,
protect them from physical or moral danger;
3. Assign a point/focal person responsible for the implementation of all phases of the internship;
4. Orient the student intern on the standard rules and regulations of their establishment before signing of
contract;
5. Enter into an internship contract/agreement with the student intern;
6. Facilitate the processing of the documents of the student intern in coordination with T.I.P.;
7. Provide practical training or work experience in accordance with agreed internship plan and schedule of
activities;
8. Provide necessary incentives to the student interns as contained in the MOA, such as free duty meals,
travel allowance and uniform, if applicable;
9. Ensure that student interns do not perform tasks and duties of regular position in HTЕs;
10. Provide supervised applied learning experience for student interns in accordance with agreed
Internship Plan and schedule of activities;
11. Develop a feedback mechanism for the student intern;
12. Develop a feedback mechanism for T.I.P. of the overall implementation of the internship and the
student performance;
13. Provide monitoring and evaluation reports or other information on the student intern's performance as
may be required by T.I.P.;
14. Make available, accurate and current records and provide access to T.I.P. of such records while on
internship;
15. Notify and provide written notice to T.I.P. of a student intern's breach of contract or grave offenses in
the internship premises prior to HTE's decision in the termination of the contract;
16. Issue to T.I.P. the following documents within ten (10) to fifteen (15) working days after the completion
of the internship:
● Certificate of completion;
● Duly accomplished evaluation sheet; and
● Other pertinent reports, information, and/or documents which may be included for purposes of
describing student intern performances.
Section 4. General Provisions:
A. Confidentiality
The student trainee shall adhere to the HTE’s confidentiality policies and shall not disclose any
proprietary or confidential information obtained during the Training to any third party without the
prior written consent of the HTE. The student trainee shall be prohibited from bringing materials
belonging to the HTE outside of the HTE’s premises without the prior written consent of the HTE.
The HTE shall designate a person or officer authorized to execute such prior written consent for
these purposes.
For purposes of this Agreement, proprietary or confidential information means any and all
information disclosed by the HTE, or to which the student trainee is otherwise exposed or obtains
access, pursuant to and in connection with the Training.
B. Intellectual Property
Any intellectual property developed by the Interns during the Training as part of their regular duties
or assignments shall be the sole property of the HTE. The student trainee agrees to assign all
rights, title, and interest in such intellectual property to the HTE.
C. Data Privacy
The parties agree that any activity that involves the processing of personal data shall comply with
the Data Privacy Act of 2012 (Republic Act No. 10173), its Implementing Rules and Regulations,
and other applicable laws and administrative issuances. The parties shall perform any or all actions
necessary to facilitate such processing of personal data, including the execution of contracts,
securing of consent, and other similar or related acts.
D. Amendments
Any amendments or modifications to this Agreement must be in writing and signed by both Parties.
The HTE shall not be liable for any accident or injury that the student trainee may suffer during the course of the
Training, provided, however, that the said accident or injury did not arise by reason of the fault or negligence of the
HTE and/or any of its employees, officers, and directors. T.I.P. and the student trainee shall renounce and waive any
claim against the HTE for any loss or injury that the student-trainee may suffer and which arises from the fault or
negligence of the student trainee in performing his/her duties and functions during the Training.
T.I.P. shall likewise not be liable for any damages caused by the fault or negligence of the student trainee during the
course of the Training and/or while under the custody of the HTE.
This agreement shall take effect immediately upon signing and shall continue to be in force and effect until such time
that any one of the parties withdraws from this Agreement upon 30 days prior notice to the other.
