PREAMBLE.

We, the students of Osun State, mindful of the wholesome influence and benefits of the indigenous
student’s association, come to a consensus to constitute ourselves into an association whose
membership shall embrace all state indigenes schooling at Ladoke Akintola University of
Technology, Ogbomosho, both present campuses and the campuses to be formed within, and also
to contribute our quota to the dynamic development, unity, and dignity of our dear state (Osun)
and Nigeria at large.

Therefore, we ordain, enact, and give to ourselves the following constitution.

ARTICLE 1

SECTION 1
NAME, AIMS AND OBJECTIVES, SUPREMACY MEMBERSHIP.
A. Name: - The body shall be known and referred to as the National Association of Osun State
Students (NAOSS) Lautech chapter.

MOTTO: - The motto shall be cooperation, emancipation, and progress.

LOGO: The Logo shall comprise of,


1. Map of Osun State.
2. River Osun.
3. Academic Cap Color: Black, Yellow, Blue, Green, and Red.

B. AIMS AND OBJECTIVES.


1. To represent indigenous students of Osun State at every level of their interest.
2. To promote unity, progress, and understanding among the members of the association.
3. To improve and promote social and cultural activities among the members of the
association.
4. To ensure the educational advancement of Osun State students in general and members of
the association in particular, and to make recommendations when necessary to the
appropriate authorities for solutions.

C. MEMBERSHIP.
This shall be opened to all students of Osun State Origin upon their admission into the Ladoke
Akintola University of Technology.
And such a student must be a registered member through the NAOSS LAUTECH CHAPTER at
his/her indigenous association.

D. SUPREMACY.
1. The provision(s) of this constitution shall be supreme and have binding force on all
members of this association.
2. If any other law, directive, or action is inconsistent with the provisions of this constitution,
this constitution shall prevail, and such law, directive(s), or action(s) shall be, to the extent
of their inconsistency, null and void.
3. Unless otherwise stated or expressly provided elsewhere, the NAOSS National
Headquarters (NHQ) is the apex body of NAOSS chapters in various institutions and
township student associations in Osun State. The provisions of this NAOSS Lautech
Chapter constitution shall also be supreme and have binding force on the bodies here-in
stated.

SECTION 2
A STRUCTURE.
The association’s structure of administration shall consist: -
1. The Congress
2. The Central Executive Council (CEC)
3. The Senate Council (S.C)
4. The Student Judiciary Council (SJC)

SECTION 3
A. CLASS OF MEMBERSHIP.
This provision, in any form, has no alteration to Article 1, section 1, subsection C and the class of
membership includes: -
Regular members: any matriculated and current students of LAUTECH are fully registered with
the “NAOSS LAUTECH Chapter” as members.
1. Use the facilities provided and recognized by the association
2. Wear or display the official colors of the association
3. Participate in recognized meetings and functions of the association.

B. LIFE MEMBERS.
The post of life membership shall be awarded to an external congress member (Patron, Patroness,
Special advisers, Ex-officio) as the association sees fit and duly supported by the congress
members.

C. PRIVILEGES OF LIFE MEMBERS.


1. Such members shall enjoy the same privileges as regular members except that they can
neither vote nor be voted for in any election.
2. Shall give maximum support to all lawful programs of the association consistent with
the provisions of the constitution.

SECTION 4
A. OBLIGATIONS.
A regular member shall:
1. Be a financial member at his/her Indigenous Association
2. Participate in the activities of the association, especially at the level of his/her indigenous
town
3. Abide by the provision of the constitution
4. Avoid any act that can tarnish the image of the association.

B. ANNUAL DUE.
Every member of the association under NAOSS LAUTECH must pay the sum of #500 per
Academic session to register under the association for the running of the association, irrespective
of whether or not the Osun state government pays a bursary.
This Annual due will be implemented as follows:
1. The annual due must be paid by all members of the Naoss Lautech Chapter.
2. The annual due shall serve as the eligibility financial status of any contestants and
electorates from their indigenous chapters, respectively, in the major election and Bye-
Election.

ARTICLE 2

SECTION 5
A. SECRETARIAT
1. A place shall be secured on the main campus of the school (LAUTECH) to serve as the
meeting point of the association.
2. NAOSS Lautech Chapter Congress shall come up at least two times in a month at the
venue, which will be decided by the CEC on the main campus.
3. Seven days ultimatum for normal congress and three days ultimatum for an emergency
congress.

SECTION 6
A. ZONING SYSTEM
1. For the smooth running of the association, it shall be divided into three (3) based on
senatorial districts (Central, East, and West Senatorial)
2. Nominations into the committees and elections into the various offices shall be based on
the zoning system
3. Reference of the Constitution shall be on:
a) Senatorial District.
b) Federal Constituency
c) Local Government

SECTION 7
A. CONGRESS

1. The congress shall be made up of members of the association present, deliberating, voting,
and/or taking decisions affecting the association and its members in pursuance of the aims
and objectives of the association as contained in this constitution.
2. The congress must be called for at least four (4) times in an administrative year
3. The president, in conjunction with the secretary, shall have the power to call for any
congress, unless otherwise stated by this constitution.
4. The congress shall be supreme to any other committee, body, organ, or structure of the
association whether elected or selected.
5. The decision of the Congress shall be final.
6. The President shall have the power to preside over the Congress.
7. In the absence of the President, Vice-President 1 shall preside over the Congress, and in
his absence as well, the next person in the hierarchy should preside.
8. The president, through the General Secretary, shall have the power to call a congress
9. In the event of an abnormal situation of total dissolution of the CEC and SC, the Congress
shall have the power to nominate members of a caretaker committee of not more than 9
members (3 members from each senatorial district), who shall see to the organization of
CEC and SC elections within four weeks of their inauguration.

ARTICLE 3

SECTION 8
THE CENTRAL EXECUTIVE COUNCIL.
The executive power of the association is herein vested in the Central Executive Council, and
subject to the provisions of this constitution, such power(s) may be exercised by them, either
directly or through officers subordinate to them, who shall, have-in after be referred to as the CEC.

SECTION 9
EXTENT OF EXECUTIVE AUTHORITY.
The executive powers of the association shall include the following:
1. Executive
2. Maintenance of this constitution
3. All other matters to which the Senate Council (S.C) and Congress have the power to make
rules and regulations.
4. Subject to the provisions of this constitution, a person shall hold the office of an executive
until:
5. When his/her successor in office takes the oath of office.
6. The CEC shall be responsible for financing the parliament and other committees
inaugurated.

SECTION 10
COMPOSITION OF CENTRAL EXECUTIVE COUNCIL.
The Central executive council shall consist of: -
1. The President

4. The Vice-President III
5. The General Secretary
6. The Assistant General Secretary
7. The Welfare Director
8. The Assistant Welfare Director
9. The Financial Secretary

SECTION 11
THE CENTRAL EXECUTIVE COUNCIL, MEMBERS, AND THEIR FUNCTIONS.

A. THE PRESIDENT.
1. Shall be the head of the association and Chairman of CEC.
2. Shall have caused through the secretary to summon all the meetings of the association.
3. Shall be responsible for harmonizing and coordinating the activities of CEC members.
4. Shall preside over all meetings held under the umbrella of the association except where
there's an elected/nominated chairman or whenever he, the president, delegated his
authority to members of the association by the provision of this constitution.
5. Shall be one of the signatories to the association’s bank account.
6. Shall exercise such powers that are not specifically assigned to any other functionary of
the association or where such power(s), having been assigned to such other functionary,
failed to perform.
7. Shall perform the swearing-in of the members of the various committees and commissions
set-up during his/her tenure after the ratification by the Senate Council (S.C.) except that
of NAOSSIEC.

B. THE VICE PRESIDENT I.


1. Shall deputize the president in his absence and as may be delegated by the president.
2. Shall be the next person in rank to the president in terms of hierarchy.
3. Shall be the number one student of the Senatorial District that he comes from.
4. Shall preside over the NAOSS meeting and activities of his senatorial district wing.
5. Shall carry out any such decision and other functions as may be assigned to him/her by this
constitution.
6. The vice president I must be active, devoted, and responsible for the members of the
association

C. THE VICE PRESIDENT II.


1. Shall be the next person in the hierarchy to Vice-president I and deputize him in his absence
2. Shall be the number one student in his senatorial district.
3. Shall preside over the NAOSS meeting and activities of his Senatorial District.
4. Shall carry out and perform other functions as may be assigned to him by other articles of
this constitution.
5. The vice president II must be active, devoted, and responsible for the members of the
association.

D. THE VICE PRESIDENT III.

1. Shall be the next person in the hierarchy to Vice-president II and deputize him in his
absence.
2. Shall be the number one student in his senatorial district.
3. Shall preside over the NAOSS meeting and activities of his Senatorial District.
4. Shall carry out and perform other functions as may be assigned to him by other articles of
this constitution.
5. The vice president III must be active, devoted, and responsible for the members of the
association.

E. THE GENERAL SECRETARY.


1. Shall be responsible for the general secretariat duties of the association.
2. Shall under the directions of the president, handle all correspondence of the association
(internal and external).
3. Shall compile an annual report of the CEC, which shall be published for internal circulation
after a presentation to the Senate Council (S.C) not later than 2 weeks before the expiration
of the tenure of the CEC members.
4. Shall carry out such other function as may be assigned to him by other articles of this
constitution.
5. Shall take the minutes of the various meetings and read the minutes at the various meetings
(including the congress) of the association.

F. THE ASSISTANT GENERAL SECRETARY.


1. Shall assist the general secretary in all his duties and deputize him/her in his/her absence.
2. Shall carry out any other decision or function as may be assigned to him/her by this
constitution.

G. PUBLIC RELATIONS OFFICERS.


There shall be for the association three Public Relations Officers, and they are P.R.O. I, P.R.O. II,
and P.R.O. III.
FUNCTIONS:
1. Shall be responsible for the publicity of all association activities.
2. Shall be responsible for the public enlightenment of the association.
3. Shall be the chairman, secretary, and PRO of the public relations committee, respectively.
4. Shall carry out any function assigned to them by the constitution and Congress as to the
way of promoting the image of the association through publicity.

H. THE FINANCIAL SECRETARY.


1. Shall be responsible for preparing the financial records of the association and ensuring that
there is proper control of funds of the association.

2. Shall keep a proper account of the association and shall be the custodian of receipts and
other financial documents.
3. Shall carry out all other duties as hereinafter assigned to him under articles of this
constitution.
4. Shall be one of the signatories to the bank account of the association.
5. Shall present the financial report to the Senate Council (S.C) when necessary.

I. THE TREASURER.
1. Shall keep all money and properties of the association.
2. Shall bank all the association money coming from the financial secretary within 3 days of
receipt.
3. Shall write cheques and be one of the signatories to the association’s account(s).
4. Shall keep an imperest account of not more than (#10,000)
5. Shall work in conjunction with the financial secretary in preparing the association account
for auditing.

J. THE WELFARE DIRECTOR.


1. Shall be the chairman of the Welfare Committee.
2. Shall see to the matters affecting the well-being of students.
3. Shall carry out any other function assigned to him/her by this Constitution
4. Shall be responsible for the maintenance of all association business ventures.

K. THE ASSISTANT WELFARE DIRECTOR.


1. Shall assist and deputize the welfare director in his absence.
2. Shall carry out any other function as may be assigned to him by the CEC and as well by
the provisions of this constitution.

L. THE SOCIAL DIRECTOR.


1. Shall be the chairman of the social committee.
2. Shall be responsible for all the social activities of the association.
3. Shall in the discharge of his/her duties, take advice from CEC.
4. Shall perform any other function assigned to him/her by other articles of this constitution.

M. THE SPORTS DIRECTOR.


1. Shall be the chairman of the sports committee.
2. Must be a keen sportsman and shall explore and adopt suitable means for improving the
current standard of member's sporting activities.
3. Shall discharge his duties with the advice of the CEC.

SECTION 12
TENURE OF OFFICE.
1. All offices of the Union shall be held for one (1) academic section.
2. Neither the CEC nor the Senate Council (S.C) shall have the privilege to extend the tenure
upon expiration.

SECTION 13
SENATE COUNCIL (S.C).
There shall be a Senate Council (S.C), where the legislative power of the association is herein
vested.

SECTION 14
SWEARING-IN /INAUGURATION OF SENATE COUNCIL (S.C).
1. The Senate Council (S.C) election and inauguration shall come up a week before the
swearing-in of CEC members
2. Senate Council Election shall be performed by the NAOSSIEC
3. The mode of appointing principal officers of Senate Council shall be through election
immediately after the ratification of a representative of the respective local government by
the NAOSSIEC.
4. Zoning/Rotational formula shall also be critically followed in electing the Senate Council
(S.C) principal officers.
5. Each local government shall provide two (2) representatives to represent their local
government in the Senate Council.

SECTION 15
FUNCTIONS AND POWERS OF THE SENATE COUNCIL (S.C).
1. The Senate Council (S.C) shall be the parliamentary body of the association.
2. Consider proposals, motions, and other matters arising in connection with the provision of
this constitution and shall transmit the recommendation to the appropriate body(s) for
execution through the Central Executive Council of the association.
3. Shall have the power to summon any CEC officer at any time through an invitation letter
about the discharge of his official duties.
4. At the end of the parliamentary year, the Senate Council (S.C) shall make
recommendations to the incoming Senate Council (S.C) on the reports received from the
CEC member and the various committees, whether such reports are satisfactory or not.
The new Senate Council (S.C) shall then act appropriately.
5. The Senate Council (S.C) may bring before its sittings any matter it considers material to
the association and its objectives or interests as defined in this constitution and make
recommendations therein.

6. Shall have the power to summon, suspend, or impeach any officer of the Association CEC
and Senate Council (S.C) members if found guilty of misappropriation or abuse of power
and other acts against the image of the Association by the 2/3 votes at Senate Council (S.C).

SECTION 16
SENATE COUNCIL (S.C) OFFICERS AND THEIR FUNCTION.
A. Officers of the Senate Council shall be:
1. THE SENATE PRESIDENT
2. THE DEPUTY SENATE PRESIDENT
3. THE CLERK
4. THE DEPUTY CLERK
5. THE CHIEF WHIP
6. THE MACE BEARER

B. FUNCTIONS.
A. THE SENATE PRESIDENT.
1. There shall be a senate president who shall be elected by members of the senate council
during its first sitting.
2. Shall be the chairman of all sittings of the Senate Council (S.C).
3. Shall act through the Clerk to summon the sitting of the Senate Council (S.C) in not
less than one week before the proposed date.
4. Shall discharge all other duties that are necessary for the effective performance of
his/her office in accordance with the provisions of the constitution.
5. Shall preside over all the Senate Council (S.C) sittings.
6. Shall perform the swearing-in of the In- house of the various committees and
commissions set-up during his/her tenure after the ratification by the members of the
Senate Council (S.C) and that of NAOSSIEC.
7. Shall be a returning member of the Senate Council unless there is no returning member
vying for the post.
8. The senate president shall call for the sitting of the senate council, or in his absence,
the deputy senate president, or on advice of the president of the association, when
necessary.
9. Not less than half (1/2) of the total members of the senate council shall, after signing a
resolution, mandate the senate president to call for a sitting of the senate council in not
less than 24 hours after the petition has been signed by senate members and served to
the senate president.
10. The senate president shall be the chief interpreter of the constitution. However, such
interpretation shall be reversible by two-thirds majority of the members of the Senate
Council present at the sitting.

11. Where there are in-house elections in the senate council, the Senate President shall not
vote unless there is a tie.

B. THE DEPUTY SENATE PRESIDENT.


1. Shall deputize the Senate President in his/her absence.
2. The DSP shall be a returning member of the Senate Council unless there is no returning
member contesting for the post.
3. Shall recommend the dismissal of any member of the senate council who absents
himself or herself from three (3) consecutive senate sittings without the prior written
permission of the senate president.
4. Where there are in-house elections in the senate council, the DSP shall not vote but
shall be the electoral officer of the senate council.
5. Shall discharge all other duties that are necessary for the effective performance of
his/her office in accordance with the provisions of the constitution.
6. Shall be responsible for certifying the quorum before the commencement of the sitting.

C. THE CLERK.
1. Shall take minutes of the proceedings at all Senate Council (S.C) sittings.
2. Shall on the instruction of the Senate President, cause the circulation of the agenda for
the sitting of the Senate Council (S.C) at least 3 days before the sitting.
3. Shall carry out other functions as may be stipulated by this Constitution.

D. THE DEPUTY CLERK.


1. Shall assist and deputize the clerk in his/her absence.
2. Shall carry out other functions that may be stipulated by the constitution.

E. THE CHIEF WHIP.


1. Shall maintain law and order as stipulated in the code of the house.
2. Shall be the custodian of the house attendance register.
3. If need be, shall seek the indulgence of the Senate President for any disciplinary action
against any offender(s).

F. THE MACE BEARER.


1. Shall be the custodian of the mace.
2. Shall lead the Senate President in and out of the house during the Senate President
procession.
3. Shall carry out other functions as stipulated by this Constitution.

SECTION 17
SITTING OF THE SENATE COUNCIL (S.C).
1. The inaugural sitting of the council shall be held immediately after the swearing-in of
the members and officers of the Senate Council (S.C)
2. There shall be a quorum, which will be taken by deputy senate president and certified
by the two-thirds (2\3) of sworn-in and present senators at the level of the sitting.
3. The Senate Council (S.C) shall meet at least six (6) times in every parliamentary year.
4. The Senate President shall summon all extraordinary sittings of the Senate Council
(S.C) on a written petition duly signed by at least one-third (1/3) of the members of the
Senate Council (S.C).
5. Any Senate Council (S.C) member who fails to attend or withdraws from at least three
(3) consecutive sittings of the house without notifying the Senate President in writing
shall forget his/her seat and be disqualified from being elected into or holding any other
offices in the association against the constitution until the parliamentary year is
finished.

SECTION 18
STANDING ORDER AT THE SENATE COUNCIL (S.C) SITTING.
1. All motions shall have a proposal and be seconded, no discussion shall be allowed on any
motion until it has been properly proposed and seconded.
2. Debate shall be limited to the immediate pending question, that is, the pending question as
stated by the senate president. The Senate President shall rule out of order any Senate
Council (S.C) member failing to adhere to the subject of discussion.
3. The mover and seconder of any substantive motion shall have to accept an amendment,
which if accepted, shall become part of the substantive motion.
4. During a discussion of a motion or an amendment to such a motion, the following order of
proceeding shall be followed: -
a) Motion withdrawing a motion
b) Motion to refer to committee
c) Motion to adjourn
d) Motion to suspend standing order or a portion of a clause of the constitution by
2/3 majority of those present
5. A point of order shall be heard at all times except during voting. It shall deal with the
conduct of the procedure of the sitting and shall concern only such matters as decision,
transgression of the standing order, and calling attention to the introduction of matters not
relevant to the question under discussion.
6. Voting at sitting shall be by showing of hands except where the 2/3 members request for
secret ballots, which shall be carried by the house.
7. In the event of a tie in the balloting, the Senate President shall have the right of cast a vote.

8. The Senate President shall rule in matters on which the constitution is silent and his ruling
shall only be reversed by a two-thirds (2/3) majority of senators present at the sitting.
9. It shall be the right of any member, after the permission of the Senate President to move
the motion of adjournment.
10. When the Senate President speaks, he shall be heard in silence and any other member who
is speaking shall at once sit down. Not more than one member shall hold the floor at a time
and such member shall not be interrupted.
11. Where a member persists in disobeying the point of order, consistently, disobeying the
Senate President, or acts in a manner that is unexpected of that Senate Council (S.C)
member. The house may give any punishment they deem fit.
12. Members of the Senate Council (S.C) have the right to file a motion against the Senate
President when he misuse his power and when such a motion received the blessing of 2/3
majorities of members present at a sitting. They may give any punishment they deem
necessary to the Senate President.
13. Any member(s) of the Union or Galleria may attend the sitting of the Senate Council (S.C)
but only senators shall take an active part in its proceeding. Unless the senate president
grants such members or galleria an opportunity to speak.
14. Shall have the power to appoint an in-house standing committee and ad-hoc committee for
the smooth running of the SENATE COUNCIL (S.C) affairs.

SECTION 19
QUORUM
A. SENATE COUNCIL (S.C).
1. Quorum in the Senate Council (S.C) shall be formed by two-third (2/3) of the entire
membership of the senate council (S.C).
2. If absence notice is received from any member of the Senate Council (S.C) in a sitting, and
the person presiding ascertains that the member present, including the member is still less
than two-third (2/3) of all members of the Senate Council (S.C), he shall then adjourn the
sitting.
3. The decision of the 2/3 majority of senators present shall be the final decision.

B. CONGRESS
Quorum shall be formed when there are in attendance: -
1. Representative from at least 4 local governments from each of the (3) Senatorial Districts.
2.

SECTION 20
COMMITTEES.
There shall be for the effective running of the association, both standing
committee(s) and AD-HOC committee.

STANDING COMMITTEE.
1. There shall be the following committee of the association for the effective implementation
of its policies.
2. On appointment, the name of the committee members and that of NAOSSIEC shall be
approved by the senate council and such name shall be published on the association notice
board and the media.
3. Every standing committee shall be directly responsible to the CEC and senate council aside
from NAOSSIEC that is directly responsible to the senate council.

SECTION 21
STANDING COMMITTEES.
A. SOCIAL COMMITTEES.
1. Shall consist of the elected Director of Social as the chairman and eight other members
from other federal consistencies besides that of Director of Social, recommended by and
they are to be recommended by him to the Central Executive Council for the Consideration
and approval and ratification from the Senate Council (S.C).
2. The Committee shall be responsible for the organization of any social activities
3. At the end of any social function involving the collection of money, proper accounts and
records shall be made and the treasurer shall bank the money collected within Seventy-two
hours (72hours)

B. PRESS COMMITTEE / PUBLIC RELATIONS COMMITTEE.


1. This shall comprise the P.R.O I, P.R.O II & P.R.O III as the chairman, secretary, and
P.R.O. respectively, and six other members (selected from other six federal constituencies
beside that of the P.R.Os.
2. Members of the committee shall be nominated and shall be ratified by the senate council.
3. The Committee shall have an editor-in-chief among its members.
4. It shall serve as the PRESS CREW of the association.
5. The Committee shall also assist the P.R.Os. in the discharge of their duties.

C. BURSARY COMMITTEE.
1. This committee shall have as the chairman, the Welfare Director, and the Assistant Welfare
Director as the secretary, and representatives from each indigenous Union.
2. The committee shall be responsible for planning ways and means of procuring easy ways
for pressing bursary awards and other issues directed to them by the CEC.

D. WELFARE COMMITTEE.
1. Shall be a committee comprising of the welfare Director and Assistant welfare Director as
chairman and secretary with three other members recommended by the welfare Director
and directly approved by the senate council.
2. Shall see to the General welfare of the members of the association (beside that of bursary
Award which is to be properly monitored by the Bursary Committee).
3. Shall be responsible for doing all such other duties that are reasonably incidental to the
welfare of all the members of the association.

E. SPORTS COMMITTEE.
1. This shall be made up of members of the association, including the Director of the Sport
himself as the Chairman.
2. The nomination of the members of this committee shall be recommended by the Sports
Director and approved by the CEC and finally ratified by the senate council.
3. Shall assist the Director of sports in the effective discharge of his duties.

F. ACADEMIC COMMITTEE.
1. Shall be a Committee comprising of the VP I, VP II, and VP III as Chairman, Secretary,
and PRO Respectively, and Other Members from Federal Constituency besides that of the
VPs.
2. Shall see to the Academic Affairs of the Members of the association.

SECTION 22
A. AD-HOC COMMITTEE.
1. An AD-Hoc Committee may be an arm of the association with any specific matter relating
to association functions and may, where necessary provide operating funds, Secretariat
assistance, as may be needed to fulfill the duties of such committee.
2. The Committee shall stand dissolved immediately after it completes its work.
3. The AD-Hoc Committee may be composed of the following: -
a. The Association Officers
b. Other members or members from the senate council
c. Such a committee shall be set up at the Senate Council (S.C).

B. INVESTIGATION COMMITTEE.
There shall be an investigation committee of 5 members that shall investigate, auditing committee
has confirmed that there are no mismanagement/embezzlements in the NAOSS account if it’s true
or not.

C. AUDITING COMMITTEE.
There shall be an auditing committee of five (5) members, which shall be constituted by NAOSS
executives at the congress, one from the executive president’s senatorial district and shall not be
the chairman of the committee, and four (4) others from the two other senatorial districts.

D. THE PUNISHABLE OFFENCE.


1. Abusive words to others during the meeting and after meetings.
2. Mode of dressing.
3. Fighting in the meeting and after the meeting.

PUNISHMENT.
a) Anybody that commits any of the above-mentioned offense (s) shall be suspended for two
(2) meetings and shall pay #500 after completing the punishment.

4. Mismanagement/embezzlement of NAOSS due.

PUNISHMENT.
a) If any executive is found guilty of mismanaging/embezzling NAOSS due, a student from
his/her indigenous town shall not be elected or selected for any post under NAOSS for two
(2) Academic sessions.
b) He/she shall be denied his/her certificate of being once an executive of the NAOSS
LAUTECH CHAPTER.

5. Any NAOSS executive that failed to attend the NAOSS meeting three consecutive times.

PUNISHMENT.
For any NAOSS executive, that failed to attend the NAOSS meeting for three (3) consecutive
times with no solid reason(s), he/she shall be suspended for four (4) weeks and must attend the
meeting during his/her suspension as an ordinary floor member and shall write an apology letter
through the Secretary to the congress after he/she has completed his/her suspension.

ARTICLE 4

SECTION 23
THE NAOSS INDEPENDENT ELECTORAL COMMISSION
(NAOSSIEC)
1. There shall be an electoral constituted at the last sitting which shall hold in the last month
of the administrative year and shall be made up of 9 members in every session, taking into
consideration of the entire federal constituency (9 IN NUMBERS)
2. Among the nine (9) committee members, there shall be Chief Electoral Officer, Secretary,
P. R. O., which shall be from the Senatorial District where the outgoing Executive
President, General Secretary, and P. R. O. 1 come from, and all the three mentioned posts
shall be 300 level and Above students, with two others from their Senatorial District /
Federal Constituency respectively.
3. The swearing of the commission shall be performed by the Senate President, at the floor
of the sitting.
4. Members of the commission shall hold the office throughout the administrative year
(Dispensation) and during the period shall not be eligible to be elected, nominated, or
appointed to serve in any other official capacity.
5. The commission shall not be controlled by any groups or individuals.
6. The electoral commission shall ensure strict compliance with the constitution.
7. The commission shall deposit the remaining funds after its stewardship report with the
senate council to the association account.

SECTION 24
FUNCTIONS OF THE (NAOSSIEC)
1. Shall be charged with the process of conducting all major elections of the association and
shall make results available appropriately.
2. Without prejudice to Article IV Section 23 sub-section 3, the commission (NAOSSIEC)
shall be subjected to the Senate Council.
3. Shall scrutinize; ratify and clear all aspirants contesting for any particular post(s) of the
association.
4. Shall make sure all contestants and electorates are financial members

SECTION 25
ELECTION OBSERVERS.
1. There may be election observers invited by the (NAOSSIEC) to witness the process of
election at least one from each (9) federal constituencies.
2. The observers shall not vote or canvass support for any candidate.
3. In case of any dispute between the electoral commission and any candidate the observers
can then be invited.

SECTION 26
ELECTIONS INTO THE ASSOCIATION OFFICES
1. Election shall be conducted in the association offices of the CEC and Senate Council (S.C).
These are referred to as elected offices or posts and these elections constitute the “Major
elections”
2. The Election into the CEC means an election to choose the officers of the executive council
of the association. However, the available offices are divided and zoned among the three
senatorial districts.
3. The election into leadership of the Senate Council (S.C) means the major election to choose
the leader or officers of the Senate Council (S.C) for that parliamentary year. However, the
available offices are divided and zoned among the three ‘Senatorial districts.
4. The election into the leadership of the Senate Council (S.C) shall be conducted by the
(NAOSSIEC) at the first sitting of the newly constituted members of the Senate Council
(S.C) called to elect their leaders or officers for that parliamentary year.
5. Only the newly constituted Senate Council (S.C) members shall be eligible to vote and
contest the available offices in the leadership election except that of the office of the Senate
President and deputy senate president which only returning members can contest.
6. Nomination shall be by collection of an application form, for a non-refundable fee to be
determined by the electoral committee.
7. The electoral process must be a general election, where all financial Naossite will
participate in the electoral process.

SECTION 27
BYE-ELECTION
1. Bye-election means the election into any vacant office after the initial major elections into
the CEC or by the removal of any of the officers of the association.
2. Bye-election shall be conducted by the electoral commission (NAOSSIEC) the bye-
election.
3. A condition for the bye-election shall be cleared winner if he/she has at least two-thirds
(2/3) of the total vote cast by the Senate Council (S.C) members present and voting at that
meeting.

SECTION 28
ELIGIBILITY OF CANDIDATE
1. Students (pre. Degree) are not eligible in any form to contest nor to be voted for, or to be
nominated.
2. Only 100 level students shall be eligible for the post of Assistant General Secretary, PRO
II, and PRO III.
3. Only Undergraduates can contest or be appointed.

4. Undergraduates in their Final Year, Penultimate year are Eligible to contest for the Office
of the President in an Election.
5. Subsequent to (4) above, students on industrial training shall not be eligible to contest for
the office of president.
6. All aspiring candidates for any office shall satisfy all questions and other requirements
demanded by the electoral commission (NAOSSIEC) before they can be eligible to contest.
7. A person contesting for any post must not be a culprit or an ex-convict.
8. An aspirant for any post must have attended half of the number of congresses held in the
immediate administrative year.
9. An aspirant for any post shall have 75% attendance from his/her hometown or local
government area and shall be confirmed by his/her indigenous president.
10. Any NAOSS executive shall not be elected or nominated as his/her indigenous president.
11. All candidates shall tender an attestation letter, from either his/her indigenous president or
adviser to prove his/her originality.

SECTION 29
CONDUCTION OF ELECTIONS AND LIFTING OF BAN
1. Conduction of election into the various offices (CEC and Senate Council (S.C) office) shall
be by open secret ballot.
2. The electoral process must be a general election, where all financial Naossite will
participate in the electoral process.
3. Each electorate shall have access to only their Lautech student school portal for
Accreditation before voting in the major election or bye-election.
4. Counting of all votes cast shall be done in the presence of all agents of the contestant and
the agents of each contestant must sign the necessary official papers.
5. The chief electoral officer shall immediately after counting all votes of the aspirant
announce the result of the election.
6. Lifting of ban on election campaign shall be announced at the last sitting\congress after the
inauguration of (NAOSSIEC)
7. Major election shall be conducted three (3) weeks after the lifting of the ban on election
campaigns or otherwise be extended for security purposes for not more than one (1) week.
8. All officers duly elected into the CEC shall be sworn into office by the chief electoral
officer not later than a week after the election.
9. Officers elected into Senate Council (S.C) shall be sworn into office Immediately after the
Senate Council leadership election and it is to be done by the Chief electoral officer.

ARTICLE 5

SECTION 30

RESIGNATION, SUSPENSION, OR REMOVAL OF ANY OFFICERS OF THE


ASSOCIATION
1. Any association officer can resign his/her office by writing to the president and the Senate
President through the clerk of the Senate Council (S.C) and would be subjected to the
ratifications of the Senate Council.
2. The president can resign his/her office by writing to the Senate President of the Senate
Council (S.C) with a copy to the clerk of the Senate Council (S.C) within two (2) weeks of
such resignation. The president shall render an account of his stewardship in writing to the
Senate President and submits all association property in his/her custody.
3. Any officer of the association may be removed or suspended following the provision of
this constitution.
4. Before any officer (CEC/Senate Council (S.C) officer) vacates his/her office, whether by
resignation, suspension, or removal, he/she shall properly hand over a correct account
thereof to the appropriate standard Ad-Hoc committee of the Senate Council (S.C).
5. The expiration of the term of office, resignation, suspension, or removal of any officer
(either elected or appointed) of the association shall not have absorbed him or his liabilities
for irregularities committed by him/her when in office.

ARTICLE 6

SECTION 31
AMENDMENT.
1. Amendment of recitation and/or dispersion of any part of this constitution shall upon a
resolution passed by not less than two-thirds (2/3) of the Senate Council (S.C) members in
the sitting present later to the Congress for final endorsement. Any proposed amendment
to this constitution must be sent in writing to the Senate Council (S.C) clerk at least two
weeks before the said meeting of the Senate Council (S.C) and shall forward to every
member of Senate Council (S.C) the statement of such amendment at least a week before
the meeting.
2. The proposed amendment shall be pasted on the association notice board(s) and the
amendment shall come into full effect when approved by a majority of students casting
their votes on the amendment at a referendum held for this propose.

SECTION 32
INTERPRETATION OF THE CONSTITUTION
1. The Senate President, as the case may be, shall have the power to interpret the rules and
provisions of the Constitution and rule on matters on which the Constitution is silent, the
Senate President at the Congress, CEC meeting, and at the Senate Council (S.C) sitting.
2. Such interpretation(s) or rulings, if need be, could be rejected by a two-thirds (2/3) majority
of the senators present at the meeting/sitting.
3. The legal adviser shall be the apex body for the interpretation of the Clause(s) with the
provision of rules of law.

SECTION 33
CERTIFICATE OF MERIT AND AWARD
1. Any officer of the association who is committed to his official duties shall on successful
completion of the tenure of office be awarded a certificate of merit, based on the
recommendation from each arm of the association i.e. (CEC, Senate Council (S.C)) The
certificate of merit shall be duly signed by the President and Senate Council (S.C) Senate
President of the association, the association legal adviser and the grand “patron (if there
is).
2. Any officer found uncommitted or unfaithful to his official duties or removed on grounds
of misconduct shall not be awarded a certificate of merit.
3. The association shall honor some distinguished indigenes of the State for their
contributions to the progress and development of the association provided that the honor
shall not be awarded more than once a year to deserving person(s).
4. The honor shall subject to the approval of the congress, determine what the honor shall
look like.

5. The association shall also, subject to the approval of the congress honor some of its
members for their contribution towards the development of the association.

SECTION 34
THE ASSOCIATION’S PROPERTIES.
1. Unless otherwise stated in this constitution each officer of the association shall keep a
continuous inventory of all association’s properties in his/her care (whether handed over
to him or procured during his tenure)
2. The General Secretary shall obtain and keep copies of all handing over notes concerning
property separately each of which must have been prepared by the members and duly
costing purposes.
3. At the end of the financial secretary's tenure of office, he shall from the old handover notes
and records kept as above present up-to-date property inventory of the association in
respect of each portfolio for the campaign with the new handover notes by the respective
official
4. In the case of any vehicle property (association bus) whether bought from the proceed of
the association due or donated to the association shall be under the era of the association
President.
5. Only licensed drivers appointed officially by the members of the CEC shall have access to
the driving of the association vehicle(s) e.g., bus etc. for Official duties only.
6. In case of landed property (e.g., secretariat/association building complex) whether rented
or donated to or personally erected by the association following Article 2 Section 5 of this
constitution, the central executive council shall take proper care of the association’s
properties within and outside the secretariat complex at the beginning and end of his tenure
of office.
7. A proper handover of the Stock shall be made to the succeeding CEC and copies to the
audit committee.

SECTION 35
SPECIAL PROVISIONS
A. SPONSORING AUTHORITY The government of Osun State shall be sponsoring authority of
this association.

B. PATRONS, PATRONESSES, GRAND PATRON, LEGAL AND SPECIAL ADVISERS.


1. The association shall point’ patron, patronesses, Advisers (legal and special Grand patron
(if necessary) which the appointment shall be a subject of CEC member recommendation
to the Senate Council (S.C) and duly approved with final ratification by Congress.
2. The governor of Osun shall be the life patron of the association.

3. The appointment of PATRON, PATRONESSES, SPECIAL ADVISER, AND GRAND


PATRON is voluntary while that of legal adviser shall” be mandated and the person to be
so appointed as legal adviser must: -
a. Have been called to the Bar for over five years (5 years).
b. Have his law firm been established in Osun State?
4. The number of legal advisers to be appointed shall be at least one but not more than three.

SECTION 36
MISCELLANEOUS INFORMATION.
For a better study, interpretation, and understanding of the frequent part of this constitution, this
important information is provided.
1. All masculine pronouns also include the feminine
2. Major election means election into the CEC and leadership of Senate Council (S.C).
3. The association officers means any members serving the ‘association as a result of being
elected or appointed in one official capacity or the other.
4. Major election shall be by "secret-ballot" which refers to the paper one which the names
of the candidate or contestant are printed in mark to indicate the candidate of his choice.

ARTICLE 7

SECTION 37
RULES OF DEBATE.
a. A member of the Congress or senate council (S.C) shall stand when speaking and shall address
the President or Senate president and the whole of the senate council or Congress.
b. If the President or the Senate President has to raise to assert his authority any member of the
council standing shall immediately resume his seat. Debates must be limited to the immediately
pending question. The President or Senate President shall rule out of order.
c. The Senate president or President may call to order the senate council (S.C) or Congress for
disregarding the authority of the Senate president or President. If after such action, such member
persists in misconducting himself/herself, the Senate President or President may: -
a) Disqualify the member from voting on a specific issue.
b) Order the member to take his/her leave out of the meeting or congress for a specific period.
d. Point of order during meetings shall be as follows: -
A point of order when raised must be heard at all times except during the act of voting and shall
deal with the conduct of the meeting.
Point of an order shall concern such matters as: -
a) Indecorum
b) Introduction of matter not relevant to the question under consideration.
c) Violation of standing order
d) A member of the Congress or senate council (S.C) shall always observe protocol before
he/she speaks in the Congress/senate council (S.C) sitting, including the CEC members
and Senate Council (S.C) officers.
e) Provided that two or more members arise to speak at a time in the Congress, or Senate
Council (S.C) meeting, the President or Senate president has the power to determine to
whom the precedence shall be given.

SECTION 38
LANGUAGE
1. English and Yoruba language shall be the official language of the association. Provided
that English Language has more priority than Yoruba Language. All official business of
the senate council and minutes of the meeting shall be done and written in same.
2. The use of foul, abusive, insulting, and derogatory language by any member of Congress
or other members shall not be entertained on the floor of the house.
3. When foul, abusive, language has been used intentionally or unintentionally, it shall be
withdrawn immediately with an unreserved apology to the affected person(s).
4. The affected person has no right to pardon any – member(s) who has/have used such
abusive language as this insult is partly to him/her and partly to the congress.
5. Where the offender stands on their ground, the final decision shall be taken by Congress.

SECTION 39
ADOPTION OF MINUTES OF MEETING
1. The adoption of the minutes of previous meetings shall be done after obeying the normal
protocol I ..............................................Duly present at the last meeting and in the absence
of no other correction subtraction or addition to the minutes I hereby move, for the adoption
of the minute.
2. The move shall be seconded by another member duly present at the last meeting.
3. The President or Senate President will sign the minute and the attendant list in a book kept
for that purpose.

SECTION 40
FINANCIAL INSTRUCTIONS ON INCOME.
A. FINANCIAL SECRETARY
1. The financial Secretary shall issue a properly authenticated receipt of the association
addressed to the paper in respect of money received either in the form of cash or bank teller
from any source whatsoever.
2. All cheques received must be duly crossed before banking.

B. OTHER ASSOCIATION OFFICIALS


1. Other association officials here shall mean members of the CEC, Senate Council (S.C) who
may from time to time either as members of the association committee or otherwise, come
in contact with the association money.
2. Other association officials shall within seventy-two (72) hours of coming in contact with
the association bank account this case he must obtain a teller which must be presented to
the Financial Secretary within the time limit stipulated.
3. In respect of any revenue-yielding ventures, the responsible officer(s) shall submit detail
of such undertaking(s) to the financial secretary along with the remittance of such money.

SECTION 41
FINANCIAL INSTRUCTION ON EXPENDITURES
1. The impress Account: - The treasurer shall maintain an imperest account of not more than
(10,000.00).
2. Accountability: The financial secretary shall be accountable on all financial matters to the
Senate Council (S.C) through the office of the external auditor, on all expenditures of the
CEC.
3. I.0.U: The financial secretary shall disburse money to a member(s) or the CEC to execute
the completion of an I.O.U form. A statement copy of this is seen in Appendix (b).
4. Auditing: The external auditor shall audit the account of the CEC and all other association
officials twice in each parliamentary year.

The article of this constitution shall become more effective upon approval from the supreme
congress of the Association (NAOSS) Lautech Chapter.
The motion to accept or reject must be raised by a member during the hearing. I

1. The constitution shall be amended with the approval of the Congress or general meeting
after 10 years.
2. It shall be subjected to revision upon a resolution passed by not less than two-thirds (2/3)
of all members present at the meeting.
3. The approval amendment shall come into full effect when approved by the majority of the
members, casting votes on the amendment at a referendum held for that purpose.
