AFFIDAVIT OF BARANGAY CAPTAIN ROLANDO ACEVEDA

I, ROLANDO ACEVEDA, of legal age, Filipino, and a resident of


Barangay Baras, Municipality of Baco, Province of Oriental Mindoro,
after having been duly sworn to in accordance with law, hereby
depose and state, THAT:

1. I am the incumbent Barangay Captain of Barangay Baras,


Municipality of Baco, Oriental Mindoro, and have been serving
in this capacity since year 2003;

2. On or about March 15, 2005, while I was resting at my


residence in Barangay Baras, I observed several police officers
and personnel from the Department of Environment and Natural
Resources (DENR) passing by our area;

3. That I approached the officers and inquired as to where they


were headed, and I was informed that they were on their way to
Barangay Laylay in San Teodoro to conduct surveillance
related to illegal logging activities;

4. After approximately two (2) to three (3) hours, the same team
returned, now accompanied by several individuals who had
been arrested, and who I recognized as members of the Iraya-
Mangyan Indigenous Peoples (IPs) residing in our locality;

5. The police officers informed me that the said individuals were


caught cutting down a dita tree in Barangay Laylay;

6. I personally spoke with the accused individuals and inquired


about the allegations made against them, to which they openly
admitted that they had indeed cut the dita tree;

7. The accused further explained to me that the purpose of cutting


the tree was to use the wood for the construction of a
community toilet for the benefit of the Iraya-Mangyan IP
community;

8. I was, at the time, fully aware of this ongoing community


project, which was intended to improve sanitation conditions in
their area;
9. I also confirm that the dita tree that was cut was located within
the ancestral domain of the Iraya-Mangyan community, and to
my knowledge, was not part of any protected forest or state-
owned land;

10. Based on my personal knowledge as a Barangay Captain


and community leader, the actions of the accused were done in
good faith, in pursuit of a legitimate community development
initiative, and with no intent to violate environmental laws or
regulations;

11. I am executing this affidavit to attest to the truth of the


foregoing facts and to support the defense of the accused
individuals, who are members of the Iraya-Mangyan IPs.
