AGREEMENT

KNOW ALL MEN BY THESE PRESENTS

This Agreement is made and entered into on this ___ day of __________,
2025, by and between:

SHYR ANNE AQUINO NAPERI, of legal age, Filipino citizen, and with
residence address at 346 Road 4 Ext. Pildera 2 Barangay 193, Pasay City, 4 th
District NCR, 1300 , hereinafter referred to as the TRANSFEROR;

and

EMMANUEL RACHO, of legal age, Filipino citizen, and with residence


address at 121 Barangay Sampaloc, Bolinao, Pangasinan, 2406, hereinafter
referred to as the TRANSFEREE;

and

JOHN DAVE PANDINUELA, of legal age, Filipino citizen, and with


residence address at 645 Doña Pilar Subdivision, Barangay San Gregorio, San
Pablo City, Laguna, 4000, hereinafter referred to as the ACCUSED;

WITNESSETH:

WHEREAS, the Transferor is the rightful holder of rights over a


condominium unit located at Studio 2508, Camden Bldg., Camden Place
under developer DMCI Homes.

WHEREAS, the Transferee agrees to accept the full transfer of rights


over the said condominium unit from the Transferor.

WHEREAS, in consideration of the said transfer of rights, the Transferee


agrees to support or file a motion for the closing or dismissal of the legal
case involving John Dave Pandinuela.

WHEREAS, the Accused, John Dave Pandinuela, agrees to be liable for


the expenses or financial obligations related to the exchange or transfer of
rights (TOR) of Shyr Anne Aquino Naperi in favor of Emmanuel Racho.

NOW, THEREFORE, for and in consideration of the foregoing premises,


both parties hereby mutually agree to the following terms and conditions
herein stipulated:

1. Transfer of Rights - Shyr Anne Aquino Naperi hereby voluntarily


and unconditionally transfers, assigns, and conveys all her rights,
interests, and participation in the aforementioned condominium unit
to Emmanuel Racho.

2. Motion for Case Closure - Emmanuel Racho agrees, in


consideration of the foregoing, to support and/or initiate appropriate
legal actions or motions for the closure or dismissal of the case
involving John Dave Pandinuela.

3. Liability of Accused - John Dave Pandinuela acknowledges and


agrees to assume all financial responsibility and payment
obligations relating to the processing and execution of the Transfer
of Rights from Shyr Anne Aquino Naperi to Emmanuel Racho.
4. Effectivity of Transfer of Rights - This Agreement, including the
Transfer of Rights for the aforementioned condominium
property, shall take effect immediately upon signing by all parties.
Upon execution of this Agreement, the Transferor shall no longer
hold any rights or claims over the said property, and full ownership
rights (subject to applicable laws and property registration
requirements) shall be deemed transferred to the Transferee.

5. Miscellaneous - This Agreement shall be binding upon and inure to


the benefit of the parties hereto and their respective heirs, legal
representatives, and assigns.

IN WITNESS WHEREOF, the Parties hereby sign this Agreement in
