Question 1 [40]
You have just obtained your degree and are invited to an interview by a business in the
industrial area of Johannesburg. This business specialises in sealing air vents by
making use of specialised equipment and chemicals. Therefore, employees must
obtain training on the use of the machines and the product, which is a chemical
poisonous to humans and animals when it is applied. As part of this interview you are
required to write a test. Against this background, answer the following questions as set
in this test.
1.1. Discuss the primary objective of the Occupational Health and Safety Act
85 of 1993 (OHSA). (2)
1.2. Discuss the purposes and aims of the committees referred to in the
OHSA. (8)
1.3. Explain the responsibilities of the employer and more specifically those of
the CEO under the OHSA. (20)
1.4. Discuss the duties of employees under the OHSA. (10)

2.1. List the most common trade union objectives. (10)
2.2. Read the following and then answer the question:
“Unions have recognised that in the changing global economy, negotiating
pay, benefits and basic workers’ rights is not enough to sustain or grow a
union. Unions therefore have adopted an experimental approach toward the
following strategies (Van den Heever, 2008): …” (SBS LBR200 Learner

List and briefly explain at least five (5) new strategies used by unions in
negotiating with employers. (10)
Question 3 [40]
There is no duty on the employer to bargain with its employees over disputes of
interest. Due to this fact, employees have the right to strike. However, strikes by
employees cause economic harm not only to themselves, due to the no work no pay
rule, but also to the employer and ultimately to society at large. Therefore, both
employers and employees stand to gain from bargaining and concluding contracts.
Against this background, answer the following questions.
3.1. Explain what a “recognition agreement” is. (10)
3.2. List the types of agreement which can be a result of collective bargaining. (5)
3.3. Explain what “disputes of right” and “disputes of interest” are. (6)
3.4. List the three (3) dispute settlement methods available to employers and
employees. (3)
3.5. List the two (2) main bargaining styles used by employees and employers. (2)
3.6. List the four (4) types of bargaining units or bargaining levels that can be
identified. (4)
