HEREINAFTER CALLED THE ‘ THIRD PARTY’

Which terms and expression of the First party, Second Party and Third
Party shall always mean and include their respective heirs, executors,
administrators, successors-in-interest and assignees etc.

Whereas during the Lifetime of Vundrathi Kommalu S/o Late Sailu


purchased the open plot, to an extent of 200.00 Sq.Yards or 167.22
Sq.Meters ., Out of Survey No. 90/B & 116 of Hanamkonda Village &
Mandal, Hanumakonda District, from its erstwhile owner Ragi Swaroopa
Rani W/o R. Prabhakara Chary , through Regd Sale Deed Vide Doct.No.
9821/2005 of Book-1, Dated 14-11-2005 at R.O. Warangal. Whereas the
aforesaid said Ragi Swaroopa Rani has purchased the plot to an extent of
200.00 Sq.Yards from 1. Kotkoju Satyanarayana S/o Veera Mallaiah 2.
Katkoju Ravinder S/o Veera Mallaiah through a Reg.Sale Deed Vide
Document No. 6864/2003 , Book-I, dated 15-09-2003 at R.O Warangal,
The aforesaid 1. Kotkoju Satyanarayana S/o Veera Mallaiah has purchased
an extent of 100.00 Sq.Yards from Gujjari Jayaprakash S/o Late Veda
Prakash, through Regd Sale Deed Vide Doct.No. 4720/2002 of Book-1,
Dated 20-08-2002 at R.O. Warangal. The aforesaid 2. Katkoju Ravinder
S/o Veera Mallaiah has purchased an extent of 100.00 Sq.Yards from
Gujjari Jayaprakash S/o Late Veda Prakash, through Regd Sale Deed Vide
Document No. 4717/2002 of Book-1, Dated 20-08-2002 at R.O.
Warangal. Its Link Document No. 4071/1981 at R.O Warangal.

Whereas Sri Vundrathi Kommalu died intestate on 08-05-2021 vide


Death Registration No. 2734, dated 03-06-2021 of Warangal Municipal
Corporation. The First and Second Parties are Sons, Third Party is Wife,
and legal heirs to him and they inherited the said open plot property.

The Tahsildar Duggondi Mandal has issued Family Members


Certificate on Application No. FAMC022100873828, Dated 26-07-2021

through Mee Seva Services stating that the parties hereto are the only
Family Members of Late Vundrathi Kommalu.

DETAILS OF THE PROPERTY JOINTLY OWNED & POSSESSED BY


THE PARTITION PARTIES

IMMOVABLE PROPERTY:

Open plot, to an extent of 200.00 Sq. Yards OR 167.22 Sq.Meters,

out of Survey Nos. 90/B & 116 of Hanamkonda Revenue Village and

Mandal, Situated at Yadava Nagar, Hanamkonda, Hanumakonda District,

within the limits of Greater Warangal Municipal Corporation, Revenue

District Hanamkonda, Registration District Warangal and it is in the

jurisdiction of the Joint Sub-Registrar, Warangal (R.O) and it is bounded

by:

EAST : PLOT OF J. PRABHAKAR

WEST : 20’-0” WIDE ROAD

NORTH : H.NO. 3-14-119 OF PREM KUMAR

SOUTH : PLOT OF OTHERS

There is no House or structure in the schedule property.

MOVABLE PROPERTY :

The Joint Family Fund Cash (Movable property) of Rs. 1,00,000/- (Rupees
One Lakh only),which is left over by the Late Vundrathi Kommalu .

NOW THIS INDENTURE OF PARTITION WITNESSETH THAT:

1. The First Party has been inducted into the possession of the ‘A’
Schedule property to have, hold and enjoy the same as absolute owner
thereof with all rights of ownership therein.

2. The Second Party has been inducted into the possession of the ‘B’
Schedule property to have, hold and enjoy the same as absolute owner
thereof with all rights of ownership therein.

3. Movable Property ‘C’ Schedule property Joint family fund cash of Rs.
1,00,000/- (Rupees One Lakh only) handed over to the share of the
Third Party and the same is acknowledged by her.

4. All the coparceners/ co-owners have joined as parties in this Partition


Deed. No coparcener is kept outside this Partition.

5. The Parties shall have right to enter their names recorded as owners
of their respective properties in the Municipal records at their own
costs & expenses. Here onwards the parties shall pay the property
taxes and other taxes of their respective share to the concerned
authorities.

6. The partition deed had been drawn up in (2) sets. Each set bears non
judicial stamp of Rs.100/-. The Partition Party No. 1 and 2 shall have a
set for their personal use.

7. The parties hereby further declare that there are no charges or


mortgages over the aforesaid property and that the same is free from
all encumbrances, court cases and litigations of whatsoever nature.

8. The parties to these presents hereby further admit and declare that
none of them shall have any right or claim of whatsoever nature in
respect of the shares allotted to the other parties to these presents
and that the partition effected through these presents shall be final
and binding between the parties.

9. Each party shall have right to alienate the property over the share of
the property allotted to them.

10. The immovable property under Partition does not belong to


government or its agencies, and it is not mortgaged to government or
its agencies, the same is not an assigned land under A.P. (POT) Act,
9/1977.

The Parties hereto have decided to make partition for the said joint
family properties (movable properties) for their better convenient, for
their individual use, peaceful possession and not to give chances to arise
disputes between them in future.

The parties hereto by mutual consent and as per their choice made
the said open plot into 2 Shares as A & B Schedule properties and allotted
‘A’ Schedule property coloured in RED in the annexed Map to the share
of the FIRST PARTY, ‘B’ Schedule property coloured in GREEN in the
annexed Map is allotted to the Share of the SECOND PARTY.

‘C’ Schedule property (Movable Property) Joint Family Fund Cash of


Rs. 1,00,000 ( Rupees one Lakh only) is allotted to the share of the Third
Party as per her consent.

The Parties hereby declares that there is no structure or construction in


the schedule of property.
The said Plot is not assigned land under A.P. Act,9/77 P.O.T.
The Market Value of the schedule-'A' property is Rs.5,80,000/-
@Rs.5,800/- per sq. yard as under Rule 3 of the A.P.P.O.U.V. Instrument
Act, 1975.

The Parties hereby declares that there is no structure or construction in


the schedule of property.
The said Plot is not assigned land under A.P. Act,9/77 P.O.T.
The Market Value of the schedule-'A' property is Rs.5,80,000/-
@Rs.5,800/- per sq. yard as under Rule 3 of the A.P.P.O.U.V. Instrument
Act, 1975.

‘C’-SCHEDULE (MOVABLE PROPERTY)

C-Schedule property (Movable Property) Joint Family Fund Cash of


Rs. 1,00,000 ( Rupees one Lakh only) is handed over to the Third Party,
and the same is hereby acknowledged by her.

First Party Share (Schedule-A Property) Value of Rs. 5,80,000/-


Second Party Share (Schedule-B Property) Value of Rs. 5,80,000/-
Third First Party Share (Schedule-C Movable Property) Cash Rs. 1,00,000/-

The Value of Half Share is Valued at Rs. 5,80,000/- is exempted from


payment of Stamp duty. Value of separated shares comes to Rs.
5,80,000/-.

DSD Rs.3,400/-, R.F 2,000/-, U/C Rs.500/- Mutation Fees Rs. 6000/-
Haritha Nidhi Rs.50/-, in all Rs.11,950/- remitted at S.B.I., vide ‘E’ Challan
Merchant Order No. 423IMB111023 dated 11-10-2023, the same is
enclosed.

We, declare that if any suppression of facts/deficits noticed at a later


date, We are liable for prosecution apart from payment of deficit stamp
duty and Registration Fee.

The Parties hereto have enclosed a true digital photograph of the


Schedule mentioned property to this Deed.

IN WITNESS WHEREOF THE PARTIES HERETO HAVE SUBSCRIBED THEIR
