MEMBERS

PURPOSE:

The purpose of this General Order is to establish uniform guidelines concerning members under a temporary
or permanent injunction for protection, protection against domestic violence or protection against repeat
violence.

DISCUSSION:

The Federal Violent Crime Control and Law Enforcement Act of 1994 prohibits the shipping, transporting,
receiving, or possessing a firearm or ammunition by any person, including a law enforcement officer subject
to a permanent domestic violence injunction. It further prohibits the member from residing where firearms
are kept.

The Bureau of Alcohol, Tobacco and Firearms has interpreted this law as not prohibiting the possession of
a law enforcement agency issued firearm or ammunition by a law enforcement member while on or off duty
when the member's official duties require possession.

PROCEDURE:

12-03.1 Requirements When Served a Temporary Injunction for Protection

Upon being served with a temporary injunction (ex-parte) and notice of hearing, the member shall:

A. Immediately report service of the injunction to his / her supervisor. If the member's supervisor is not
immediately available, the member shall notify the on-duty Shift Commander.

B. Report service of the injunction to the Administrative Investigation Division by means of a memorandum
via the member's chain of command.

12-03.2 Requirements When Served a Permanent Injunction for Protection

Upon being served with a permanent injunction following a court hearing, the member shall:

A. Immediately report service and supply a copy of the injunction to his / her supervisor. If the member's
supervisor is not immediately available, the member shall notify and supply a copy to the on-duty Shift
Commander.

B. Immediately report service to the Administrative Investigation Division:

1. Directly contact the Division Commander or designee during business hours (0800-1700 Monday
thru Friday excluding holidays). Beyond business hours contact the Division Commander or de-
signee via the on-duty Communications Division supervisor. If the Division Commander or designee

is unavailable, contact the Professional Standards Bureau Commander.

2. Additionally, submit a memorandum via the member's chain of command.

12-03.3 Supervisory Requirements

At the discretion of the Sheriff or his designee, the affected member's supervisor or Shift Commander may
be instructed to:

A. Take possession of the member's agency issued firearms and ammunition until such time said items
can be secured by the Agency Armorer

B. Take possession of the member's agency issued vehicle

C. Assign the member to duty not requiring the carrying of a firearm and / or participation in the Mobile
Response Plan

D. Advise the member he / she is further required to divest himself / herself of all personally owned firearms
and ammunition

12-03.4 Requirements Upon Expiration of an Injunction

When the temporary injunction expires or is recalled by the court without issuance of a permanent injunction
or a permanent injunction expires or is recalled by the court, the member shall:

A. Immediately notify his / her supervisor of the injunction's expiration or recall

B. Report the injunction's expiration or recall to the Administrative Investigation Division by means of a
memorandum, via the member's chain of command
