This Agreement is entered into on this 9th day of December, 2024, by and among:

1. Contractor A: PSMB General Construction – Sho Bernardo("Contractor A"),


2. Contractor B: Contractor engaged by owners Marycel Rhea C. Syto and Ma. Magarita C.
Singson with an office address at [Insert Address] ("Contractor B").
WHEREAS:
1. Contractor A is responsible for specific works on the construction project located at 38B
Madasalin Street, Sikatuna Village, QC
2. Owner shall engage the services of other Contractor B who will perform leak and Pressure
Test for the whole building (collectively referred to as "the Tests") on PMSB Construction’s
work to verify its compliance with project specifications.
3. The Parties wish to outline their responsibilities in the event of a failure in the Tests.
NOW, THEREFORE, the Parties agree as follows:
1. Performance of Tests
1.1 Contractor B shall conduct the Leak Test and PPR Pressure Test for the whole building in
accordance with industry standards and the project requirements.
1.2 Contractor B shall provide the results of the Tests to Contractor A upon completion.
2. Rectification of Failures
2.1 If the Tests indicate a failure in Contractor A's work, Contractor A shall rectify the failure within 7
days of receiving the test results.
2.2 Contractor A shall bear all costs associated with the rectification.
3. Failure to Rectify
3.1 If Contractor A fails to rectify the failure within the stipulated time, Contractor B shall undertake
the necessary rectification work.
3.2 Contractor B shall charge the costs of the rectification and the Tests to Contractor A.
4. Payment Obligations
4.1 Contractor A agrees to reimburse Contractor B for the costs incurred as described in Section 3.2
within 15 days of receiving an invoice.
5. Miscellaneous
5.1 This Agreement constitutes the entire agreement between the Parties concerning the subject matter
hereof and supersedes all prior agreements or understandings.
5.2 Any amendments to this Agreement must be made in writing and signed by both Parties.
5.3 This Agreement shall be governed by the laws of Phlippines.
