(Retd.), formerly I/c Rayapalli Section of Addateegala Range of Kakinada
Division, under Rule 20 of A.P. Civil Services (Classification, Control and Appeal)
Rules, 1991 read with Rule 9 of A.P. Revised Pension Rules, 1980 - Inquiry
Conducted – Imposition of penalty of "Withholding of 5% (five percent) pension
permanently besides recovery of Rs.83,150/- along with interest thereupon
towards loss caused to the Government” against the Charged Officer Sri K. Maria
Das, Forest Section Officer (Retd.) – Orders – Issued.

A.P., Mangalagiri, Letter Ref.No.3514/2016/A&DC-3(ii), dated 13.06.2025.

ORDER:

In the letter 1st read above, the Principal Chief Conservator of Forests &
Head of Forest Force, A.P., Mangalagiri has informed that, the following Article of
Charge was issued to Sri K. Maria Das, Forest Section Officer, formerly I/c
Rayapalli Section of Addateegala Range of Kakinada Division by the Divisional
Forest Officer, Kakinada Division, Kakinada in Rc.No.7332/2016/P2, dated
31.12.2016, under Rule 20 of A.P.C.S. (CC&A) Rules, 1991:

Article:“That he had exhibited gross negligence in duty and done check


measurement in digging of PT in Chavitidibbalu, Burugupalem,
Vangalamadugu and Tungamadugula areas in Rayapalli Section as if
executed manually and charged the expenditure with manual rates,
even though the work was actually executed with machine and
concealed the fact as a result incurring of excess expenditure for
Rs.2,21,736/- by his subordinates ”.

2. The Charged Officer acknowledged the receipt of Article of Charge on


16.01.2017 and submitted his written defense statement, dated ‘Nil’.The Principal
Chief Conservator of Forests & Head of Forest Force, A.P., has appointed the
Chief Conservator of Forests, Visakhapatnam Circle as Common Inquiry Officer
and the Divisional Forest Officer, Flying Squad Division, Rajahmundry as
Presenting Officer in Proc.No.3514/2016/Vig-1(i&ii), dated 15.05.2017
respectively, for conducting the regular inquiry. Subsequently, the Principal Chief
Conservator of Forests & Head of Forest Force, A.P., has appointed the Chief
Conservator of Forests, Rajahmundry Circle as Common Inquiring Authority in
Proc.No.3514/2016/Vig-1, dated 31.10.2017, for conducting the regular inquiry.

3. The Inquiry Officer & Chief Conservator of Forests, Rajahmundry Circle has
completed the inquiry and submitted his findings in Rc.No.29/2017-M8, dated
23.06.2018 wherein, the Inquiry Officer has concluded that the Charge framed
against charged Officer was held proved.

4. The Principal Chief Conservator of Forests & Head of Forest Force, A.P., has
communicated the findings of the Inquiry Officer to the Charged Officer in
Ref.No.3514/2016/A&DC-3(ii), dated 10.11.2020. The Charged Officer has
acknowledged receipt of final notice on 16.12.2020 and submitted his written
representation, dated 12.01.2021 wherein, he did not put-forth any
new/valid/fresh points.

5. The disciplinary proceedings are continued under Rule 9 of A.P.Revised


Pension Rules, 1980, since the Charged Officer has retired from Government
service on attaining the age of superannuation on 30.06.2019.

6. After careful examination of the matter keeping in view the findings of the
Inquiry Officer, Government have taken a provisional decision to impose a
penalty of "Withholding of 5% (five percent) pension permanently besides
recovery of Rs.83,150/- along with interest thereupon towards loss caused to the
Government” against Sri K. Maria Das, Forest Section Officer (Retd.), formerly I/c
Rayapalli Section of Addateegala Range of Kakinada Division, under Rule 9 of A.P.
Revised Pension Rules, 1980. Accordingly, in Govt. Memo., 2nd read above, a
Show-Cause Notice was issued to the retired Charged Officer, for submission of
his representation if any, on the proposed penalty. The Charged Officer has
acknowledged the receipt of Show-cause Notice on 02.12.2024 but did not submit
his written representation.

7. Government after careful examination of the entire matter, have decided to


impose a penalty of "Withholding of 5% (five percent) pension permanently
besides recovery of Rs.83,150/- along with interest thereupon towards loss
caused to the Government” against Sri K. Maria Das, Forest Section Officer
(Retd.), formerly I/c Rayapalli Section of Addateegala Range of Kakinada
Division, under Rule 9 of A.P. Revised Pension Rules, 1980. Accordingly,
Government hereby order to impose a penalty of "Withholding of 5%
(five percent) pension permanently besides recovery of Rs.83,150/- along with
interest thereupon towards loss caused to the Government” against Sri K. Maria
Das, Forest Section Officer (Retd.), formerly I/c Rayapalli Section of Addateegala
Range of Kakinada Division, under Rule 9 of A.P. Revised Pension Rules, 1980.

8. The Principal Chief Conservator of Forests & Head of Forest Force, A.P.,
Mangalagiri shall take necessary further action in the matter, accordingly.
