executing Deed of Mortgage/Memorandum of Deposit
of title deeds dated ____________ besides other loan
security documents for availing Housing loan of
Rs.9000/- (Rupees Nine Thousand Only) upon
such terms and conditions stipulated therein.
2. We hereby state that by an agreement of Lease/Leave
and License dated ____________ entered between us,
the Borrower has given the said mortgaged premise
on lease/licence to MISS. PANCHAMI MUKESH
ADHANGALE (Lessee/Licensee) for a period of 11
month/year on monthly compensation of Rs.9000/-
and security deposit/premium/advance of
Rs.30,000/-.
3. We hereby declare that MR. VIJAY VISHNU
JOGDAND is the owner of the said property which is in
occupation of MISS. PANCHAMI MUKESH
ADHANGALE temporarily as a care taker on behalf of
the said owner and the occupant is having no
independent right, title and interest in the said
property.
4. We hereby agree and undertake to make payments of
monthly lease rent/compensation every month to the
Bank at its Branch office or Administrative Office
mentioned hereinabove, on the due dates payable by
Licensee to Borrower under the Leave & License
/Lease Agreement and in case there is no such
agreement, on or before 10th date of every month, to
appropriate the said amount towards repayment of
interest or further interest and principal or EMI or any
other amount payable by Borrower in connection with
the said loan account or other dues to the Bank.

5. We undertake to draw the cheque of monthly rental
amount in favour of “Abhyudaya Co-op. Bank Ltd.,
Wadala Branch MR. VIJAY VISHNU JOGDAND A/c.
No. 32664 “and send to Wadala Branch.
6. We hereby further undertake that the payment of
lease rents/compensation by the Licensee/Occupier to
the Bank shall continue till the dues of the Bank are
fully paid or the Licensee vacates and hands over
possession of the premises to the Borrower or Bank.
7. We hereby agree and undertake not to modify the
terms and conditions of the said Lease /Leave and
License Agreement without prior written permission of
the Bank.
8. The Borrower hereby undertakes that in case the lease
rent/compensation is not paid by the Licensee, as
agreed hereinabove, and even if paid and the same is
not sufficient to fully liquidate the agreed installment
of repayment and interest, the Borrower shall make
the payment of the balance or full installments (EMI),
as the case may be with interest and other costs and
dues payable by him/her/it.
9. We further undertake to pay all rates, taxes, cesses,
fees, revenue, duties, charges, assessment with
penalty, if any, as and when demanded by the
concerned authority and also maintenance and other
outgoings in respect of said mortgaged premises and
shall observe and perform all rules and regulations
pertaining to the same and will not do or omit to do or
suffer to be done, anything, whereby the mortgage
security as created in favour of Bank, be affected or
prejudiced in any manner whatsoever.
10. We further declare and undertake that we have not
done and we will not do any act of omission or
commission, which would deteriorate the value of said
premise or which would amount to sale, transfer,
mortgage or in any way encumbering the right, title or
interest, into and in respect of
mortgaged property.
11. We hereby undertake to permit inspection of the said
mortgaged premise whenever the Bank demands for
the same and make every possible provision and
facilitate and co-operate the Bank officials without
raising any objection for the same.

12. It is declared and undertaken by the parties herein
that the mortgage of the premises shall continue till
the entire dues of the Bank are paid and discharged
and the mortgage is released and “No Dues”
certificate is issued by the Bank in writing.
13. We specifically hereby declare and undertake
unconditionally, to handover vacant and peaceful
possession of the said mortgaged property/premises
to the Bank or its Nominee/s as desired by the Bank, in
case of enforcing the mortgage on account of the
default in repayment or for violation of any of the
terms of loan/limit granted by the Bank to the
Borrower.
