Reply filed on behalf of CBI to application U/s 207
Cr. P.C. moved on behalf of (A-7) M/s OPG Securities Pvt. Ltd.
wherein there is mention of one list of unrelied documents. It is
submitted by Ld. Counsel for A-7 that earlier also one list of
unrelied documents was filed and IO was directed to file
consolidated list of unrelied documents. IO submits that he will
do the needful on NDOH.
Out of several issues, there is one issue about digital
evidence and IO was supposed to file detailed reply but IO has
not filed any detailed reply. IO has stated that he has not filed
detailed reply because in the application moved on behalf of
accused, there is no mention of any specific file which was not
opening. To counter this submission of IO, ld. Counsel for A-4
has pointed out towards his application dated 15.02.2024 wherein
he had pointed out towards several files which he is unable to
open which falsify the claim of IO. Perusal of record reveals that
matter is lingering on for the same purpose and several dates
have been taken by IO to comply with the order of the court.
Perusal of record reveals that repeatedly vague replies have been
filed and needful has not been done by the IO.
On being questioned as to why he has made false
submission, IO has come up with several explanations. One of
the explanation he has made is that he gave solution to the
accused persons to provide their hard disk which was supplied by
CBI and CBI would get the file open and supply the same to the
accused persons.
At this stage IO submits that he would file detailed
reply and would co-operate with Ld. Counsels for accused
persons himself and if Ld. counsels do not respond to him, he
would send them mail in this regard.
Be put up for filing of detailed reply by IO on
22.03.2025. Long date is given at request of IO as he submits
that it will take time to prepare detailed reply.

Present application has been moved on behalf of A-6 Vikas Goenka seeking
release of his passport.

1 By way of present application, A-6 Vikas Goenka is seeking


release of his passport for submission as part of verification process during
renewal of passport No. U8858836 of his daughter namely Ms. Aanya
Goenka which is going to expire on 29.01.2025. It is submitted that
applicant’s daughter has successfully received admission in foreign
universities in USA. It is further submitted that applicant’s daughter had
applied for renewal of her passport with the office of Passport Seva Kendra,
Bengaluru. It is stated that the passport authorities have informed daughter of
the applicant that passport of applicant is required in order to renew the
passport of his daughter. Copy of the relevant documents are annexed with
the application as Annexure-A/1 & A/2. It is further submitted that bail was
granted to the applicant vide order dated 01.09.2023 and passport of the
applicant was surrendered before the court in compliance of bail order.

2 Reply filed on behalf of CBI. It is stated by Ld. PP that
applicant has not submitted any document to support his claim that his
daughter has successfully received admission in various foreign universities.

3 It is submitted by Ld. Counsel for applicant that passport


authorities do examine and compare the original with the photocopy of the
passport.

4 Considering the submissions made by Ld. Counsel for


applicant, it is ordered that passport of the applicant be released to him for a
period of one month so as to enable the applicant to renew the passport of his
daughter. Accused is further directed to furnish security in the form of
FDR/bank guarantee for a sum of Rs. 5 Lakhs (Five Lakhs only).

5 In view of the aforesaid facts and circumstances, the application


is allowed. The applicant is directed to surrender his passport in court
immediately after renewal of passport of his daughter.

6 Copy of this order be given dasti to the accused/applicant and to

by IO. Copy supplied. It is submitted by Ld. Counsel that only
yesterday IO supplied the digital evidence and the files are
running into lakhs in number and they need time to access the
same. IO has submitted that he could not do the needful earlier as
he was deputed in some other matter and due to that he could not
comply with the direction of court in time. The digital evidence
has been supplied to A-2, A-4, A-6 & A-7. Remaining accused
persons except A-5 have not approached the IO. Today they have
not raised any objection. It seems that they have no objection or
issue regarding digital evidence. Ld. Counsel for A-5 prayed that
he would require 2 – 3 days time to provide hard disk to IO.

It is submitted by Ld. Counsel for A-3 that one


e-mail was sent on behalf of A-3 mentioning to the IO that they
are not able to access the hard disk as it is password protected. It
is stated by IO that e-mail was received on 03.05.2025 i.e. one
day prior to court hearing and that too at 10.00 PM. It is stated by
IO that belated mail has been sent just to delay the matter. It is
further stated that hard disk was supplied to accused on
22.03.2025. The factum of A-3 sending e-mail at fag end just one
day prior to court hearing shows the conduct of A-3. No other
counsel has submitted that they are not able to access the hard
disk.
On last date of hearing, Ld. Counsel for A-5 had
stated that he require 2 - 3 days time to provide hard disk to the
IO but same has not been provided till date. Now Ld. Proxy
counsel Ms. Afsha Moin submits that hard disk would be
provided to the IO within 7 days. No reason has been assigned as
to why hard disk was not provided within 2 – 3 days to the IO
when sufficient time had been granted to A-5 to do the needful.
Although there is no reason as to why time be extended for this
purpose again. In the interest of justice, one more opportunity is
granted to A-5 to provide hard disk to IO in three days failing
which the right of A-5 will be closed.
Ld. Counsel for A-7 submits that in reply filed by the
CBI, it is stated that digital devices seized from A-1 Chitra
Ramkrishna and A-2 Anand Subaramanian were sent to CFSL and
subsequently sent to NFSU and it was further submitted that
digital evidence is in the process of extraction. It is stated that
said evidence has not been supplied to any of the accused till
date. IO submits that report has not been received and the same is
yet to be supplied to the accused persons.
IO has submitted that permission may be granted to
him to inspect the record/documents filed in court which have
been identified as illegible by the defence counsels so that he can
again photocopy or re-scan the same and provide copies of such
documents to the Ld. Counsels.
