Subject: Request for Immediate Removal of Obscene Private Videos from


Social Media and Legal Action Against Unauthorized Digital Dissemination

Respected Sir/Madam,

I, Shubham Gupta, a citizen of Mainpuri State of Uttar Pradesh, India, I am writing this
letter to bring to your kind notice an extremely serious and sensitive matter involving a
grave breach of privacy and unauthorized dissemination of obscene digital content
relating to me and my female friend.

On 30th May 2025, my wife, with malicious intent, unlawfully accessed my personal
mobile phone and extracted private and objectionable videos involving me and my
female friend. These materials, without our consent, have been circulated across
multiple social media platforms such as Facebook, WhatsApp, Instagram, and
Telegram, leading to irreparable damage to our privacy, dignity, and mental well-
being.

Consequently, my friend filed a First Information Report (FIR No. 370/25) under
Sections 203(2), 351(2) of the Bharatiya Nyaya Sanhita (BNS) and Section
66E of the Information Technology Act, 2000. The case is currently under judicial
consideration before the Hon’ble Chief Judicial Magistrate, Mainpuri.

Despite the ongoing case, the objectionable content continues to circulate online,
further violating our constitutional right to privacy under Article 21 and creating
immense social and psychological distress.
This act constitutes violations of:- Article 21 of the Constitution of India – Right to Life
and Personal Liberty (including Right to Privacy)
- Sections 43, 66E, 67, and 67A of the IT Act, 2000
- Sections 203(2) and 351(2) of the BNS, 2023
- Duties of intermediaries under Section 79 IT Act and Intermediary Guidelines, 2021
Hence, I humbly request that you kindly:

1. Issue takedown notices under relevant laws to immediately remove all such
objectionable content from all digital platforms.
2. Instruct all relevant intermediaries (Meta, Google, Telegram, Instagram etc.) to
remove the content and preserve all related digital logs, IP addresses, upload times,
and device metadata.
3. Initiate a digital forensic investigation to trace the origin and medium of the upload.
4. Take strict criminal action against the individual(s) responsible for this unauthorized
dissemination.
5. Provide necessary safeguards and digital monitoring to prevent further spread of
such content.
