Article 5 “all persons are equal before & under the law, should be
equally protected, equally benefits from the law by prohibiting
discrimination on the basis of disability & all other grounds for
discrimination. To promote equality and prevent discrimination,
& provided reasonable accommodation
 
Article 19 “the State have obligation to take effective &
appropriate measures to facilitate full inclusion & participation
of all persons with disabilities by making the facilities & services
for the general population available and responsive to the needs
of persons with disabilities. To prevent isolation and segregation,
persons with disabilities should have access to wide range of
community support services including personal assistance
necessary to support living and inclusion in the community.”
UNCRPD
Article 11 “States Parties shall take all necessary measures
to ensure the protection and safety of persons with
disabilities in situations of risk, including situations of (…)
humanitarian emergencies and the occurrence of natural
disasters.”

Sendai Framework for Disaster Risk Reduction
Guiding principle (d):
Disaster risk reduction requires an all-of-society
engagement & partnership. It also requires
empowerment and inclusive, accessible and non-
discriminatory participation, paying special attention
to people disproportionately affected by disasters,
especially the poorest. A gender, age, disability and
cultural perspective should be integrated in all
policies and practices, and women and youth
leadership should be promoted.

Priority three: Investing in disaster risk reduction for resilience

c) Investing in DRR also includes applying Universal Design Principles to ensure


resilience of vulnerable persons from disasters when they try to access service
providers’ infrastructures
k) People with life threatening and chronic disease, due to their particular needs,
should be included in the design of policies and plans to manage their risks before,
during and after disasters, including having access to life-saving services
l) Encourage the adoption of policies and programmes addressing disaster-induced
human mobility to strengthen the resilience of affected people and that of host
communities as per national laws and circumstances.

Magna Carta for Disabled Persons (Republic Act 7277)
(1992)

An act providing for the rehabilitation, self-development


and self-reliance of persons with disabilities and their
integration into the mainstream of society and for other
purposes.
RA 9442 : An Act Amending Republic Act No. 7277,
Otherwise Known As The "Magna Carta For Disabled
Persons, And For Other Purposes”
(for the Provision of Medical and Related Discounts and Special Privileges)

Sec: 4 the title of RA 7277 is hereby amended to read as the “Magna Carta for Person
with Disability”, and all references on the law to “disable person” shall likewise is
amended to read as “person with disabilities”

Sec. 40 no individual, group or community shall execute any of these acts of ridicule
against person with disability in any time and place which could intimidate or result in
loss of self-esteem of the latter

Proclamation 688 enjoined all departments, agencies and instrumentalities of the national
government and local government units (LGUs) to implement plans, programs and activities
geared towards the development of persons with disabilities in accordance with the Incheon
Strategy.

Risk Reduction and Management Act of 2010
Section 2: Declaration of Policy
(n) Develop and strengthen the capacities of vulnerable and marginalized groups to
mitigate, prepare for, respond to, and recover from the effects of disasters

Section 3: Definition of Terms


“Vulnerable and Marginalized Groups” – those that face higher exposure to disaster
risk and poverty including but not limited to women, children, elderly, differently-
abled people and ethnic minorities
The Free Mobile Disaster Alerts Act
(Republic Act 10639)
In the event of an impending tropical storm, typhoon, tsunami, or other calamities,
mobile phone service providers are mandated to send out alerts at regular intervals as
required by the l (NDRRMC), (PAGASA), (PHIVOLCS) and other relevant agencies. The
alerts shall consist of up-to-date information from the relevant agencies, and shall be
sent directly to the mobile phone subscribers located near and within the affected
areas. The alerts shall include contact information of local government units and other
agencies required to respond to the situation. The alerts may contain other relevant
information such as, but not limited to, evacuation areas, relief sites and pick-up
points. These alerts shall be at no cost, whether direct or indirect, to the consumers;
and shall be included as part of the service providers auxiliary service. The alerts may
be in the form of SMS (text messages), MMS, or email, as needed and appropriate.
Children in Emergencies Bill (House Bill 5285)
Sec. 2. Declaration of Policy

It is the policy of the state to protect the fundamental rights of children during
disaster, calamity, and other emergency situations when children are gravely
threatened or endangered by circumstances that will affect their survival and
normal development. Towards this end, the State shall establish and implement a
comprehensive and strategic program of action to provide the children affected by
a disaster, calamity & other emergency situations with utmost support & assistance
necessary for their immediate recovery & protection against all forms of neglect,
abuse, exploitation & other acts prejudicial to their interest & well-being.
Enhancing the Inclusiveness of the Philippine
Disaster Risk Reduction and Management System
Act of 2016 (House Bill 6183)
An Act incorporating internationally accepted principles of DRM including the
Sendai Framework for DRR. The adoption and implementation of a coherent,
comprehensive, integrated efficient and responsive DRR program incorporated in
the development that is formulated in a participatory and inclusive manner and is
funded adequately at various levels of government giving priority to local
government units that are highly vulnerable, geographically isolated and belonging
to the poorest of the poor.
