PROFESSIONAL CONDUCT
AND
ETHICAL STANDARDS
-This course deals with the Professional Conduct
and Ethical Standards of Professionals, and as
Criminologists in the practice of their profession
and field of specialization;
Governing Ethical codes both in Government and
Private sectors and their relevance to Human
Relations.
ETHICS
*Is a moral judgement, Philosophical study of morality
ETHICS IS WHAT MAKES US HUMAN”
* derived from the Greek word, ethos- which means
characteristics way of acting / ethikos- customary.

TWO DIVISIONS OF ETHICS

GENERAL- the study of general principles of morality

SPECIFIC- application of general principles of morality to


certain profession or calling.
HUMAN ACTS
*any sort of activities performed by human beings.

ELEMENTS OF HUMAN ACTS

KNOWINGLY- when the persons understand what he is


doing and has the capability to appreciate the
consequences of his actions.
DELIBERATELY- when the person did his action
intentionally.
FREELY- the persons performs his act voluntarily.
CLASSIFICATION OF HUMAN ACTS

* ELICITED ACTS- human acts that are complete and begin


in the human itself.
It is a well act began and completed in the will without
bodily movement.

* COMMANDED ACTS- done in relation to the dictates of


reason and begin in the will but are perfected by other
faculties under the control of will.
PROFESSIONAL ETHICS
*set of moral code to which every profession must
subscribe

POLICE ETHICS
* a practical science that treats the principles of human
morality and duty as applied to law enforcement
VALUES
*anything that a persons considers important or
significant in life either tangible or intangible .
Latin word- “valere” – to be strong or to be worth

KINDS OF VALUES
*BIOLOGICAL VALUES - those are necessary for survival,
such as food, shelter, water, clothing, sleep and sex.
– include the physiological need of man as a man
*PSYCHOLOGICAL VALUES- those are necessary for
emotional fulfillment of man, such as relationship,
companionship, family, friendship, love.

*INTELLECTUAL VALUES- necessary for intellectual


fulfillment of man, such as achievement, career, success

*MORAL VALUES- those that are necessary for the


spiritual fulfillment of man
VIRTUE

-a habit that inclines to act in a way that harmonizes


with his nature
- the habit of doing good
- the opposite is vice, the habit of doing bad

1.PRUDENCE
- ability to govern and discipline oneself by means of reason and
sound judgement
- the virtues that attract the intellect to choose the most
effective means for accomplishing what is morally good and
avoiding what is evil

-the virtue that regulates the carnal appetite for sensual
pleasure

Is an oath legally binding?

an oath but is usually taken to avoid the
religious implications of an oath; it is thus

PRIMARY RESPONSIBILITY OF REGISTERED
CRIMINILOGIST

-The primary responsibility of every person admitted to


the practice of criminologist is to bear faithful allegiance
to the Republic of the Philippines and be loyal to his
profession. They shall accept as a sacred obligation and
responsibility as citizens to support the Constitutions of
the Philippines and as registered Criminologist to defend
the principles of liberty as defined in the Constitution
and Laws.
-As a Registered Criminologist, they shall strive
to improve their effectiveness by diligent study
and sincere attention to improvement and to
welcome the opportunity to disseminate practical
and useful information relating to matters
accruing to the benefit of public safety and
welfare.
LIMITATION OF AUTHORITY
-criminologist is a upholder of the law is to know its
bounds upon him, be aware of limitations and
prescriptions and recognize the system of gov’t that
gives to no man group or institution absolute power. He
must ensure that he is prime defender of that system
and as must never pervert its character.
-they shall in the performance of their duty be just,
impartial and reasonable, never according anyone more
preferential treatment that one another. They shall
recognize the limitation of their authority and no time
use the power of their profession for personal advantage.
PRIVATE CONDUCT

-THE REGISRETERED CRIMINOLOGIST MUST BE MINDFULL OF


HIS SPECIAL IDENTIFICATION BY THE PUBLIC AS AN UPHOLDER
OF THE LAW.
-NEVER BE LAX IN CONDUCT OR MANNER IN PRIVATE LIFE,
EXPRESS DISRESPECT FOR THE LAW, NOR SEEK TO GAIN
SPECIAL PRIVILEGE THAT WOULD BE REFLECTIVE UPON THE
PROFESSION.
-HE MUST CONDUCT HIS PRIVATE LIFE THAT THE PUBLIC WILL
REGARD HIM AS EXAMPLE OF STABILITY FEDELITY AND
MORALITY.
CONDUCT TOWARDS THE PUBLIC
-THAT DIGNITY,FAIRNESS AND A GENUINE WILLINGNESS TO HELP
ARE ESSENTIAL TO THEIR PUBLIC IMAGE AND THEIR ABILITY TO
DO A GOOD JOB

-THEIR RESPONSIBILITY TO THE WHOLE COMMUNITY IS TO DEAL


WITH THE INDIVIDUALS IN A MANNER CALCULATED TO INSTILL

ATTITUDE TOWARDS PROFESSION
-The criminologists shall strive to make the best application of
science to the solution of crime, by diligent study and sincere
attention to self improvement.
-He shall appreciate the importance and responsibility of his
profession as an honorable one rendering valuable service to
community and country.
-He shall avoid outside influence from overzealous and over
anxious clients and his findings shall be based solely and entirely
on logical scientific deduction derived from fair and impartial
examination personally performed by him.
-He must never loose sight the important fact he should not only
work for identification, apprehension of criminals, but must be
strive with greater if not equal vigor to clear innocent.
ATTITUDES TOWARDS FELLOW CRIMINOLOGISTS
-The criminologists shall strive constantly to improve
professionals standing of criminology through
association with others in the profession and keeping
abreast with fast moving world of science and
technology through constant research and
development.

-HE SHALL COOPERATE WITH FELLOW CRIMINOLOGISTS AND


PUBLIC OFFICIALS TO THE END THAT THE SAFETY OF GENERAL
WELFARE OF THE PUBLIC WILL BE ASSURED ,NEVER PERMITTING
JEALOUSIES OR PERSONAL DIFFERENCES TO INFLUENCE THEIR
PROFESSIONAL DUTIES AND OBLIGATIONS.
THE LAW ENFORCEMENT CODE OF ETHICS

AS A LAW ENFORCEMENT OFFICER, MY FUNDAMENTALS DUTY IS TO SERVE MANKIND;


TO SAFEGUARD LIFE AND PROPERTY; TO PROTECT THE INNOCENT AGAINST
DECEPTION; THE WEAK AGAINST OPPRESION OR INTIMIDATION; AND THE PEACEFUL
AGAINST VIOLENCE OR DISORDER AND TO RESPECT THE CONSTITUTIONAL RIGHTS
OF ALL MEN ,TO LIBERTY,EQUALITY AND JUSTICE.

I WILL KEEP MY PRIVATE LIFE UNSULLIED AS AN EXAMPLE TO ALL; MAINTAIN

OATH OF PUBLIC OFFICERS and EMPLOYEES,
and Code of CONDUCT and ETHICAL STANDARDS
among GOV’T OFFICIALS AND EMPLOYEES
All public officers and employees to gov’t including every
member of the armed forces shall, before entering upon the
discharge of his duties, take an oath or affirmation to uphold
and defend the Constitution, that he will be true faith and
allegiance to it; obey the laws legal orders and decrees
promulgated by the duly constituted authorities; we well and
faithfully discharge to the best of his ability to the duties of
the office or position upon which he is about to enter and
that he voluntarily assumes the obligation imposed by his
oath office w/o mental reservation or purpose of evasion.

Copies of the oath shall be deposited with civil service


commission and national archives.
REPUBLIC ACT NO. 6713 FEBRUARY20 1989
-an act establishing a code of conduct and ethical standards
for public officials and employees.
Section 1; Title
-this act shall be known as the code of conduct and ethical
standards for public officials and employees
Section 2; Declaration Policies
-it is the policy of state to promote a high standard of ethics
in public service. Public officials and employees shall at all
times be accountable to the people and shall discharge their
duties with utmost responsibility, integrity, competence, and
loyalty, act with patriotism and justice, lead modest lives,
and uphold public interest over personal interest.
(a).Government
includes the National Gov’t, the local gov’ts and all
other instrumentalities, agencies or branches of the
Republic of the Philippines including the gov’t owned or
controlled corporations, and their subsidiaries.
(b).Public Official
includes elective and appointive officials and
employees, permanent, or temporary, wether in the
career or non-career service, including military and
police personnel, wether or not they receive
compensation, regardless of amount .
(c).Gift
>refers to a thing or a right to dispose of gratuitously, or any
act or liberality, in favor of another who accepts it, and shall
include a simulated sale or an ostensibly onerous disposition
thereof. It shall not include an unsolicited gift of nominal or
insignificant value not given anticipation of, or in exchange for,
a favor from public official or employee.
(d).Receiving any gifts
>includes the act of accepting directly or indirectly, a gift
from a person other than that a member of his family or
relative as defined in this act, even on the occasion of a family
celebration or national festivity like x-mass, if the value of the
gift is neither nominal nor significant, or the gift is given in the
anticipation of, or exchange for a favor.
(e).Loan
covers both simple loan and commodatum as well as
guarantees, or accommodations intended to ensure its
approval.
(f).Substantial stockholder
means any person who owns, directly or indirectly, shares
of stock sufficient to elect a director of a corporation. This
term shall also apply to the parties to a voting trust.
(g).Family of public officials or employees
means their spouses and unmarried children under 18
years of age.
(h).Person
includes natural and juridical persons unless the
context indicates otherwise.

(i).Conflict of interest
arises when a public official or employee is
member of the board, an officer, or substantial
stockholder of a private corporation or owner or has
substantial interest in a business, and the interest of
such corporation or business, or his rights or duties
therein, may be opposed to or affected by the
faithful performance of official duty.
(j).Divestment
is the transfer of title or disposal of interest in
property by voluntarily, completely and actually
depriving or dispossessing oneself of hi right or title to
it in favor of a persons other than his spouse and
relatives as defined in this act.

(k).Relatives
refers to any and all persons related to public
official or employee within the fourth civil degree of
consanguinity or affinity, including bilas, inso and
balae.
NORMS OF CONDUCT OF PUBLIC OFFICIALS
AND EMPLOYEES
A. Commitment to public interest
all public officials and employees shall always uphold the public
interest over and above personal interest. All gov’t resources and
powers of their representative offices must be employed and used
efficiently, effectively, honestly and economically particularly to
avoid wastage in public funds revenues.
B. Professionalism
all public officials and employees shall perform and discharge
their duties with the highest degree of excellence,
professionalism, intelligence and skills. They shall enter public
service with utmost devotion and dedication to duty. They shall
endeavor to discourage wrong perceptions of their roles as
dispensers of their roles or peddlers of undue patronage
C. Justness and Sincerity
public officials and employees shall remain true to the
people at all times. They must act with justness and
sincerity and shall not discriminate against anyone,
especially the poor and the underprivilege. They shall at all
times respect the rights of others, and shall remain from
doing acts contrary to law, good morals, good customs,
public policy, public order, public safety, and public
interest. They shall not dispense or extend undue favors on
account of their office to their relatives wether
consanguinity or affinity except with respect to
appointments of such relatives to positions considered
strictly confidential or as members of their personal staff
whose term are coterminous with theirs .
D. Political neutrality
public officials and employees shall provide service to
everyone without unfair discrimination and regardless
of party affiliation or preference.

E. Nationalism and Patriotism


all public officials and employees shall at all times be
loyal the Republic and to the Filipino people, promote
the use of locally produced goods, resources, and
technology and encourage appreciation and pride of
country and people. They endeavor to maintain defend
Philippine sovereignty against foreign intrusion
F. Responsiveness to the public
public officials and employees shall extend prompt,
courteous, and adequate service to the public. Unless
otherwise provided by law or when required by the public
interest, public officials and employees shall provide
information of their policies and procedures in clear and
understandable language, ensure openness information,
public consultation and hearings whenever appropriate,
encourage suggestions, simplify, and systematize policy,
rules ang procedures, avoid red tape and develop an
understanding and appreciation of the socio-economic
conditions prevailing in the country, especially, in the
depressed rural and urban areas.
G. Commitment to democracy
public officials and employees shall commit themselves
to the democratic way of life, values, maintain the
principle of public accountability, and manifest by deeds
the supremacy of civilian authority over military. They
shall at all times uphold the Constitution and put loyalty
to country above loyalty to persons or party.
H. Simple living
public officials and employees and their families shall
lead modest lives appropriate to their positions and
income. They shall not indulge in extravagant or
ostentatious display of wealth in any form.
Duties of Public officials and employees
A. Act promptly on letters and request
all public officials and employees shall, within fifteen (15)
working days from receipt thereof, respond to the letters,
telegrams or other means of communications sent by the
public . The reply must contain the action taken on the
request.

B. Submit annual performance reports


all heads or other responsible officers of offices and
agencies of the gov’t and of gov’t-owned or controlled
corporations shall within forty five(45) working days from the
end of the year, render a performance report of the agency or
office or corporation concerned . Shall such report shall be
opened and available to the public within regular office hour.
C. Process documents and papers expeditiously

All officials papers and documents must be processed


and completed within reasonable time from the
preparation thereof and must contain, as far as
practicable, not more than three(3) signatories there in.
In the absence of duly authorized signatories, the
official next-in-rank or officer in charge shall sign for
and in their behalf.
D. Act immediately on the public’s personal
transactions

all public officials and employees must attend to


anyone who wants to avail himself of the services of
their offices must, at all times, act promptly and
expeditiously.

E. Make documents accessible to the public


all documents must be accessible to, and readily
available for inspection by, the public within reasonable
working hours.
System of Incentives and Reward
-a system of annual incentives and rewards is hereby
established in order to motivate and inspire public
servants to uphold the highest standards of ethics. For
this purpose, a committee on awards to outstanding
public officials and employees is hereby created
composed of the ff;
* Ombudsman
* Chairman of the Civil Service Commission as Co-
Chairman
* Chairman of the Commission on Audit
* and two gov’t employees appointed by the President
Prohibited act and transactions
in addition to acts and omission of public officials
and employees now prescribed in constitution and
existing laws, the following shall constitute prohibited
acts and transactions of any public official and employee
are hereby declared unlawful;

A. Outside employment and other activities related


thereto- Public officials and employees during their
incumbency shall not;
(1.) Own, control, manage, or accept employment as
officer, employee, consultant, counsel, agent, broker,
trustee or nominee in any private enterprise regulated,
supervised, or licensed by their office unless expressly
allowed by law;
(2.) Engage in the private practice of their profession
unless authorized by the Constitution or law, provided,
that such practice will not conflict or tend to conflict with
their official transactions;
(3.) Recommended any person to any position in a private
enterprise which has a regular or pending regular
transaction with their office;
(B.)Disclosure and/ or misuse confidential
information
-public officials and employees shall not use or
divulge, confidential or classified information officially
known to them by reason of their office and not made
available to public; to further their private interests or
give undue advantage to anyone ; or to prejudice the
public interest.
(C.) SOLICITATION OR ACCEPTANCE OF GIFT
-public officials and employees shall not solicit or accept,
directly or indirectly, any gift, gratuity, favor, entertainment,
loan or anything of monetary value from any person in the
course of their official duties or in connection with any
operation being regulated by, by or any transaction which any be
affected by the functions of their office.

>As to gifts or grant from foreign govt’s the Congress consent to;
* The acceptance and retention by a public official or employee
of a gift of nominal value tendered and received as a souvenir or
mark of courtesy;
* The acceptance by a public officials or employee of a
gift in the nature of a scholarship or fellowship grant or
medical treatment;

* The acceptance by a public official or employee of


travel grants or expenses for travel taking place
entirely outside the Philippines ex; transportation,
food, and lodging ) of more than nominal value if such
acceptance is appropriate or consistent with the
interests of the Philippines and permitted by the head
of office, branch or agency to which he belongs.
* The ombudsman shall prescribed such regulations as may be
necessary to carry out the purpose of this subsection, including
pertinent reporting and disclosure requirements.
* Nothing in this act shall be construed to restrict or prohibit any
educational, scientific, cultural exchange programs subject to
national security requirements.

>STATEMENT AND DISCLOSURE


public officials and employees have an obligation to accomplish
and submit declarations under oath of, and the public has the
right to know, their assets, liabilities, net worth and financial and
business interests including those of their spouses and of
unmarried children under 18 years of age living in their
households.
A. Statements of Assets and Liabilities and
Financial disclosure

-all public officials and employees, except those who


serve in an honorary capacity, laborers and casual or
temporary workers, shall file under oath their
statements of assets, liabilities and net wort and a
disclosure of business interest and financial connections
and those of their spouses and unmarried children
under 18 years of age living in their households.
The two documents shall contain information on the ff;
A. real property, its improvements, acquisition costs,
assessed value and current fair market value.
B. personal property and acquisition cost
C. all other assets such as investment, cash on hand or in
banks, stocks, bonds, and the like;
D. liabilities
E. all business interests and financial connections;

The documents must be filed;


> within 30 days after assumption of office;
>on or before April 30, of every year thereafter
>within 30 days after separation from the service.
>All public officials and employees required under this
section to file the afore stated shall also execute, within 30
days from the date of their assumption of office, the
necessary authority in favor of the Ombudsman to obtain
from all appropriate gov’t agencies, including the Bureau of
Internal Revenue, such documents as may show their
assets, liabilities, net worth, and also their business
interests and financial connections in previous years,
including, if possible, the year when they first assumed any
office in the gov’t.

> Husband and wife who are both public officials or


employees may file the required statements jointly or
separately.
Statements of assets, liabilities, and net worth and the
disclosure of business interests and financial connections
shall be filed;

1. Constitutional and national elective officials, with the national office


of the ombudsman;
2. Senators and Congressman, with the secretaries of the senate and
the house of representatives, respectively; justices; with the clerk of
court of the supreme court; judges, with the court administrator, and
all national executives officials with office of the President;
3. Regional and local officials and employees, with the Deputy
Ombudsman in their respective region;
4. Officers of the armed forces of the Philippines from the rank
of colonel or naval captain, with the office of the President,
and those said below ranks, with the Deputy Ombudsman in
their respective regions;
5. All other public officials and employees, defined in Republic

B. Identification and disclosure of relatives


it shall be the duty of every public official or employee
to identify and disclose, to the best of his knowledge and
information, his relatives in the gov’t in the form , manner
and frequency prescribed by the civil service commission .
C. Accessibility of document
1. any and all statements filed in this act shall be made
available for inspection at reasonable hours;
2. such statement shall be made available for copying or
reproduction after 10 working days from the time they are
filed as required by law.
3. any person requesting a copy of a statement shall be
required to pay a reasonable fee to cover a cost of
reproduction of mailing of such statement, as well as the cost
of certification.
4. any statement filed under this act shall be available to
the public for the period of 10 years after receipt of the
statement. After such period the statement maybe destroyed
unless needed in an ongoing investigation.
D. Prohibited acts
it shall be unlawful for any person to obtain or use any
statement filed under this act for;
* any purpose contrary to morals or public policy;
* any commercial purpose other than by news and
communication media for dissemination to the general public;

DIVESTMENT
a public official and employee shall avoid conflicts of interest
at all times. When a conflict of interest arises, he shall resign
from his position in any private business enterprise within (30)
days from his assumption of office or divest himself of his
shareholdings or interest within (60) days from such
assumption.
Review and compliance procedure
A.) designated committees of both houses of the congress
shall establish procedures for review of statements to
determine whether said statements which have submitted on
time, are complete, and are in proper form. In the event the
determination is made that a statement is not so filed, the
appropriate committee shall so inform reporting individual and
direct him to take the necessary corrective action.
B.) In order to carry out their responsibilities under this act,
the designated committees of both houses of congress shall
have the power within their respective jurisdictions, to render
any opinion interpreting this act, subject in each instance to
the approval by affirmative both of the majority of particular
house concerned.

PLAGIARISM

CHEATING
Is attempting to present another one’s own, work that one has

* sharing of unauthorized information regarding specific content
of examinations is not allowed, nor is the used of books, notes or
other material without the instructor’s permission.
* the discussion of any aspect of the examination before all
students have completed.
* student may not speak or other wise communicate with one
another in English or any other language or manner during
examination.
* a student may not submit work she has not done herself. This
includes papers, projects, homework, assignments, etc;
* submission of the same paper or assignment, or material
portions thereof, for more than one course is not allowed,
except by both instructor’s approval and in accordance with
criteria established by each them.
* the falsification of research data.
* preventing students or faculty access to course material. This
includes mutilating or disabling computer equipment or data
bases.
* using electronic devices such as cellphone or calculators to
store information or materials that are not authorized by the
instructor.

-have the right to be treated fairly, impartially and promptly in matters
related to academic ethics.
-if a students disagrees with faculty members action under the academic
ethics policy, and is unable to arrive at a satisfactory resolution in
discussions with that faculty member, she has the right to request in
writing a hearing before the academic ethics council
-student must sign a statement during registration indicating that they
have read, understand and will abide the by the academic ethics policy
- students have the responsibility to notify an instructor of any knowledge
of suspected academic dishonesty.

-handshake is the formal cultural-norm on the united states for


professional business engagement and handshake is often done
when greeting someone and when closing out a meeting or
departing
-make strong eye contact and offer a greeting before and during
the handshake.
- your handshake should be firm, but not crushing. Don’t offer
up a sweaty floppy hand. No one wants to shake a fish hand.
-when you shake your hands you want them to align, web-to-
web, and shake firmly for one or two shakes.
Your online presence
*don’t ruin your professional image by posting something online
that can be misinterpreted. In the digital age of growing social
media platforms, you need to consider how your comments,
post, and information could be perceived.
A professional contact doesn’t need to see a photo of what you
had for lunch or know what political candidate you despise.
*set your social network privacy settings to private. However
assume everything you put online could be viewed(or hacked)
your grandmother, least favorite person and future employer.
We don’t know too many computer hacking grannies, but you
get the point. Remove anything you wouldn’t want that
audience to see.
*Don’t try to make professional connections on the wrong
social network. In the work place, LINKEDIN is solid
professional social platform to connect with clients, colleagues,
supervisor and contacts. Trust us, your boss doesn’t want to
be tweeted or receive snaps. When in doubt, don’t tweet it
out!
*Google your self.

Lunch meetings/ interview

> sometimes meetings or interviews will take place over a


meal, and there are a few things you can do to ensure it goes
well. When in doubt, follow the lead of the host.
> Once seated, immediately put your napkin in your lap.
> if there are multiple forks and spoon options at your place
setting, just start from the outside working in towards at plate for
each course.
>drinkware is on the right, bread and salad plates to your left
> order manageable food item-avoid items that are messy, difficult
to eat, or could leave you with food in your teeth such as salad or
spaghetti.
> don’t order the most expensive item on the menu.
> do not order alcohol on an interview. Don’t order seconds on

=alcohol maybe served at a company function or perhaps


a dinner interview. Use caution when consuming alcohol
with colleagues, clients, and supervisors.

manager, it is preferable to order something other than
alcohol. It is acceptable to decline alcohol. If you do order
alcohol, stick to beer or wine and only one drink.

- is a vital to maintaining professional communication. Note that
email provides an easy opportunity for information to be
misinterpreted so choose your words carefully. It is also
important to return emails in a reasonable timeframe, sitting on
an email for weeks is unprofessional.

-RSVP is a French word term commonly used to solicit a
response to note if you will attend the function or not; it means
‘please respond’. When you are asked to rvsp for something it is
expected that you will reply. If you accept an invitation it is
your professional responsibility to see the commitment through.
Dress for the situation

how you dress for a professional situation like an


interview, networking event, or a day in the office varies
by organization, situation, industry, and cultural. When in
doubt, its better to opt for a more professional look.
Human relations

-is an important part to our career success. It is defined


as relations with or between people, particularly in a
work place setting. Because a company depends on good
human relations through its organizational structure,
developing these skills important.
Why is human relations is important?

-Human relations aims to ensure that your employees are


happy and productive- not latter- as possible. Human
resources somewhat disregards interpersonal interactions
treats your employees primarily as resources.
What is good human relations?

Good human relations practices such as understanding


needs and expectations of employees, providing
comfortable work conditions, resolving conflicts between
management as well as coworker creates satisfied and
motivated employees. It results in improvement in their
