Consumer
• Consumer means any person who buys any goods for a consideration which has
been paid or promised or partly paid or under any system of deffered payment and
includes any user of such goods older than the person who buys such goods for
the consideration

state of Jammu and kashmir
• This act shall apply to all goods and
services the parliament passed the
consumer protection bill 2019 in 6
August 2019 to replace the

• The right to be protected against the marketing of goods products or services
which are hazardous to life and property
• The right to be informed about the quality , quantity,potency ,purity , standard and
price of goods or services as the case may be so as to protect the consumer
against unfair trade practices

message ,verbal statement, demonstration,depiction of the name ,

 PRODUCT LIABILITY 👉 means the responsibility of a
product manufacturers or product seller of any product or
service to compensate for any harm caused to a consumer

 UNFAIR TRADE PRACTICES 👉 means a trade practice
which for the purpose promoting tha sale ,use of supply of
any goods or the provision of any service adopts any unfair
method
 Falsely represent that the services are of a particular
stand quality or grade

 👉 the objects of the Central council shall be to render
advice on promotion and protection of the consumers right
under this
 The objects of every district shall be to render advice on
promotion and protection rights under this act within the
district
 A central consumer protection authority to be known as the authority to regulate
matters relating to violations of right of consumer unfair trade practices and false
or misleading advertisement
 The central authority shall have an investigation wing headed by a director
general for the purpose of conducting inquiry under this act as may be directed by
the central authority
 Protect, promote and enforce the rights of
consumers as a class and prevent violations of
customer rights under this act
 Prevent unfair trade practices
 Ensure that no false advertisement is made of
any goods or services
 Ensure that no person takes part in the
publication of any advertisement which is false
 The central authority may after receiving any information or complaints or cause
to be conducted a preliminary inquiry as to whether there exists facie case of
violation of consumer rights or any false or misleading advertisement by any
person which is prejudicial
 Where the central authority is satisfaction the basis of investigation it may pass
such order as may be necessary
 Recalling of goods or withdrawal of services which are dangerous hazardous
 Reimbursement of the prices of goods or services so recalled to purchases of such
goods and services
 Discontinuation of practices which are unfair and prejudicial to consumer interest
 Provided that the central authority shall give the person an opportunity of being
heard before passing an order under this section
 A person aggrieved
by any order passed
by the central
authority under
section 20 and 21
may file an appeal
to the national
commission within a
period as thirty days
from the date of
receipt of such order
