  Scope In June2004 Section 175 of the Education Act 2002 came into force. This requires Further Education Colleges to make arrangements to ensure that that their functions are carried out with a view to safeguarding and promoting the welfare of children attending College. In addition, we must have regard to any guidance issued by the Secretary of State in considering what arrangements we need to make for that purpose of the section. The Children Act 1989 defines a child as any person under the age of 18 years . This includes all 14–16 year old school children attending college as a supplement to their Key Stage 4 curriculum.

  By the endof the session you will be able to: Understand what is meant by safeguarding and promoting the welfare of children and the different ways in which children and young people can be harmed. Be aware of the statutory duty to safeguard and promote the welfare of children in accordance with the Children Act 2004. Know how to access a copy of the college’s policy and procedure. Identify your responsibilities in protecting children in your role as a College employee and follow the College’s procedure in relation to child protection Know the boundaries of personal competence and responsibility, when to involve others and where to seek advice and support.   Organisational ResponsibilitiesAll organisations that provide services or work with children and young people must: Be clear about people's responsibilities to safeguard and promote children's and young people's welfare Make sure staff get training that helps them do their job well Have rules about how to help children and young people be safe and well; and how to act when there are concerns about a child's or young person's safety or welfare Allow staff to report things they are unhappy or worried about, without being punished for speaking out.

  Who does thePolicy protect? Students aged under 18 years and students aged under 21 years with learning difficulties and/or disabilities If a student aged over 21 or above has been identified as a “vulnerable adult” reference should be made to the College’s Safeguarding Adults Policy and Procedure

  Recognising abuse andneglect In order to ensure the safety of children it is important to be able to recognise the signs of abuse and neglect. Some possible indicators include signs that the student:- Shows sudden changes in behaviour or school performance. Has not received help for physical or medical problems brought to the parents' attention. Has learning problems (or difficulty concentrating) that cannot be attributed to specific physical or psychological causes. Is always watchful, as though preparing for something bad to happen. Lacks adult supervision. Is overly compliant, passive, or withdrawn. Comes to college or other activities early, stays late, and does not want to go home.

  Definition Child Abuse can involve any one or more of the following: Neglect – the persistent or severe neglect of a child, or failure to protect a child from exposure to any kind of danger, including cold or starvation, or extreme failure to carry out important aspects of care, resulting in the significant impairment of the child’s health or development. Physical injury – actual or likely injury to a child, or failure to prevent physical injury (or suffering) to a child including deliberate poisoning, suffocation.

  Definition Child Abuse can involve any one or more of the following: Sexual abuse – actual or likely sexual exploitation of a child or young person including prostitution. Emotional abuse – actual or likely significant adverse effect on the emotional ill treatment or rejection Significant harm – where the child is suffering, or likely to suffer significant harm. Bullying – the act of intimidating a child or weaker individual in a physical, verbal or non-verbal manner

  Policy Statement It is important that children are protected from abuse. Newcastle College recognises that employees and students have a role to play in safeguarding the welfare of children and preventing their abuse. All complaints, allegations or suspicions will be taken seriously and discussed with the College’s designated member of staff before any steps are taken. Where action is necessary, this will be undertaken with due regard to the College’s Child Protection Procedures.

  Procedure – Pointsto consider Promises of Confidentiality should not be given as the matter may develop in such a way that these cannot be honoured. Inform the student that there is a legal duty to inform an authorised agency. The arrangements for this should be negotiated with the student. If the complainant is the student him/herself, questions should be kept to the minimum necessary to understand what is being alleged and leading questions should be avoided. Care must be taken in asking or interpreting responses to questions about indications of abuse as this could have an effect on the evidence which is put forward if there are subsequent legal proceedings. No-one in the College should investigate – your role is to record the information only.

  What to dowhen a student is under 18 Student informs you they are being abused Take a full record of the allegation but do not investigate Contact the member of staff with responsibility for child protection in your school within 2 hours Is the member of staff with responsibility for child protection in your school available? Contact alternative staff member A referral form is provided in DTC for the recording of this information. Additionally, a list of the information to collect is included later on in this unit.   If a studentis aged 21 or over and is identified as a “vulnerable adult” then consult the College’s policy on Safeguarding Adults Policy and Procedure There is no need to report abuse unless there is a risk to others under 18 Our role is simply one of support The student may wish to involve the Police Student may require directing to a counselling agency Contact Student Services and seek advice What to do when a student is over 18 Available from DTC in College Policies section

  Do not approachthe student direct Discuss concerns with School’s designated member of staff with responsibility for child protection Abuse suspected but not disclosed A list of staff with responsibility is provided later on in this unit

  All staff appointmentsare made subject to Enhanced Criminal Records Bureau and List 99 checks – Until results are through no staff member should be working with students under 18 years of age without supervision Suspicions, allegations or actual abuse must be reported to the member of staff responsible for child protection in the school within 2 hours of the initial concern arising Allegations about Staff A list of staff with responsibility is provided later on in this unit

  The information youneed to collect in connection with reported abuse includes:- The date The time The place where the alleged abuse happened Your name and the names of other present The name of the complainant and, where different, the name of the child who has allegedly been abused The nature of the alleged abuse/bullying incident A description of any injuries observed The account which has been given of the allegation Record of information Standard forms for recording this information are available from the person for responsibility for child protection in each school. Alternatively, a written account of the above will be acceptable
