INTRODUCTION
In our society disabled persons has been always treated as
inferior and worthless, but today due to their increasing population
they may be kept in a specific community. Some people in society
and some other professional who are involved in providing
education , training and rehabilitation had felt that, if they were
provided with some type of help and opportunities, they might
have become self dependent. In this order, the person with
disability act 1995,has been passed which gives direction for
making various useful scheme for providing education and training
and occupation to the disabled.
A disabled welfare department in every district has
been established which, by regulating the scheme at the gross
root level is trying to uplift the condition of the disabled person.The
Central as well as the State Govt. has launched several scheme
to educate and trained the disabled person.
Schemes
IDENTITY-CARDS
For Tamil Nadu– District Social Welfare Officers
Concerned & Child Development Project Officers
IDENTITY CARD IS ISSUED ONLY TO A
PERSON CERTIFIED TO HAVE 40% OR MORE
DISABILITY BY THE MEDICAL BOARD
EDUCATIONAL SCHEMES
• 3% seats are reserved for children with disabilities for
admission in all Educational Institutes.
• Students with Disability reading up to class VIII receive
scholarships from Social Welfare Directorate from the Social
Welfare Officers in their respected districts.
• Students from class IX and above receive scholarships from
Mass Education Extension Deptt.
• Persons with Loco motor disability in lower limb, having
minimum 40% and not exceeding 60% disability, are
permissible to be admitted into MBBS Course.
• Children with disabilities are provided with special and
Integrated School facilities. Students with disabilities are
provided with book grant,uniform and other assistance under
IEDC scheme of Sarva Siksha Abhiyan.
EMPLOYMENT SCHEMES
(i) Persons with physical disabilities outside Tamilnadu may
register their names in Regional Employment
Exchange/District Employment Exchange. Mobile
registration facilities are being provided by Directorate of
Employment to accommodate Adult Disabled Persons
receiving vocational training in various NGOs.
(ii) Vacancies not less than 3% are reserved for the Persons
with Disabilities - 1% each for persons suffering from
(a) Low vision/Blindness (b) hearing impairment
(c) Locomotor disability / Cerebral Palsy.
(iii) 12th, 42nd & 72nd posts in 100 point Roster have been
kept reserved by the State Govt. for facilitating
employment to Persons with Disabilities.
AGE RELAXTATION IN EMPLOYMENT & OTHER
FACILITIES
1. Disable persons are entitled to age concession up to 45 years at the time
of entry into the Govt. services.
2. Disable persons applied for Group ‘C’ & ‘D’ (non-gazetted) posts of Govt.
of India advertised by SSC & UPSC are entitled for exemption from the
payment of examination and application fees.
Exemption of examination fee is applicable for PSC also.
3. No establishment shall dispense with or reduce in rank, an employee who
acquires a disability during his service. If found unsuitable for the existing
post he may be shifted. To some other post with same pay scale and
service benefits. In case no such post is available he may be kept on
supernumerary post until a suitable post is available or he attains the age
of superannuation.
4. No promotion shall be denied on the ground of his disability.
5. State Govt. Employees with Locomotor/visual disabilities are entitled to
conveyance allowance to the tune of 5% of the basic pay subject to a
maximum Rs. 200/-p.m.
POSTING & TRANSFER
A Govt. employee having a child with mental retardation is
sympathetically considered for his posting at a place of
his/her choice, where the special services are available for
their child.
This provision holds for both State & Central Govt.
institutions
ECONOMIC ASSISTANCE
(1) Disabled persons are entitled to support for self-employment
under Swarna Jayanti Gram Swarozgar Yojana (SGSY)
through formation of self-help groups. In the case of disabled
persons a self-help group may consist of a minimum of 5
persons belonging to the families below poverty line.
3% quota is earmarked for the disabled persons under SGSY.
(2) Disabled persons are entitled to financial assistance
by the National Handicapped Finance & Development
Corporation (NHFDC) at a concessional rate of interest
as detailed hereunder:

1. All loans are to be repaid within 10 years.
2. A rebate of 0.5% on interest for disabled women is admissible.

(3) 3% of funds for construction and up gradation of dwelling
houses free of cost for the disabled rural poor living below
poverty line are kept reserved under INDIRA AWAS YOJANA
(IAY).
(4) Children with disability of Govt. employees are who cannot
earn their livelihood independently are entitled to the benefit of
Family Pension for life.
(5) Persons with disabilities are also provided with different
prosthetic aids free of cost by the State Govt as well as by the
Govt. of India through ADIP Scheme
ADIP Schemes
1. The scheme aims at helping the disabled persons by bringing
suitable, durable, scientifically manufactured, modern, standard
aids and appliances within their reach.
2. The implementing agencies are released financial assistance for
purchase, fabrication & distribution of such standard aids and
appliances that are in conformity with the objectives of the
scheme.
NON-DISCRIMINATION
Persons with Disabilities are entitled to a Barrier-Free
Environment -
(1)In transport
• By arranging easy access,
• By adapting toilets in transport in such away as to
permit the wheel-chair users to use them
conveniently.
(2) On the road
 By installation of auditory signals of red
lights in the public roads
 By engraving on the surface of the zebra-
crossing
 By installing warning signals at appropriate
places
(3) In built-up environment
By construction of ramps with handrails
By adaptation of toilets for wheel-chair users
By installation of Braille symbols and auditory
signals in elevators or lifts.
Benefits & Concession for
the person with mental
retardation
• Educational Benefits
States and Union Territories (UTs) are provided assistance for education
of the children with mental retardation in general schools. The assistance
provided includes the provision of necessary aids, incentives and specially
trained teachers. :
• Education Allowance : Parents in govt. organizations are entitled to have
reimbursement of an amount of Rs.50/- per month as education allowance
as per notification by the Ministry of Personnel (Department of Personnel
& Training). There is also a provision for reimbursement of Rs. 150/- per
month as Hostel fee, provided the child stays in the residential
organization.
• Insurance Scheme: The LIC of India has framed a Group Annuity
Insurance Scheme for the persons with mental retardation. Under this
scheme a parent/guardian becomes a member of an organization where his
ward has been admitted. 25 members as a group should agree to pay
regularly the premium either till the death of the member or upto the age of
58 yrs of the concerned person.
• Pension Schemes : According too the Central Civil Service Pension
Rules 1972, provision is made for grant pensions to the handicapped
person (son 21 & Daughter 24). They are eligible for pension for the whole
life provided Son/Daughter of Govt. Servant is suffering from severe
disability, mental or physical and is unable to earn a living even after
training.
• Aids & Appliances : Person with mental retardation having associated
problems are entitled to have aids appliances either free or on confessional
rates depending upon the income of parents i.e. income upto Rs. 1200/- no
cost, Rs. 1201/- 50% cost.
Cont.
1. Scheme of IEDC: under the scheme of IEDC, which is supported by
department of MHRD, assistance is provided to state govt. for
education of children with disabilities in regular schools.
The facilities provided for disabled children include book &
stationery allowances, uniform allowances, and transport allowance,
escort allowances etc.
2. NHFDC
3. Scheme to promote voluntary action for PWD: under the scheme
to promote voluntary action for Persons with Disabilities financial
assistance is provided to NGOs working in the field of spl.edu. &
vocational training.
4. National Institutes : National institute under the MSJ&E are
engaged in conducting / sponsoring/ coordinating or subsidizing
research in all aspects of special education.

RAILWAY concessions are available for PWDs as per the

2. By Air
(i) 50% concessional fare can be availed of by Blind person
on a single one way journey or single fare for round trip
journey on all domestic flights by the Indian Airlines. No
concession for escort is available.
(ii) 50% concessional fare can also be availed of by a
person with 80% locomotor disability.
(iii) No concession of escort is available.
3. By Surface Transport
Person with mental retardation are allowed
free travel facilities in buses run by state
transport corporation (except deluxe)
INCOME TAX RELIEF
(i) A resident individual having permanent physical disability is
entitled to claim a deduction upto Rs. 50,000/- under the
Income Tax Act. For severe disabled persons relief is of Rs
75,000/-
(ii) The Act provides for deduction of a sum of Rs. 50,000/- for
maintenance of handicapped dependant including medical
treatment.

REDRESSAL OF GRIEVANCES
Persons with Disabilities may move the Commissioner for
Persons with Disabilities at Chennai and district social
welfare officers for redressal of grievances relating to the
rights provided by Persons with Disabilities ( Equal
Opportunities, Protection of Rights and Full Participation)
Act, 1995 and National Trust Act 1999.

• The Ministry of Human Resource of Development has
started in 2000.
• Free education would be provided.to every student with
and without disability of any category.
• Free aids and appliances would be provided in integrated
and inclusive education environment.
Viklang Bandhu
The Disability Division under the Ministry of
Social Justice and Empowerment has started
this scheme for the rehabilitation of disabled
people in rural areas.Under this scheme, after
the three month training viklang bandhu
becomes responsible for providing training and
rehabilitation services to disabled people in rural
areas. This community based project is going on
in some district of different states of the country.

Insurance scheme for M.R. children
The Life Insurance corporation of India has framed a Group
Annuity Insurance scheme for the mentally retarded
individual. Under this scheme parentsguardians become
member of an organization where the child is admitted, 25
members should agree to regularly pay the premium till the
death of the member or upon the age of 58 of the M.R.
person. LIC will pay the annuity every month to the trust
formed by the institutions in which the parents have joined
as members. The trust will look after the welfare of the
retarded person and pay for his maintenance to the
organization in which he lives. Major drawback in this
scheme is that the retarded individual should be in the
residential institution.

Provisions
• Article 14: The state shall not deny to any person equality before
the law or the equal protection of the law within the territory of
India.
• Article 41: The state shall within the limits of its economic
capacity & development, make effective provision for securing the
right to work, to education and to public assistance in case of
unemployment, old age, sickness & disablement & other cases of
undeserved want.
• Article 45: The state shall endeavor to provide within the period of
10 yrs from the commencement of this constitutions, for free and
compulsory education to all children until they complete the age
of 14 yrs.
• Article 46: The state shall promote with special care, the
educational & economic interest of the weaker sections of the
people and in particular scheduled castes & scheduled tribes &
shall protect them from social injustice & all forms of exploitation.
Mental Health Act 1987 (MHA)

National Trust Act 1999
• Parents always have the big question in their mind of what will happen to our child after
us. The National Trust Act is an answer to this question.
• The National Trust Act has made provision for appointment of guardians for those who
have applied and residential facilities by organizations who will have to maintain minimum
standards prescribed by the trust in terms of space, staff, furniture, rehabilitation and
medical facilities.
Objectives:
1. To enable and empower persons with disabilities to live as independently and as fully as
possible within and close to the community to which they belong
2. To strengthen the facilities to provide support to persons with disability to live within their
own families.
3. To deal with the problems of persons with disability do not have family.
4. To promote measures for the care and protection of persons with disability in the event of
death of their parent or guardian.
5. To evolve procedure for appointment of guardians and trustees for persons with disability
requiring such protection
6. To facilitate the realization of equal opportunities protection of rights and full participation of
persons with disability.
7. To do any other act which is incidental to the aforesaid objectives.

    Insurance scheme forM.R. children The Life Insurance corporation of India has framed a Group Annuity Insurance scheme for the mentally retarded individual. Under this scheme parentsguardians become member of an organization where the child is admitted, 25 members should agree to regularly pay the premium till the death of the member or upon the age of 58 of the M.R. person. LIC will pay the annuity every month to the trust formed by the institutions in which the parents have joined as members. The trust will look after the welfare of the retarded person and pay for his maintenance to the organization in which he lives. Major drawback in this scheme is that the retarded individual should be in the residential institution.

    Provisions • Article 14:The state shall not deny to any person equality before the law or the equal protection of the law within the territory of India. • Article 41: The state shall within the limits of its economic capacity & development, make effective provision for securing the right to work, to education and to public assistance in case of unemployment, old age, sickness & disablement & other cases of undeserved want. • Article 45: The state shall endeavor to provide within the period of 10 yrs from the commencement of this constitutions, for free and compulsory education to all children until they complete the age of 14 yrs. • Article 46: The state shall promote with special care, the educational & economic interest of the weaker sections of the people and in particular scheduled castes & scheduled tribes & shall protect them from social injustice & all forms of exploitation.

The National Trust Act is an answer to this question. • The National Trust Act has made provision for appointment of guardians for those who have applied and residential facilities by organizations who will have to maintain minimum standards prescribed by the trust in terms of space, staff, furniture, rehabilitation and medical facilities. Objectives: 1. To enable and empower persons with disabilities to live as independently and as fully as possible within and close to the community to which they belong 2. To strengthen the facilities to provide support to persons with disability to live within their own families. 3. To deal with the problems of persons with disability do not have family. 4.
