1) The petitioner submits that, petitioner is the absolute owner


of the Vehicle, the said vehicle document stands in the name
of the petitioner, there is no rival claimant other than this
petitioner.

NO KA 02 KF 9770. ITEM NO: 02

If the vehicle is left in the open place, subjecting to the


environmental conditions i.e.., sun light, rain and other
conditions, the vehicle get spoiled and decline its value.

2) The petitioner submits that, the Complainant police had


registered a case against the accused on the complaint for
the alleged offence punishable under section U/S 303 (1) of
BNSS 2023.

3) The petitioner submits that the during the course of


investigation the said of the accused person.

4) The petitioner undertakes to produce the said vehicle before


this Hon’ble Court as and when directed to do so. The
petitioner undertakes to abide by the terms and conditions
in the event of release of the Vehicle.

5) The petitioner duly identified the vehicle before the police


station, the vehicle is required for regular use, there is no
claim raised by the petitioner in respect of vehicle. In case of
third-party claim, the petitioner will be held responsible for
future consequences.

WHEREFORE, the petitioner prays that this Hon’ble Court


may be pleased to release the VEHICLE TVS NTORG 125
BEARING REG NO: KA 02 KF 9770 ITEM NO: 02 as mentioned
herein below to the interim custody of the petitioner in the
interest of justice.
